Hi All,

 

I contacted DIAC today morning and the lady told me if I get the positive assessment for 261311 Analyst programmer from ACS, I will be able to get the priority 3 based on SOL-3 without lodging new application and will processed sooner.

 

I lodged my application in Sept 2008 as a recent graduate and also had 1 year experience at the time of application.

 

Today for the first time I got the positive response from DIAC but I am still unsure about this reassessment from ACS as it contradicts the new arrangements released on 14th July.

 

I am going to call DIAC and ACS again tomorrow and gonna cross check this.

I just rang DIAC this morning, the response I got was the standard "if you want to nominate a new skill, you need to lodge a new application(!)".

I guess it is far too soon to jump to any conclusion. Better wait until SkillsAustralia and DIAC meeting as chajath's post, or until after election. We can then plan our move forward.

Just reading another thread og people of group 3 and one of them said that "even though i was in cat 4 they told me that they have sent my application for processing and a CO will be allocated soon..." He didn't mentioned which occupation he was referring to!!!

I think 2231-79 is bit confusing ...

We are only holding 1 side of coin..that new graduates are on SOL..

Have any new graduate got assesment under SOL 3 Occupation?

Nobody told that new graduates are on SOL 3?

I think we have to wait till 21 August untill new government comes..

I am absolutely agree on this.

 

First we have to confirm whether new graduates are getting occupation from new SOL.

Well, ACS has confirmed that all the new grads would be classified according to ANZSCO codes and that '65% major' in the degree would be the assessing criteria for a category of IT skilled occupations. Now if a new grad has 65% major in IT Business related subjects, he would be classified as IT Business Analyst, which is on new SOL (Priority 3).

I have suggested few policy options to rectify the situation

Thanks. Your generous help on this issue is much appreciated.

Based on what I have been hearing from online community, might I suggest a few policy options?

 

Option #1 (minimal change)

Allow pre-July 1 applicants with ASCO code 2231-79 to be mapped into a different ANZSCO code than 261399, upon the applicants receiving new skill assessments with ANZSCO code from ACS (Australia Computing Society - Skill assessment body for computing professionals). Also allow old fresh grads applicants to be reassessed under Group C (fresh grads: no exp needed, but you can take into account exp) category.

 

Rationale:

Prior to July 1, ACS was categorically issuing 2231-79 to almost all kind of computing professionals. It is evidenced from Is Your Occupation in Demand? - Workers - Visas & Immigration that 2231-79 (with specialities) used to constitute almost all of the computing professionals. (The list of specialities are quite exhaustive, for that matter)

 

Now the change has been made to SOL and obtaining a proper code has become a new 'selection mechanism' (as opposed to gaining 12 months experience -> get speciality -> get MODL/CSL), it is fair for the pre-July applicants to be given the equal opportunity to be selected under such new mechanism.

 

The proposed option won't offend the established principle of 'applicants cannot change the nominated skill code', since technically applicants are not amending their nominated skills but the old code is getting conditionally translated into new code. It could be argued that the same sort of 'circumventing' of the freezing of the nominated skill code is already there, when DIAC/ACS allowed applicants to attach speciality to already-nominated code of 2231-79 via a new post-lodgement skill assessment from ACS.

 

Option #2

Include 261399 (with specialities) to the Schedule 3 SOL.

 

Rationale:

From the MODL page, and the general practice that DIAC/ACS has been engaged since Jan '09, it could be shown that attaching specialities to 2231-79 was the selection mechanism to discern a more favourable. This system will then link the selection mechanism to applicants' employability, which is the sort of end result that Australia wants.

 

Option #3 (major change)

Reconsider the Category 3 of the priority arrangement

 

Rationale:

Under the current priority arrangement, it is practically impossible for the old applicants in category #4 to obtain a PR. Many of them have been in such situation for 2+ years, and they were living in Australia with all the restrictions/legislative holes of Bridging Visa A. What good does it serve to deny them the full Permanent Residency, and keep such administrative overhead indefinitely alive in the system, when they are fully integrated already to the Australian society?

 

Now, these are my humble opinions. I understand that I'm not in position to make such call. However, I believe that this opinion sheds more light into understanding current situation.

Thank you for your email.

Skills Australia is committed to a review of the SOL, to be published around the end of February 2011 and we are about to start this process. It will take some time to re-assess all the occupations on the basis of our criteria for the SOL and new information and data that has become available since it was published earlier this year.

