  1. Hey all, When nominating a person for the 856 would you say immigration will need to be shown evidence of training in the company. And if so does the amount spent on training need to be a certain amount? Are they strict on this issue? Did your sponsor need to show this when nominating you for an 856?? Thanks so much.

  3. Has anyone else heard this - as a friend of mine has an ENS 856 visa and went for a mortgage. She applied for 95 percent and got pre-approval but when it came down to it the insurance indemnity company (who are required if you dont have a 10 percent mortgage) refuses to acknowledge the status of the perm ens 856. They cannot provide the insurance - for permenant residency obtained on these visas - due to them being linked to the temp 457 visa - even though the government acknowledge they are permenant visas. Bottom line is on an ENS 856 visa - you will not get a mortgage unless you have 10 percent deposit (its out of the banks control). Can anyone substantiate this? My friend (who is a hairdresser - and speaks to many english expats) advises that she has heard the same problem reported by loads of people. Interesting/Worrying !!

    Residency 856 de facto removal

    cut a long story short, with my partner for over 3 years, came to oz in 2009 and we got residency in september of this year through my company. soon as we got it she left me. how do i go about removing her from the residency. basically she has admitted that she used me for the residency and moved out straight away. any advice would be good before i go down the legal route.

    856 Issue.

    My employer lodged for an 856 application about 3 months back. Got the approval nomination letter through on the 16th May. Since then, I have been compiling all the neccessary paperwork to submit the 2nd part of my application (employee side). I have been delayed due to the police checks for Australia still not turning up. Ive just spotted on IMMI site for 856 that things have been turned upside down once again: Which checklist should I now be using to do the second part of my applicaiton? I am confused on how to proceed. Really appreciate any help.
  6. Hi everyone, On 28th of June I will fulfil condition of "have worked full-time in Australia in the nominated occupation for the last two years prior..." for my 121/856 application. My current 457 visa expires on 1st of July. So technically I have only two working days (28th and 29th) to submit my application and get bridging visa. Is it possible to get bridging visa within two days? Anyone else had such a short time-frame to apply and get bridging visa? I'm planning to send my application a day or two earlier so that it can be in Parramatta on 28th. My employer already logged nomination application. Thanks.
  7. My partner is filling in form 47A as a defacto partner to accompany my lodgment for an 856 visa. We have the approval letter from IMMI in response to my employer lodging the initial part of the 856 visa. Q3 on form 47A asks: Other people on the net have mentioned leaving it blank or perhaps using the application ID from the approval letter. What is the correct number to fill in here? :rolleyes:

    DRC for 856 ENS

    Hi All, My wife and I have been in Melbourne for 2 years on a 457 Visa. We have subsequently had a positive skills assessments, medicals, police checks etc. and have completed the entire application process for 856 ENS with all the correct documents and it is ready to submit. However, we are wondering: 1) Is it worth instructing a registered migration agent to submit the application on our behalf with a DRC? 2) If so, how much will they charge? 3) Can anyone recommend an agent who has done this before? We have received conflicting advice that 'DRC doesn't make a difference', however, looking at the DRC thread it appears those application are processed quicker. We would be submitting to the Melbourne CE. Any advice would be appreciated. Thanks, BL

  10. This has been raised on a few other posts but I still have not found a definitive answer. Myself and my partner (both from the UK) are applying for an 856 (without a migration agent) We have already had an approval letter as our employer lodged the first half. The following checklist (which I would assume to be the definitive source for applying for an 856) Employer Nomination Scheme / Regional Sponsored Migration Scheme - Application Document Checklist This form makes no mention of filling in form 80. Employer Nomination Scheme Visa Decision Ready Document Checklist (Migration Agent) The easy answer would be to include a form 80 for myself and my partner, but form 80 is not the easiest of forms to fill in and it will take a significant chunk of time for us to gather the info and fill the form in. For an unassisted 856 application, do you need to include Form 80?

    ENS 856 Processing Times

    Hey Guys My VISA was Lodged with Parramatta DIAC in Mid December for the above Perm Residency subclass and I have received today my first step Nomination approval. Does anyone know how long it will take after this first step approval for the full thing to be approved? I'm getting annoyingly vague estimates from many people. Thanks for your help in advance.   13. Hi, The agent lodged my ENS Sub 856 application with decision ready checklists about 1 and half months ago. Does anybody tell me how long the whole processing time for PR approval will be in normal situation? Many thanks in advance.
  14. Hi. I was wondering if anyone could help me with this one. On the 856 visa (perm ens) document checklist on the first page it says "do not undertake a health check unless requested to do so". But on the immi wesite in the health requirements section it says you need to do a medical for all permanent visas. Could anyone clarify if I take a medical in advance or not for the 856?     856 nomination. Is there a limit?

