Hi ...this information is on ******  page..hope u get your answer in there..as long as i know " it doesn't matter if ur occupation is still on the list on not ..if u applied before 19 april,and your application is meeting all the requirements such as training benchmark and all,,u will definitely get your PR. The applications that got rejected , they definitely got reasons for rejections..hope everything will be fine for them who are waiting as government said again n again in news , 96000 existing 457 workers will get processed under old rules.hope it helps.

19April 2017 changes in 457/ENS/RSMS - Further Info by DIBP. 

What has already changed?
A. As of 19 April 2017:
• the Consolidated Sponsored Occupation List
(CSOL) has been replaced with the new Short-term Skilled Occupation List (STSOL);

• the Skilled Occupation List (SOL) has been replaced with the new Medium and Long-term Strategic Skills List (MLTSSL);

• there has been a reduction of 216 occupations available for subclass 457 visa programme applications;

• 59 caveats now apply to specified occupations - these either relate to work experience, regional location or are occupation specific; and

• new visa validity periods also apply under the standard subclass 457 programme with a maximum 2 year period available for occupations that are eligible for the subclass 457 programme but not on the new MLTSSL.

Do the above changes have any impacts on existing subclass 457 visa holders?
A. No – unless they wish to change employers or positions, in which case a new nomination will need to be approved under the new arrangements.

Note:
• This will include situations where due to business structure changes, an employer is required to lodge a new sponsorship application and is required to lodge new nomination applications to accommodate existing subclass 457 visa holders (unless they continue to work for an associated entity of an Australian sponsor).

• A new nomination approval for an occupation listed on the STSOL will not result in reduction of the visa period already held by the visa holder.

Can I change the nominated occupation?
A. No – but you can withdraw and lodge a new nomination with a new occupation specified for the nominee. This may, however, raise concerns about the genuineness of the position – particularly if the new occupation is substantially different.

How do the above changes impact other permanent visa programmes?
A. The above changes do not impact on hand (‘pipeline’) applications for other skilled permanent visa programmes.
The removal of occupations from the list will, however, impact clients who lodge an application for one of the following on or after 19 April 2017:

• Employer Nominated Scheme (subclass 186) – Direct Entry Stream
• Skilled Nominated visa (subclass 190)
• Skilled Regional (Provisional) visa (subclass 489)

That is, any applications already lodged before 19 April 2017 for the above visa subclasses (other than a 457 visa) will not be impacted (even if the occupation was removed for these visas on 19 April 2017).

Q26. Can you still apply for ENS if your occupation is on the STSOL but not the MTSSL?
A. Yes – currently, if your occupation is on the STSOL or an eligible occupation on the MLTSSL you can apply for the ENS Direct Entry stream. Current holders of subclass 457 visas continue to be eligible to apply for permanent residency through the Temporary Residence Transition (TRT) stream of the ENS visa. Access to the TRT stream is not based on the occupation lists and is therefore unaffected by these changes.

A. Key reforms that will be implemented from July 2017 for subclass 457 visas include:
• expanding mandatory skills assessments;
• introducing mandatory penal clearance checks consistent with other visas;
• tightening existing training benchmarks; and
• removing English language exemptions based on a skilled migrant’s salary (e.g. if their salary is higher than $96,400).

A. Yes – it is expected that the occupation lists will be regularly updated, based on a range of factors including advice from the Department of Employment and the Department of Education and Training.

What reforms will be implemented on 1 July 2017 for ENS and RSMS?
A. On 1 July 2017, the additional changes below will be implemented for ENS and RSMS:
• raising English language requirements to “competent” for all applicants (IELTS 6) – with TRT and Direct Entry requirements to be consistent;
• upper age limit of 45 for Direct Entry applicants;
• 3 years skill and experience for Direct Entry applicants; and
• further changes to the occupations lists and their application to relevant visas.

What are the changes to the English language requirements?
A. The English requirements for the Short-term stream of the new TSS visa will be the same as the current 457 visa, with a minimum IELTS result (or equivalent) of 4.5 in each test component required, and an overall score of 5.
There will be a higher standard required for the Medium-term stream with a score of 5 required in each test component.

What reforms will be implemented for ENS and RSMS in March 2018?
A. From March 2018, new eligibility criteria for ENS and RSMS will include:
• an upper age limit of 45 (from 50) for most applicants;
• occupation must be on the MLTSSL (unless an additional occupation approved for regional areas);
• a minimum market rate salary: all visa holders must earn at least a minimum salary of $53,900 – that is the TSMIT;
• at least three years’ relevant work experience; and
• a pathway to permanent residence through TRT requires 3 years on Medium-term TSS visa.

More information will be provided about these changes to registered migration agents closer to 2018.

What transitional or ‘grandfathering’ arrangements will be in place for those who already hold a subclass 457 visa before March 2018?
A. More information concerning the legislative details of future changes will be available closer to their implementation date. This will include information about transitional arrangements for visa applicants and visa holders.

