  1. My employer applied for a 457. The nomination for sponsorship was refused on 10th November, with option to appeal within 21 days I believe this means my current Bridging Visa A will be set to expire Have been advised not to appeal, but working on some other options. I am assuming that at the end of this 21 day grace period (1st December), I will be notified that I have 31 days left till my Bridging Visa expires. Q1 - Do you concur with this? If I were to withdraw my application before the end of the appeal grace period, I believe this entitles me to say that I have not had a visa refused on future applications, as its not the application they refused, but the nomination from the employer. Q2 - Do you concur with this? So, ideally, to maximise my time in Australia, I should wait till a couple of days before 1st December and then withdraw my application. I should then receive notification that my bridging visa will expire in 31 days. This will buy me valuable negotiation time with my employer/other employers. Q3 - Do you also concur with this approach? Looking for some advice from anyone out there, would really appreciate any tips or knowledge in this area. :wub:
  2. Background Arrived in Aus 2010 on a Student Visa. After Uni, obtained a 485 Skilled Graduate. Currently working for an employer in my skilled nomination. Applied for a 457. Unfortunstely, nomination for sponsorship was recently refused due to salary issues (long story, but legal advice has said not worth appealing) Currently under a Bridging A (class WA) as I still have till the 1st December to appeal against my 457 decision. I intend on withdrawing my 457 application before the 1st of December. I believe that upon doing this, I will then be given 28 days on withdrawing, for my Bridging Visa to remain valid. Option 1 - New 457 Application I am currently working with my employer to potentially find another role with a simpler contract that meets the needs of a 457. I would then need to apply for a new 457 application Q1. Whilst on my current bridging visa, can I apply for a new 457 onshore? Option 2 - Lodge a Tourist Visa (600) The above might fall through with my employer and therefore I want to find work elsewhere in Australia. I would then like to apply for a 6mth Tourist Visa so that I can continue to find work. Q2. Whilst on my current bridging visa, can I apply for a 600 Tourist Visa onshore? Can anyone perhaps offer some answers to my above two questions. If anyone has any other ideas or useful advice, would really appreciate it. I would like to avoid getting myself into any high risk categorys with IMMI by having anything refused, so want to do everything right.
  3. I am doing a skills assessment with Vetassess. I only need to get these from one prior employer. a) I dont have these anymore, and my prior employer can only provide screenshots of my records from their software. I dont think this will suffice for Vetassess. b + c ) I also dont have these. My question is, how would I go about getting a copy of these from HMRC? I cant see any request forms from their website.

  5. a) No. None b) Ive been a gis CONSULTANT for last 5 years, 3.5 of which have been in Melbourne. The last 3.5 years has involved management duties in my role. The Vetassesss skills assessment costs $650. Does anyone know if they offer any sort of pre-assessment where you can work out your chances before splashing out on a potentially waster $650? Happy to pay a fee but cant see any service on their website. If anyone can send me a link that would be great.
  6. Terry - appreciate the humour, but im not really in the mood right now. HippyChick - Yes, 3.5yrs. Ur right, if I was lodging from scratch, I would fall into the temporary transistion stream, not req my skills to be assessed. However, as mentioned on my other post, im in a situation where I was in the middle period between 856 (when my employer lodged) and the 186 (when I lodged final application) and have been told today that I am forced to apply for direct entry stream (which requires skill assessment). Thanks.
  7. Im in a bit of a predicament, more info on this post. Currently on 457, doing a ENS 186, and current employer lodged me as a Mgmt Consultant. Due to some issues around my employer lodging this when it was the 856, and me applying on my half when it was the 186, the only option I now have is not to be on the temporary migration stream, but the direct stream. So. I need to get my skills assessed as a Mgmt Consultant with vetassess. This is in the Group B field for skills: The truth: I did a degree in Geographical Information Systems (GIS) I spent 3 years in the UK as a GIS Analyst, 2 yrs as a GIS Consultant (didnt manage people, but some project mgmt) Came to Oz on 457 as a Mgmt Consultant, but essentially been working for 3.5yrs as a GIS Senior Consultant. Am I eligible? Vetasses state: source Q1 - Is my qualification in GIS highly relevant to my nominated occupation as a Mgmt Consultant? Yes, I am a GIS Consultant, but its not like my original degree was in how to be a Mgmt Consultant. Its like someone having a financial degree, but then goes on to become a Mgmt Consultant for a Financial firm, same Q applies. It goes on to state: I dont want to fork out $650 to then fail the assessment. The even more annoying factor, is that there is a more suitable occupation (Cartographer) which my employer should have put in, as I would have no problems passing this test. This was not initially an issue as I was under the impression that I would be going into the 186 temporary transition stream, which did not need my skills assessed. From talking to DIAC, I believe that trying to convince my case officer if I can change the nominated occupation will likely result in the application having to be cancelled and no refund, and start over again. Not entirely sure my employer would also want to start another application. Any ideas, or experience from those that have done skills assessments with vetassessas a Mgmt consultant? Its quite a vague role.
  8. Understood, albeit it is understandable why I am frustrated. In my email from the case officer, it states: Please confirm whether you are satisfied with changing the streams. I am hoping that I will not have to cancel my current application and have to pay for another application, and that I can simply provide the additional info required for a direct entry stream. Im responding to the email now.

