Hi guys, is it really required to stay with the same employer for the 2 years who sponsored the PR ? one of my friend received his PR subclass 186 last year and now he is getting a good offer from a company. But his HR has indicated (not a formal or written communication) that he needs to stay with the company for an another year before he can quit. Is this really legal?

Of course it is.  His company paid out a lot of money in fees and devoted staff time to preparing all the paperwork for his visa application.  They are entitled to expect him to honour his side of the bargain.

They can't force him in the sense that there must be a reasonable buyout price in the employment contract addendum. Maybe he has to pay all or a portion of the company's visa costs, which would be reasonable.

If there's no written agreement about it, he is free to leave. It is not a legal requirement in that case - more a moral one as they did spend a lot of money on his visa.

We were told by my wifes employer that it cost them $5.500 all expenses included. So maybe it's worth it depending on how great the new offer is - maybe it's not....

If in doubt, talk to a lawyer.

My employer asked me to sign an agreement before they started processing my 186. The agreement says" We will bourne the whole cost, you need to serve 2.6 years after the grant, else pay the money and leave".. So I have the option to buy out and leave the employer.

visa and nom applied : July 2020

no comms until grant today.

onshore

Actually that's incorrect, there's no legal requirement to remain with the employer who sponsored the 186 visa.  All that is required is that the visa applicant intends to stay with the employer (similarly the employer commits that they intend to employ the applicant for 2 years after the visa is granted but they aren't legally required to do so).  There's a possibility the employer could complain to DHA if the visa holder resigns quite soon after the visa is granted in case they think the applicant was already planning to leave before the visa is granted, but I've not heard of DHA taking any action against visa holders who quit.

It seems in August, 1391 visa applications have been granted for subclass 186. See

This is less than July (which had over 1982) but more than June (639), May (715), and April (383).

On the other hand, each month typically a bit more than 2000 new applications are lodged.

That budget is for pertner visa, but your partner was applying 186 secondary applicant visa, wasn't her?

I informed her personally. I do not think they get notified automatically by the system, if that's the case , she would have expressed the concerns quite earlier.

That link doesn't talk about the 186 tho...

Looks pretty easy. Has anyone done it and sure doesn't compromise application at all?
My MA is Deloitte and they told me that they prefer I wouldnt do it...

It doesn't compromise anything. I imported mine without agent knowing, and got my grant. As long as you don't upload or change any information yourself, using it to monitor status is fine.
