  1. Yes. Could not go DRC for the nomination due to Employer's reluctance to provide a particular document on the checklist. Fingers crossed (other documents submitted in lieu of that and all training benchmarks cleared). Visa will go as DRC Ok. I think there maybe an assumption amongst people here (or my inference from the past 8 months) that people were logging the acknowledgement as well. Thanks!
  2. Hey guys, Is there a correlation between : 1. Date the Nomination was applied 2. Date it was Acknowledged The reason I ask is because I've finally heard from my lawyer that he lodged the nomination however he provided an acknowledgement letter the same day. What is surprising is that I don't think all the documents were fully submitted, so I don't think the nomination acknowledgement is or should be an indicator of any progress

  4. Thanks for that. I'm not sure if you can reveal where in the process or at what stage that question/drop down shows up. I'm not quite sure what may have occurred with mine in that case @Raul, have you done a 186 Visa application under the new software portal as well? Im just wondering if the wording and the dropdown appears the same, I'd like to advise the agent of that.
  5. Originally planned on applying in January 13 and after many different delays I'm happy that my Lawyer filed the ENS186-Transition Nomination yesterday. Apparently the NEW (July2013) DIAC portal allows only upto 10 documents to be uploaded. So he managed to get an email address and he was told to submit the documents there. ALSO THERE IS NO OPTION TO INDICATE DRC - Decision Ready?! Thats ridiculous. Finger's crossed and hoping for the best, my file is extremely thorough and straight forward.   7. I thought over this last night and realised I may have answered my own question. Lets consider a hypothetical situation : 1. Mr.Apu has live in London on a 3 year work permit from Feb 2010 till Feb 2013. 2. In Feb 2013 he was required to return to India as his work permit for UK expired and he need to re-apply (offshore?). 3. Technically Mr. Apu is an NRI since he spent the last 3 years overseas. Visa requirement is a PCC for any country that the applicant lived in for 12 months cumulatively. Therefor for up until 2010 the Indian PCC and 2010-2013 the UK PCC. So technically a NRI are able to request a PCC at their local RPO in order to apply for future visa's! (The drama this involves I don't even want to know). Finally : This is not to say that DIAC will accept this, it's just an angle I am pursuing.
  8. That is a compelling explanation, Thank you. I think I will send out some feelers on the ground in India to the RTO to understand if they issue PCC for NRI's. If so I get that in hand till I get some clarity here via an immigration lawyer. Meanwhile I could also return and try my luck with VFS here. If the passport is simiply at the HC in Canberra the process to withdraw it maybe quicker than I expected (worse case scenario that I need to travel/apply for a visa to a country that requires on).   9. Thanks. So when VFS issues a PCC who does that come from? Does it not also come from the RPO but simply that VFS delivers this process? 8 weeks - I may as well resign my job and then wont have an employer to sponsor my 186
  10. Hi Debbie, Generally they would question large gaps. Has he worked atleast 3 years in the last 5 years in his area of trade? Also is it very relevant and can he evidence this through appointment letters,payslips etc? It is very situational. Additionally : 1. Does your husband have an Australian employer that is willing to sponsor ? 2. For the ENS186-Direct Entry scheme your husband would need to submit a Skill assessment from the relevant certifying authority for his trade. I would suggest reviewing the latest checklist here : http://www.immi.gov.au/skills/skillselect/index/checklists/186-applicant-checklist.pdf (particularly page 2/3/4) Using the checklist, see how far you get with a mock "application" and consult a reputable migration agent/lawyer who can guide you. If need be pay the $$ and lodge via a Migration Lawyer who can go to review/appeal if things get complicated. Hope this helps!
  11. Also missed an important point : What is your experience at the RPO if you are an NRI. How do you substantiate your present address? Do they cause trouble saying you are an NRI ?

