Hi everyone, 

I've been silently following this forum on and off for almost a year now. My partner applied for the 186 transition in February last year and the application was made invalid in October (due to a simple paperwork error). It was a huge disappointment but he has reapplied and we're waiting to hear something. 

Just have a question someone may be able to answer. His employer submitted their nomination on 14 October but his application didn't go in until 22 December. His MA recently said that his file won't be open yet as it's a December file, however when we requested priority for this application (back in December which was refused), immigration stated he was an October file. So ... do immigration use the nomination or application date as the order of when they open files? Hope that all made sense!

I think they use the nomination date- but i can't be sure.

What was the paperwork error if you don't mind me asking?

Thanks, I thought so too. It was just that two boxes were ticked instead of one on the declaration form. They asked him to resubmit which he did, but because of time difference between states they didn't receive it by COB and made it invalid overnight. We appealed it but they said they couldn't override the invalid status.

immi requested some documents ?

My immi saying..they refuse applications straighaway with in 7 to 8 months normally in transition visa.

If IMMI is not satisfied with the financial situation of the business by the documents that your provided as asked for in the checklist, then they are well within their rights to either ask for further info or refuse the application. That's the prerogative of the case officer. 

However, if you think that docs are correct and sufficient as per the check list then its your right to appeal.

My agent also said immi refused 30 to 35 files in two weeks.....i m in depression becoz it's 19 months now but still no case officer allocated yet....and visa will expired in 2 months and in hairdressing

That's pretty stressful. Has your agent any explanation on why your file is taking so long?

Do not know suddenly why immi doing this.

@Hapy @badaich87 @pramsahota - Can you try to find more info from your MA about the kind of applicants being rejected such as the applicants occupation, LR/HR, DE/Transition, onshore/offshore, approximate revenue/profitability of the employer etc. 

I think the occupations which are no more in STSOL might undergo high level of scrutiny and even a small deviation from the checklist would lead to rejection. https://www.acacia-au.com/stsol.php.
