I received what I thought was going to be my 'Golden Phonecall' 2 days ago and with the risk of ridicule I just thought I would share my situation and ask for any advice.... short story I applied for my PR in December 17 I am currently on a 457 as a marketing specialist. My friend applied in November 17 and received PR June 18 working at the same company so I had a good feeling mine was due soon but having heard some horror stories on here I didn't want to count my chickens. When I applied for my 457 the question any convictions came up. I have had 2 cautions in my life one 14 years ago for drunken disorderly (I'm from Newcastle it's a standard rap) and one 9 years ago for damaging property (again drunk put a cone on someone's car and scratched it) advice given at the time was don't mention it as they are cautions not convictions. When I applied for my PR these showed up on my police checks my MA said don't worry we will write a stat dec saying you misinterpreted conviction and caution and you are sorry, a different person etc (which is true I am 32 years old I have built a house here and have a Australian partner and son. I think in England a lot of things we did seemed normal in our environment but it takes moving somewhere new to realise how stupid and childish you are!) Fastforward to the phone call 2 days ago and you guessed it the response says more info needed it says I made bogus statements in my 457 and I have 28 days to respond as to why. It is a very strongly worded letter and says if they find my explanation not good enough my visa maybe refused. I guess my reason for the post is: 1. Don't be stupid like me in the first place 2. I think you need an expertise on this specific issue All I can suggest please seek advice from few other MAs instead of relying on just one MA. Take advise from your MA but maybe go down the lines of - you didn't think they were relevant as they were only Cautions and not convictions? Maybe a letter from a member of the community as a character reference? We all do stupid things when we were younger mate, that's just part of growing up - good luck!! ali Posted August 9, 2018 Share Posted August 9, 2018 I agree with your agent - a letter detailing how you misinterpreted conviction and caution, how you've seen the error of your ways, never been in trouble since etc (i'd leave out the bit about it being 'normal in Newcastle' lol. Character references may be helpful from both UK and people who have known you here in Aus - ? your boss, Good luck .. your post does provide a cautionary note for people. Thanks Ali yes I will leave the bit out about Newcastle haha! It is called a PIC 4020 and apparently from November 17 it has been enforced a lot more than in the past. Bro my frnd had same problem whn he applied 457. He came here on student visa and smhow didn't mention abt drunk drive conviction. Frm UK but whn he applied 457 smhow case officer requested for UK police clearence where his conviction show up but tht time in year 2013 smhow his MA saved him. He got the same letter u got to explain why he fail to declare his conviction. He get through this tht time. I just asked him wht they hav written tht time. He told me tht they mentioned in letter tht they student visa MA misguided him as he said his ma said he only needs to declare anything in which he served jail sentence. Milkyway Posted August 9, 2018 Share Posted August 9, 2018 You have to be honest and tell them the truth with the background to the offences as explained here BUT ignorance is not an excuse that what the police always say. You haven't had any issues here so that will work in your favor I personally think you'll be ok as they weren't serious offenses and no prison sentence. Good luck and let us know how you get on ! Ah, didn't really answer my question - also a pretty big assumption (especially based off of how many people are well passed their initial waiting period) Anyone else? In the beginning around jan18 to april 18 they kept saying waiting for the first available co to open my file. Only your MA or employer can talk to us to find out about this application..... now MA says they won’t tell us too exactly what they are or have been doing with this application so no use contacting them......and again waiting waiting and waiting Now by telling you all this I don’t want to hurt you or guide you about processing time.... i just want to tell you that don’t believe in any rubbish they tell you over the phone as I think they themselves doesn’t know whats being done on file they just say random stuff to keep us waiting....don’t be so hopeful or super excited about anything just by a phone conversation because its breaks when the waiting game time keep increasing. It might come tonight or it may take 5 months ....just don’t think about it. I am telling you cause I am going through it and think i have gone into deep depression that even if i want i am finding it hard to come out of it or stop thinking about it. It’s affecting whole family .... just try not to be super excited by any phone conversation as if it didn’t come any soon then you will end up worrying and thinking more about it. All the best My MA indeed told me before that actually only the MA or employer can contact them about the status because employer was asking for a nomination, not us, and MA is helping the employer to go through all the process and document submitting, not us. If the nomination gets approved. it is MA's task to ask about our visa's processing status. If using a MA, then immi depart CO would contact your MA directly, not us. Actually my MA has contacted the CO recently but MA said better not hoping them would give any answer because if it is not our turn to get assessed, then there would be no answer. Calling them is a waste of time, no use. They just set up a place for us to tell the frustration, but not taking any action. And we never get any true answer. I do understand your status of anxiety and depression as, believe me. I don’t know why these people treats us like pieces of paper and have no human compassion for our situation. I wish them to live in a limbo for more than 15 months, with a job that pays you the minimum for the max effort. Is someone who have same situation plz help wht can do now , send them remind them or just wait. My employer is impatient now. He give me strees everyday. BTW, Did the CO give you the link to pay the language fee or you just got CO's letter to tell you show the evidence? Because mine is a correspondence from CO and asking for proof of evidence from my partner, but not giving the link. My MA said we have to wait them to give the link to pay. Anyone knows about this? He was planning to apply for a student visa and he ask me me to find a job for him because he was struggling economically ,so I found a job for him and I texted to his cellphone all the details about the job,hours,money, etc.i told his also to put my address and my details on his boarding pass. on his arrival, immigration call me and ask me if he’s going to stay with me and if he is coming for tourist reasons . Officers made him step aside for further inspection ,and the seized his cell phone ,obviously the found all the messages from my number and they canceled his visa. And the nightmare starts for me.. 2016 my wife found a company to sponsor her (457 visa) we submitted the application,and after 2 months we went overseas for a holiday break. on my departure when I gave my passport for check, they did further checks ,on my arrival same thing they did further checks ,I asked them with very polite way if something is wrong and the replied all good. i was afraid the won’t grand me my 457, but after 3 months we receive the grand notifications for all the applicants. last year we went again for holidays overseas...same story further checks on me. so my question is , am I flagged ? and is it gonna affect my application for 186 trn thanks in advance Quote Link to comment Share on other sites More sharing options...
