  2. Yes @NickyNook you were right it wasn't the 190. Can I edit the topic title to remove that as a headline and tag? It was a 457 lodged prior to the changes but he is now on the BVA with several months left before he needs to leave the country.

  4. Hi folks, hoping someone can offer advice for a friend who is going through some visa issues. My friend has been sponsored on a 190 visa for permanent residency (as an account) by they're employer for whom they'd worked for 5 years. However the business has gone through a recent restructuring and wanted to relocate him and increase workload significantly. So he left, with that and ongoing issues, terrible working conditions and the employer taking advantage of him and other visa holders he'd had enough. He is a qualified account and holds a BA in Marketing etc although was not strictly working as an account for said company. So, I'm hoping there is an other option for him, he is currently seeking work elsewhere in the hope another business will offer sponsorship. Has anyone got experience in this situation? Any advice would be great. Is it worth him going to an immigration agent for possible solutions. Thanks in advance!

    Thank you all for the advice, we're going to try to see a migration agent to see what we're going to do or what options might be available to us. It was certainly not our intention to build up 9 months in order to get a defacto without marrying, but issues beyond our control have made things very stressful for us in what should be a happy time. We have a lot of documentation that we feel could help support some sort of an appeal or change of visa. Could anyone recommend a good Sydney based agent? Thanks again

    Hi all, I have a somewhat complicated enquiry regarding my current prospective marriage visa (subclass 300). My partner and I have just one month left to fulfill the obligation of our visa, which is to marry and apply for our 820 visa. Despite initially planning to marry in March we have had to delay and have experienced a number of setbacks since I arrived from Ireland in December. Ultimately we would prefer to delay our plans to marry for now and move to a de-facto visa. I have spoken to the department of immigration to enquire about the possibility of an extension and/or change to a de-facto visa without marrying. They have been very vague but say that we can apply for a de-facto visa but that they cannot guarantee that we would be granted a visa as failing to comply with our PMV obligations may work against us. In addition, we can’t provide evidence of 12 consecutive months co-habitation, just the nine months that I have been here. That said we do have a cumulative minimum of 12 months and have been together since the end of 2007. The hope is that based on the setbacks we’ve experienced (which included several serious court cases, documents can be provided) that we can demonstrate what the department describes as “compelling and compassionate” circumstances and waive the 12month requirement. I’m hoping that someone else has been in the same boat, or may be able to point us in the right direction. We've had conflicting information, immi says we 'could' try for a defacto, while a migration agent has told us today that theres no way we would be eligible without the 12month requirement.   9. Wilcer, my partner and I are in the same predicament at the moment. Having had a series of difficult/unforeseen (non-relationship) challenges since we have been together on the visa we are rapidly approaching the end of the visa. We will most likely have the same small ceremony and have something more extravagant later. However, with the set backs we put off our first intended wedding date and now we both feel an enormous pressure with the date looming and are trying to find out about extending our PMV or moving to a de-facto. Does anyone know if this is possible? With exceptional circumstances? Many thanks!

  11. Hope someone might be able to answer my question. I have just come to the end of my private health insurance policy in Ireland and now looking at options for travel insurance to cover my 9month prospective marriage visa but I think I will be covered by Medicare on the visa. Under the prospective marriage details on the immi website it states: "you may use Australia's medical expenses and hospital care assistance scheme, Medicare, but only if you are in Australia and have already applied for a Partner visa" I'm not entirely sure what that means...but in any case presumably I can get private insurance in Oz once I get there or do I need to be an Australia citizen or permanent resident for that any help would be great, cheers!

  16. Congratulations, I can imagine the relief. All these early/quick grants are v encouraging. I lodged my pmv300 in July and have booked flights at the end of Nov, just hoping it comes in mid Nov, might send my CO an email just letting him know I've booked. Exciting!!
  17. Ahhh, I see. Thanks for that MM2Melb, someone mentioned it to me and thought I may be eligible while/if on the pmv. I know a few people who've been out in oz on work visas and it sounds like a great scheme, but as you say I'd trade that for the more secure situation of migrant status!

  19. Congrats Purpledonna!! Amazing time scale. I'm waiting on a pmv subclass 300 and have AB too, emailed him today and got the stock the exact same response as you say. I applied mid-july but planning to fly over end of November going to book tomorrow on the basis of all these early grant dates - fingers crossed!!!

  21. I finally lodged my pmv and these are my stats so far... Visa Sent July 13th Money taken July 15th Medical Booked for July 18th and police cert ready to send on request We started getting everything together in Feb/March and between one thing and another its taken an age to finalise everything so we're crossing our fingers for a speedy grant date. Though I think I will travel to Sydney in Sep/Oct and go offshore once/if it comes through. So relived the application part is done so far, so tedious!
  22. Hi all, just put everything together to post my visa app tomorrow, knowing there may be a slight increase in the fee. Well, its gone up from 1,735au to 1,995au! So annoyed, I decided not to rush through anything and risk the increase, but that's quite a lot! BOOOOO! Hopefully it means they'll increase man power and speed up times! Wishful thinking huh?! As you say mjandmum, lets hope they get the ball rolling and crank up the processing times, oh to dream of a four month grant!! I'm copying a link to a question I have over on the main migration issues page. Its about the NOIM form for the 300pmv if anyone has a quick minute to cast your eye over it I'd be much obliged, off work today so on visa duty!
  24. Thanks a million Attypodian! Your're so right much better to paint the whole picture! We have mine done, and waiting for his from Oz so I might go with 3 from me and two from him. Phonewise, yep good idea to just say why we don't have the itemised bills. We are going to submit some emails but just a smattering to give an idea of dates and so on, same with photos we think. Thanks again for your help!! So good to be on the forum helps maintain sanity levels, hope there'll be some more subclass 300's in the April gang!
  25. hi all, Just putting the final touches to my subclass 300 application. Its taking forever!! OH is in Syndey last time we saw each other was November, so if we get it in early/mid April we'll be looking at September/October nearly another year apart! eeeeeeeek. We might fit in another trip or I may go over early. Anyway, I'm hoping you can help me with a few niggling questions... We are putting together our 888 forms with 3 declarations from his side and 3 from mine. I left Oz in March 08, so only got to know his pals/family very briefly, so although we've been in touch via social media etc, I'm a bit worried about the big gap in time having not seen them since then? (OH has been visiting here, but I havent gone back to Oz yet). I'm wondering if we should just do 2 each, or 3 from me and one from his Dad, or do they even take much notice once its done? Secondly, We have (much to my annoyance) been using our mobile phones to communicate as OH has no computer (LUDDITE), its a running bone of contention. He finally broke and got an iphone 4 but hes struggling with its efficiency!:wink::wink: But ultimately it means that now we are both experiencing difficulty getting proof of calls made over the course of the 3 years so we're really reliant on that information to form the grounds of our 'proof of relationship'. We've been on the phone constantly to our respective service providers with the usual lack of customer service making it very difficult. What we were both told is that we can get a letter from our service providers saying calls have been made between the two numbers between 2008-2011, but no itemized call details, do you think that will be enough? Ta very much, total pain in the gizzards this form filling business!!! Looking forward to having it done so I can enjoy the rest of my time in Dublin, the recession is doing wonders to make it quite fun and vibrant, wont want to leave!
