not that I'm an expert but I read a lot about it as I needed to do the same and didn't want to damage any progress so far.

I took 2 months off unpaid as I did not have enough holidays and because of family reasons I really needed to be back home. I made sure I took it in a period with low workload and made sure 2 people, with 2 different skills set covered my work and also made sure I was available remotely in case of emergency. 

Under the Migration Acts and Fair Work Act 2009 we are covered by the National Employment Standards.Leave without pay is additional to any other form of leave which an employee is entitled to take. It is usually granted only when an employee has used up all his/her entitlement to other forms of leave.The length and terms of leave without pay are subject to agreement between the employee and employer. 

Leave without pay (LWOP) is permitted whilst on a 457 visa for up to a year, where agreed to by the employer and documented, as long as you do not work for another employer during any period of LWOP. The genuine need for a position and consequently your position within the company cannot be questioned because you need to take unpaid leave for various circumstances.

Now, few tricky things to consider, you are generally protected from dismissal in case of sick/unpaid/long leave but not anymore in these cases:

An employee is no longer protected from being dismissed (even if they provide evidence) if:

  • the total length of their absence due to illness or injury is more than 3 consecutive months, or a total of more than 3 months over a 12 month period
  • over that period they’ve only taken unpaid leave, or they’ve taken a combination of paid and unpaid leave.

 

now the other tricky thing:

you are on bridging.. so you should read your entitlements for that visa. As far as I am aware they should be similar to the last valid visa you held before going into bridging.

Hi All,

Please don't consider me as a free rider. I am a silent reader of this thread for  many months and didn't want to register as my knowledge on this topic very few. 
 

Regarding me, I am currently holding a 457 visa and planing to apply 186 TRT at the end of this month. Wish me luck !! My problem is current employer said his Standard business sponsorship (SBS) has expired this year and he not going to renew it as he not willing to do the sponsor  any more.

Q1. Is this going to affect me? he said no

Q2. Is he not required to meet training benchmark after his SBS expired?  he said no

 

While waiting to consult MA your valuable thoughts on this matter highly appreciated 👍

Furthermore If anyone know good, experience MA who can handle this case and located around Melbourne more than well come to introduce.

Hi @GTRZ

If I understand your concerns correct, then yes, both those items will affect you. 

Q1. If your employee is no longer registered for sponsorships, they will not be able to lodge an application for sponsorship. 
    There is a reason you need to stay registered. 

Q2. Every sponsorship should fall under the same requirements, meaning if a training requirement is needed for any 186 TRT - then it's the same across the scope. 

I suggest you confirm all this with a MA soon, as I feel this will directly affect you (unless i've misunderstood something).

According to my understanding on the attach screenshots, it states that our employer must be an approved active Standard Business Sponsor. Meaning that on the day of nomination lodgement the business must be SBS approved. Otherwise the business won't be able to nominate you as it is a "sponsorship" visa program and shall comply with all requirements.

Question: I have a nomination TRN, is there a way I can check nomination status?  In my IMMI portal, I can only see my application. 

I asked the same question earlier and no one seemed to reply, so I'd assume that is impossible to do. That makes sense as it's an interaction between your company and the immigration.  If you find a way pls let me know 🙂

You won't be able to see the nomination status, as it contains sensitive information of your employer. Therefore, only your migration agent would have access and your employer. With the TRN number you are only able to track the status of your visa application.

That's correct. However, do check your Message Box regularly as outcome of the nomination will land there.

@ICT Customer Support Officer It's very unlikely you'll be able to get access to the nomination application. 

    You can try and import the nomination with the TRN number, however, i'm not sure it will allow you access to same. 

This is because, the nomination is for the company (typically applied for through the MA Immi account), which includes all the company finances etc. If you have gone through an MA, I can almost guarantee that they won't allow you access to same (not without explicit permission from the company - even then it's not for sure). 

My suggestion would be to hold on tight, wait for the nomination to be approved (the MA should tell you) and then monitor your application closely.

I will have to look at my own specific circumstances as you have advised because i was on a working holiday visa before i was employed and so my working rights changed to being able to work for an employer for longer than 3 consecutive months as soon as i applied for 186 visa so im probably in some grey area some where with what rules i fall under but my goodness you have given me some hope!
