@karsheka If the visa has already been granted, then no. 

The only time they can act on this, is if the visa process is still in process (at any  stage - up till grant).
- After which the only way they can affect your grant is if you leave the company after receiving the grant (within 2 years), they can then complain to Immigration and tell them that you had no intention on staying with them after grant and you "used" them for PR. In this case, things could get messy.

Hi guys,

I hope you are all well.

I am just reaching out to see how many applicants have been treated unfairly by the Department of Home Affairs.

My case is pretty simple, I have been working full time for a company on a 457 visa for two years after my employer lodged a nomination for TRT 186 Visa and I have applied for the visa.

The nomination was quickly refused by the Department of Home Affairs for the financial viability of the business without requesting any additional documents to prove otherwise.

We lodged an appeal thru the AAT, almost two years have passed now and we don't have any news but I am still working at the same job with the same employer.

Is anyone in the same situation?

Sorry to hear that, in which month did u applied AAT?

Hi everyone, 

I am new here. I am looking forward to our visa 186 submission next week. As we are applying without MA, may I know what preparation work should I do for now? I read on the immi website that they advise health checks and police checks to be done prior but I understand they have a 12 months window period. May I get some insights from anyone? Appreciate heaps.

Hi Irfan Sam,

We did combined application for Employer Nomination&Visa on the 31/07/2017, employer nomination was refused on the 11/12/2017 and the appeal was lodged on the 15/12/2017.

We called the AAT few weeks ago and they advised that the case is still in the queue and has not been assigned yet.

Is anyone-else waiting for a decision from AAT since 2017?

When they refused your nomination, did they ask for any additional information or question?

Did they refused the nomination assesing only the information you uploaded on the website? 

With us they did not give any opportunity to prove otherwise or ask any additional information, we really feel the case has not been given natural justice.

They refused the nomination based on the financial viability of the business, but the fact that the business is still running and you are still working there and getting paid for almost 2 years now have already proven they were wrong, btw did you provide more documents to prove the financial viability when you lodge appeal?  Truely hope you can win this.

Hi SamuelL,

this February 2019 we provided BAS activity statement + letter from employer accountat and most recent P&L hoping to hear from tribunal soon but nothing has happened yet.

Do you know if after the PR will be granted I will still need to keep working for the same employer for 2 more years after the grant date?

It seems a bit unreasonable as I basicallyalteady worked these 2 years already, it feels like a new modern slavery system.

I forgot to mention that my employer was also able to sponsor another employee for 4 years in January 2019.

In general, yes you have to keep working for the same employer for 2 more years after grant, that count down starts from after the pr is grant, no matter how long you have waited for and worked there before grant.

But, as previously posts some people suggest that after you got your pr, they won't usually do anything about it even if you leave the company within less than 2 years, unless the company reports you and proves that you had no intention to work there for 2 years and gave false information when you were applying for your pr, then they might do something about it.

A friend of mine is waiting for a AAT decision since december 2017/January 2018... she applied for a 187 DE.

Still no news at all for her.

Yeah is crazy.

I am wondering if we can all team up and make a "mass" request to AAT to prioritise all these cases which are obviously been unfairly treated.

long time reader first time posting.

I was worried about jinxing my application so I have waited to post.

Mechanic TRT, LR country, 1 person

10/4/19 nomination and visa applied

12/4/19 nomination approved 

16/4/19 medical 

22/5/19 s56 Nz police clearance disclosure request as I didn’t attach

29/5/19 granted this morning 

I know it was very fast. I feel very lucky and wish everyone the best on your journey. It hasn’t hit me yet properly.

Although I'm happy for those people being processed super fast - I'm equally frustrated (and I know I'm not even a worst case of waiting either)

Is there genuinely a pattern of higher priority job types being worked more urgently....or is this an attempt to lower overall timeframe statistics by working newly received applications quickly? Cynical I know but I've seen this sort of stats fudging before elsewhere.

Hi mate,  

I got some inside of this. Based on MIA udpates, Department of Home Affair have two group of staffs dealing the old applications ( they didnt define "old"), also they set up a specialist group dealing with new appliacations. beside those changes, their proority is prcess the applicaitons are decision ready or low risk. So far, there still are 30,000 186 applicaitons in the queue. I hope this help.

I am facing the same situation.In my opinion once they ask for additional documents then it will take time to reopen the file. There is no system of clearing old files now there are looking into 2019 files instead of 2018.

this is a very complex question, in short I will say it depends on the size of sponsor company, the genuine requirement of the posisiton and other factors. For example, if a low turnover, 5 empolyees company hire a accountant, immigration definitely will question the genuine need of this position and define it as a high risk.

Ok, i went to look at the old email with the invitation to comment nomination refusal and the subject starts with "Team 01- IMMI Invitation etc.. etc... "

Any idea what Team 01 is?