Timeline: I am coming up to the end of my 457 visa (been here nearly 4yrs, working for just the one employer) My employer lodged a 856 ENS back in January Received nomination approval letter from IMMI on 28th May Started gathering documents and police clearance. Police Checks from Australia turned up on the 2nd July. As 856 no longer existed, was told by IMMI on the phone that I would have to apply for 186 with nomination letter under the Temporary Transistion Stream. Lodged via eVisa and application submitted for 186 on 5th July, all documents required uploaded by the 10th July. Wait... Got Email today = You have stated in your application that you would like to apply under the Temporary Residence Transition Stream. However, as your employer lodged their nomination prior to 1 July 2012 you are only entitled to apply under the Direct Entry Stream. [*]Phoned up IMMI = Yes, this is correct. As your employer nominated beforehand, you have to now apply under direct entry stream. I can either cancel application and not get any refunds and re-apply, or appeal to try and get it converted to an application as a direct entry. source Pretty pissed off, but not much I can do about this. The delays I can understand from IMMIs end, but the misinformation given by IMMI over the phone have led me down a path which I am not sure if I can carry on down. i.e. I might have to get my employer to submit another application (assuming they still want to). I now have to try and work out if I fit the bill for direct entry stream and start gathering more documents. Anyone else been in similar situation? What would you recommend? Ive been told to just communicate with the case officer via email, but expect a 4 week wait on responses.
  10. I actually had to go look this up, as was not aware of what it meant. Provide Registered Migration Agents with the capacity to certify their applications as decision ready No. Ive done my application myself via the eVisa system, but have all the requested docs on the checklist uploaded and waiting for a case officer to review.
  11. (Me, earlier on page 1 of post) Ive still not got a CO allocated. eVisa still just states application recieved. Paramatta office. No idea if its done on first come, first served, but if so, ill let you know as soon as I get any change.
  12. yea, similar situation. I was thinking about attaching a note (.txt) to my online app, saying that ive done medicals, have the paper copy with me, and that IMMI advised on phone that it would appear in eHealth for them, but I did ask about 2-3 days after the 186 was introduced, so im also thinking that perhaps this may slip through. I will phone them, just cant today, as its usually a good 1hr wait till u get though. Ill keep u posted
  13. I applied on 5th July. Uploaded all docs by mid July. Medicals were done prior to lodging, and have the sealed envelopes on my desk - apparently IMMI are ok about this, but as its been awhile without hearing from a case officer, ill be ringing to find out whats going on. The online system was full of bugs when I have been using it and in dire need of being improved. Still, it has done the job. If you look at the posts ive made in last few months, ull find some of my problems.
  14. I got in there quick and lodged my 186 on 5th July. Uploaded all docs that are on the checklist (no form 80, which was nice). Still not heard from a case officer, will be ringing tomorrow. Some other info on here.

  16. Lodged my 186 on the 5th July, had all documents on the checklist uploaded by about the 15th. IMMI told me on the phone that the medicals I did a couple of weeks prior to lodging would be ok. However, ive recieved no update on my visa other than a quick auto-response when i lodged it. Will ring them back tomorrow.
  17. Just spoke to IMMI. They said that this is by design, and that it should only have one applicant in the drop down. Id say that it is not that intuitive. Ill rename my files, so that the applicant name is the suffix for all relevant files.
  18. See image. I have lodged a 186 via the eVisa system. I am the primary applicant, and I also have my de facto partner included as well. I need to start attaching files against my application. It only seems to let me attach files to the primary applicant, but on the 186 checklist I need to provide several attachments that relate to her. This looks like a bug. I can't find an email address or contact form for reporting technical difficulties with the eVisa system. Does anyone have an email or link?

  21. Im doing a 186. Looking at the checklist, it asks for 'Evidence main applicant has worked as a subclass 457 visa holder' I have worked for my current employer for nearly 3 years under the 457. I was assuming that because I have a nomination approval letter already from IMMI, then do I need to still proove that I have worked there 2 years? My HR department can take a bit of time to provide documents, but what sort of evidence should I provide in this instance?
  22. Despite the fact thats not the response I was looking for, I really appreciate that response. If this the case, its very annoying. I actually had to fork out the fees for my employer to do the 856, and they had to spend a lot of man-hours getting the relevant material together to lodge the first part. I have been trying to get in touch with the Paramatta office who sent the nomination letter through, but keep getting answer phone. Left them an email, but dont expect a response anytime soon. I will update when I get through to them. Any other channels I should be going through? **edit** Just read your response a fifth time and realise that you believe that I might still be in luck. (not holding you to anything). Ill let you know what I find out. I have everything filled in on the eVisa site for my 186, and have inputted my approval number. Just weary on tapping in credit card until I get a definitive answer...
  23. I went through an agent for my 457, and they no longer are around. They did send me through some emails from IMMI, when my 457 was approved, but none havea 13 digit number on. How should I proceed to find out my Visa Grant Number?
  24. bump. So, if I am currently here on a 457, I believe I now know that the Visa Number is the long number at the bottom of my 457 label in my passport, beginning with V. I am not entirely sure what my Grant number is, or if it even applies to my 457. As quoted above - it says on the online application that it is 'a 13 digit visa grant number of your most recent permanent visa.'457 is not permanent for starters. And looking at both my 457 label in my passport, and the original approval letter from IMMI, I can not find a 13 digit NUMBER. Can anyone else help? Perhaps I leave this blank?