No it's good ?? I have read this one before but I am not sure what must be the reasons behind rejections I have applied for RSMS187 on22 Aug 2016 I just wanted to make sure if I have any trouble coz can have a back up plan as immigration is taking so long for processing application

Hi ...as u can see there are many applicants waiting since april with all the documents updated but still waiting for their files to be opened by them.

Rules changing slower the process as well as we are closed to end of financial year in Australia .as per my experience last time after uploading all the documents on 10 march when we were waiting for immi response,we got to know that process will be slower in may_june as it was closed to end of financial year n we  were told that we can get response by the first week of july...and we got responded on 30june.

Its always good to have a backup plan but m sure u'll be fine..it all about waiting!! Gud luck

Finally it's my turn to post something positive.

I got both my nomination and visa approval today.

Applied both nomination and visa on 14th April 2016 through agent

Occupation is Market Research Analyst - (This is now a removed occupation as per new rules. Luckily i had applied last year)

Nomination got approved first, after which i was asked for employer referral letter (which we submit during skill assessment). 

I submitted that immediately and got visa approval within another hour or so.

Few suggestions to people waiting -  

My agent did NOT submit form 80. So pretty much what they request depends on your case. I did pester my agent to submit it after reading threads online. However ensure you submit what they need, don't panic on reading other peoples' cases like I did please.

I know the wait is very very stressful, however make sure you do not let it get onto you like it did to me. Staying calm is hard, but try. 

If you have an agent try following up through the agent because a couple of times the immix people who received my calls have given me different answers to the same questions and also asked me to contact via agent, not directly. 

Thank you very much! This forum has been my only support after my family back in my home country.

Hi guys, CO asked for proof of training benchmark, i have for certificates for one year don't have for two years, my MA said should be fine, i am vry worried cause heard alot of rejections, can anyone suggest something please

Neev that's good news 

your file was open

but as per my opinion you should have to attach 2 years training benchmarks because nowadays many of us suffering from same problem and end of the day they got refusal.

so for safe side u must attach 2 years

Have you reached out to your MA or to immi during the last days? 

I am surprised that the timelines haven't been updated (http://www.border.gov.au/about/access-accountability/service-standards/global-visa-citizenship-processing-times) and I wonder if any of you have heard any rumours about the maximum DE timelines being potentially increased.

  • Salary AUD 100,000 pa + Super
  • Working for an reputed Internet Startup company selling online products/subscriptions with turnover of way over $1 million per year
What are my options for PR?
  • Can I / should I apply for another 457 and try through the TRT stream?
Should I apply for another 457 before my visa expires in Jan 2018 and wait to complete 2 years and then apply under TRT? Would someone reading this recommend that?
  • Can I apply for 186 now under ICT business development manager as for Sales & marketing Manager (AIM) requires me to be the top most executive which I am not
  • ICT business dev manager was recommended by my lawyer but there is no clear definition of ICT anywhere on any government website
Even if I apply to 186 now, and even if I do get a positive assessment as ICT business dev manager, by the time i get a positive skills assesment it will be 3 months + 186 visa another 8 months which means my 186 visa will be in process when we hit march 2018. Is there is risk with that?
 
Also since my 186 will be under process I might not be able to apply for another 457 to complete my 2 year requirement for TRT stream. Is this right?

As your skill is not in MLTSSL (https://www.border.gov.au/Trav/Work/Work/Skills-assessment-and-assessing-authorities/skilled-occupations-lists/mltssl), hence you must have a employer ready to sponsor you for 186. Am not sure if ICT BDM is open for sponsorship by any state or not. 

If you have completed your employment at the current employer for more than 2 years than they sponsor you for 186 Transition. If its less than 2 years, then they can sponsor you for 186 Direct Entry. You need skill assessment if you apply 186 Direct Entry.

I don't see a risk with your application hitting March 2018. As soon as you apply for 186 visa, you are granted a Bridge Visa A that allows you to stay in Australia once your 457 expires during your application process time. 

I can not comment on TRT as am unaware of it. Find out a dedicated forum for answers on TRT.

Hey all, I thought I will share this with you guys, my work has called immi today for follow up and they said that once documents are requested by the CO over the phone they put the file aside for 7 days. 

So then we can make a conclusion that internally IMMI has the following time frames:

- 6 months until file can be allocated to CO for assessment after submission

- 28 days until file is picked up again after email with request for more information is sent. 

- 7 days until file is picked up again after phone call is made to get further additional information

Due to workload assessors might not be able to keep up with these time frames, but this is what we have been advised. 

Hope it helps to address some of your expectations, also if you had request for info and haven't heard anything from them, call them or get your employer to call them.

I didn't hear any rumour about timeline increase. However, mu MA insists that they will not call the IMMI before 10 months of application lodgement.