We will take account of your advice in our stakeholder consultations with organisations such as the Australian Computer Society and the Department of Immigration and Citizenship.

So yeah, realistically, we can expect some policy change around Feb 2011? But then there is election coming up soon, and a possible policy change. Too early to call, I would say.

 

But yeah, at least one director from Skills Australia is hearing our voice. I wish she gets a sort of special recognition when this matter is resolved.

I think approaching SkillsAustralia is the best to do. At the very least the issue is now on their table. We have submitted our concerns (via chajath) with valid reasons instead of just crying "i want my PR".

 

We can all relax for a bit now. For those lucky ones who already have a job, don't stress much about it - just work hard enough so you won't get fired :P. For those who are still looking for a job, DON'T GIVE UP. There are still employers looking for you.

 

I too started looking for a job with a Bridging Visa (while waiting for my TR). It was really tough, I had to move inter-state (from QLD to VIC) for a job as a Customer Service (non-IT related). With very minimum pay ($36,000 pa). Lucky enough after 1 year working there they had a vacancy for junior database admin, I applied for it and got accepted. Still same crappy pay though >_< But I was just happy at least it was related to my degree.

 

2 years later, my TR almost expired, I had enough experience to get MODL. Received positive assessment for 2231 79 Oracle Specialist, so I applied for PR confidently. then of course suddenly DIAC abolished MODL.

I quit my oracle job simply because I demanded a payrise but they won't give me. I then searched for jobs for like 3 months WITH bridging visa. And eventually got accepted in one of Big 4 companies. I work in HR now as reporting specialist with a significant payrise. ($65k+ pa) :biggrin:

 

Moral of story: Bridging Visa A is not 'that' hopeless. Don't let it stand in your way of finding a good job.

Well It is not about nominating a new skill ...It is about changing our skills from ASCO to ANZSCO with a new assesment.And that is allowed (Just read FAQ About ASCO to ANZSCO)

They were the people who developed this ANZSCO not us?

And they cannot disadvantage us by giving new graduates PR in 1 Month and leave us who are waiting for 2 years?

I can't thank you enough chajath :) I will encourage my affected friends to approach to Skills Australia too.

 

To be honest, I've been so stressed out these past few weeks. I feel so powerless because of this unfairness. The last time I felt like this was when I was looking for job under Bridging Visa, but like polkadot said it turns out to be ok after all. I think I need a holiday to freshen up my mind, can't do much but wait for now :D

Sorry guys, I called DIAC today again with regards to above claim and found out they given me wrong information yesterday.

 

What a bunch of clown who even don't know what to say to the callers. Stupid support person had told me that I will be able to get the priority without lodging new application if I get the new assessment from ACS.

 

One day they give the hope and next they shatter them all and even don't even apologize for giving a wrong information. Today I am feeling so down and unable to think of any way out of this problem. :(

Pals,

 

Please help me understand the new priority processing.

 

I got 485 in 2007 as a recent ICT graduate.

 

Attained 1 year required experience along with Victoria state sponsorship.My professional experience is going to be almost three years (support Analyst).

 

Applied 886 in April 2009,was assigned case officer in 2 weeks. I had medical test done onshore and my wife offshore.My application looked like being processed at super sonic speed but then July 09 Ministerial changes occurred.

 

Am I on prority 2 since I have a state sponsorship with new prority processing time lines?if so, any thoughts of you guys about time line? given that priority 2 says 6 months from the time application was lodged,my application was lodged over 16 months ago.

 

If I'm on prority 4 then I'm not alone in this pool.Whats coming for us?

 

I really appreciate your thoughts and thank you in advance.

Well, for us 2231-79 applicants, it can't get any worse. So any change would be good for us? Let's just hope the migration department regain sanity and restore integrity of the system. We can only hope. *sigh*

Please take time to see what has been happening so far. I think the general consensus here is that it is just too early to despair, since the end-result of the policy change is just plain absurd. Plus, we have a chance of government change, and the new government will conduct a comprehensive review on the current mayhem if elected to office, I believe.

I think that was aimed at local ICT students .......the ICT international students are and never will be of intrest to them!

Sadly I don't think a change of government would do much good ,the coalition policy on skilled migration is to reintroduce the CSL which could mean yet more confusion and another change in processing priorities for visa applicants.