Hi Guys, Page 40 : http://www.immi.gov.au/allforms/character-requirements/character-penal.pdf States that : Non-resident citizens -> Apply to the nearest Indian High Commission, consulate or embassy in your country of residence. Technically I am an NRI (Non-resident indian) as I have been in OZ for 3 years now. The thing is my application is ready to submit and I'm pending the Indian PCC(I have a valid one from the Police Commissioners Office but as of Feb 2013, DIAC wont accept that anymore). I want to goto India and get the PCC from my local RPO instead of waiting endlessly at the mercy of VFS in Sydney. The reason is I travel a lot on work and cant afford to have my passport locked up with them. Has any NRI citizen successfully had an onshore visa application approved in Australia with a PCC that was obtained from the local RPO from India rather than the VFS centre in Australia? Thanks!
  13. So I have a slight setback. I got a PCC done in Jan 2013 from the Police Commissioners Office. DIAC issued a circular in Feb 2013 to state that PCC now needs to be made from the Regional Passport Office - http://www.immi.gov.au/allforms/character-requirements/character-penal.pdf Since I live in Sydney I am at the mercy of the VFS processing centre : http://www.vfs-in-au.net/policeclearancecertificate.html Pray for me guys?!

  15. Off-topic to the Original poster, so apologies in advance. And that is why we should pay good money for a migration lawyer/agent. Should be the only way I guess. I created such a concise file for my student visa and did all the work myself but it is mandatory to go through an agency (in India) and they are able to lodge online. This was in Dec 2009, I received it in a record time of 14 calendar days. It can be something as simple as missing that one of your documents somewhere is spelled Philipp and not Philip. Most people would overlook this. I instead had an affidavit made and notarised to state that it was an error and both were one and the same. Necessary? Nope.
  16. I took the IELTS - General this morning.Went there hungover with 3 hours of sleep - NOT RECOMMENDED:wacko:As I could not care less to what my score was I will admit to being sloppy. Even though I am not a "native" English speaker, I previously scored and 8.5 on the Academic when I first came to Australia to do a Masters Degree. Biggest tip : work on the listening test, that is the only one NOT in your control. General tips : they are testing your command of the language and not your GK. So if you knew how to build a rocket ship but did not articulate it well enough too bad! Instead someone describing how to make scrambled eggs has a better chance if they stress,pause and are lucid in their message. Good luck!
  17. The skills assessment is time consuming and cost me around $700. You are like 75 days away from being able to apply under Transition. Approach you employer now so that they start to prepare for your nomination. Until your PR is granted, you can travel in and out on the 457. At this stage maybe consult your company migration agent or book a slot with some of the agents who support this forum. Good luck!

  20. 1. Yes it makes sense for you to wait (however I took the decision to push through with Direct Entry, even though I qualify for Transition in August. Why? Because I had my skill assessment and a clear employment history ) 2. Your existing 457 will continue to be valid until your PR is granted. In other words, you do not lose your 457 even if your PR is rejected. My advice to you is to start as much paperwork as you can now. Especially the nomination papers with your employer. There will be a formal process where you need to sign off regarding who covers costs etc. Police Clearance for any country that you have spent atleast 12 months in the last 10 years(in my case 3 different countries) Other bizarre documents like birth certs etc. Good luck

This is only if your visa was already "approved in principle" by the Case Officer (CO) who then requested your medicals and PCC to complete the process. For new applications that havent been allocated or finalised, there is no guarantee on the approval timeframe. So if you applied for your visa with medicals and PCC and your visa was approved 2 years later, then the CO would request these again as the PCC/Medical become invalid. In that instance, your visa would be granted as soon as you provided the revised documents and nothing out of the ordinary appears there.
  22. 1. If you have completed 2 years on the 457 with the SAME employer you are eligible for the ENS186 - Temporary Residence Transition (TRT) Scheme 2. For the TRT stream you do NOT need a skills assessment 3. You do not need to put in an EOI(interest) for the ENS186 - The ENS = Employer Nomination Scheme 4. If you have a British passport you will not need and English test If you are on a 457 but NOT 2 years with the same employer you can opt for the ENS 186 - Direct Entry scheme (skill assessment needed).   24. Hi Guys, My skill assessment (VETASSESS) did not require an IELTS score and gave me a positive assessment in December. However for my 186 I require the base score and wondering what I need to take? I will not go back to UNI again so the IELTS is specifically for my 186 only. Any guidance would be appreciated.