    Hi I'm on a 457 visa and want to go for 856 visa. I havent done 2 years on a 457 yet, but have lodged my skills assessment recently (its pending). If my employer tries to get me nominated now, and for some reason I don't pass my skills assessment, the nomination will have expired by the time I have done 2 years on the 457. So is there any limit to the amount of times I can be nominated for the 856 for the same employer? Cheers.

    ENS 856: Some Questions

    Hello, First post on this great forum. I am applying for a ENS 856 Visa in the new year. Currently I am on a 457 visa. So I have been doing my homework and getting ready to submit my application but I have a few outstanding questions. I am not going to be using a RMA. My partner is on a defacto visa with me on the 457. She is going to be on the application for the 856 ENS. Do I have to submit defacto evidence again? There is no mention of this at all on the forms I have been looking at. In the new year I will be applying for the VISA as I will be on the 457 visa 2 years. This will enable me to NOT have to go through the skills assesment. My question is do I have to submit all my qualification documents, CV, etc anyway? Lastly, do I need to get my partner to get all the relevant police checks and clearnaces? I know that I have to as I am the primary applicant but wil she? No issue if we do. There ya go!

    Hi everyone, Just wondering if you can help me. My husband has his first skype ineterview next week (nothing may come of it but you never know!). We were just wondering if its expected that we will want a 457 visa from the employer or can we ask for a 856? I am just worried that if we go for the 457 we may move our young family to oz and then not get perm residency as his job might not be on the SOL list in two years or he loses his job etc. We also dont want to put the employer off by asking for too much. I would appreciate any advice. Thanks

  20. Does anyone have any idea how long they are taking to process ENS 856 onshore visa applications. My employers nomination has already been approved and we have at last couriered ALL our paperwork off, medicals, police checks etc., to our Migration Agent and they are anticipating that it will be "decision ready" and will be forwarded to immigration within the next day or two. We are in Brisbane so not sure what processing office. Any feedback or personal experience would be greatly appreciated. Waited so long to get to this point, cant help but get a little excited

    Hello Everyone. Can someone please help me on this issue please! Question: Can I apply for an Onshore 856 ENS Visa under my current visa? IMMI states that the course must be diploma award or higher. A diploma award is under Subclass 572. I have completed a CERTIFICATE under the same Subclass 572. Cheers, Eoin
  22. Hello PIO's, As the subject says; I am in need to some clarification regarding our 856 ENS application. My husband's company lawyer had lodged his application in August with me as the non-migrating partner. I returned back to OZ on a Tourist Visa and the lawyer had my husband sign a letter advising DIAC that he would now like for me to be added onto the application. I am not sure what else the lawyer would have sent with this letter to advise DIAC to add me on. We have asked the lawyer to clear the doubts but its been extremely frustrating for us to get anything out from him as he's not helpful at all. That is why I need assistance with the following; 1. Should'nt I be on a Bridging Visa already? I am concern as I do not want t be unlawful should I still remain assuming my Bridging Visa has kicked in when my Tourist Visa expires. I am also afraid to contact DIAC to enquire incase I alert them to the fact I am applying for PR whilst on a TV. 2. Would'nt DIAC send some sort of an acknowledgement to advise that they will add me onto the application? Many thanks in advance for any assistance provided with clearing my doubts. SW :hug:
  23. Hi, I am currently on 457 visa which would expire in next few months. I have applied for onshore 856 visa and my understanding is that I would be granted bridging visa after 457 visa lapses if my application for 856 is still not processed by then. I understand that you get 28 days to leave the country should your application gets rejected. I was wondering if anyone knows whether I could apply for second 457 whilst awaiting the outcome of 856 since that would give me enough time to apply for some other skilled pathway should my 856 gets rejected. I know that I cant apply for 457 whilst I am on bridging visa and that is why I would like to apply for second 457 whislt I still have valid 457 visa. I read somewhere in forum that the second application cancels the first application....would my 856 application get cancelled with this rule then?

    ARTC and 856 Visa

    Hi, I am having trouble with my 856 visa, I applied through TRA to have my skills assessed for the visa, all granted OK. Visa was lodged and case officer issued, says I need a licence. Applied for licence using TRA outcome assessment and it got rejected saying I need an ARTC from TRA. This application seems identical to the one I've already done successfully but just with a diff certificate! Can anyone shed any light on if my TRA for migration can be converted to ARTC without starting again from TRA as their wait is massive at the moment I think. Thanks Rick
