don't think that is entirely true @MaggieMay24 one of the conditions is you being with the employer for the next 2 years, Yes, circumstances may change and if you agree amicably you might part ways, but if you just leave the employer and contact Immigration and state that your intention was not genuine and get your visa revoked. Consult with migration agent to be certain.

No, perhaps you are confusing the 186 with the 187.  The 187 visa comes with greater powers for Immigration to cancel the visa if the visa holder doesn't make a genuine effort to remain with their employer for 2 years after the visa is granted.  The same is not true for the 186 visa.

Hi Guys,

Happy to share that I had the best start to the weekend with the grant email coming through on Saturday morning.

Application status went straight from received to finalized. No further information was requested. It took almost 7 months with Nomination being approved in April.

Please update the same on the spread sheet. My data is in December with username RjayD.

Wishing you all Good Luck with your grants.

Cheers!

Your 186 visa does not have any condition that states you must remain working with your employer.  It needed to be your intention when you applied and when the visa was processing, but after the visa is granted you can leave your employer.

Dear MaggieMay24,

Are you a migrant agent or lawyer in Australia?

I have been reading about ENS 186 cancellation everywhere. But I am still very confused.

Please, I need true advice.

I was on old 457, and I have my ENS 186 (TRT) granted three months ago. I have been working for Queensland Health as a registered nurse for almost 4 years. Now I’m thinking of leaving Queensland Health and relocate to NSW Health or agency nurse. Should I be worried about the visa cancellation?? If I leave Queensland Health soon, will I lose ENS 186 permanent residence??

If it shouldn't be a problem, do I have to tell the department that I have left??

Thank you.
Kind regards,

Don't be nervous, nomination and visa will be approved at the same time.

Sorry @jackgu310 this is not always the case. There are many cases when the 2 applications are approved months apart, in fact - there are many cases where the nomination is approved and then additional documents are requested for the visa.
- They are 2 completely separate applications.

Hi Hex. I am looking for information regarding 186 TRT. I applied 186 TRT as retail buyer and my nomination has been approved. My two year payslips shows weekly wages $1050 before tax but doesn’t show weekly hours. I am working 38 hours per week. Do you think guys CO can ask for weekly hours? The company I work for they already mentioned in the reference letter that I am working 38 hours per week. Please advise me what should I do as my Mara agent says CO will not ask for hours on payslips. Thanks

@Ajay88 In my opinion - if you think it's important to your case, upload a letter stating the same (under additional information).

- I have never heard of a case that had provided TOO much information.
Besides, it could help avoid an extended wait (by if the CO does ask for evidence).

Hi Guys

Hello everyone 🙂

Just joined this forum as my ENS 186 visa (TRT) application has been lodged on 4th June 2019 and I wanted to know what would be possible timeframe that I can expect for final decision. I had a look at the tracker in the spreadsheet whose link comes in with the welcome message but found that it has very few entries. I was just wondering if I am looking at the right tracker - can the forum members help me with the link to the visa tracker spreadsheet please?

Also, from the posts in this forum I am getting a feeling that timeframe for final decision is extremely random and there is absolutely no way to tell if the decision is gonna take 2 months or 2 years! Bt still, I wanted to ask if someone has identified any pattern at all here - like if some occupations or nationalities or company sectors experience swift decision making and others do not? Being a newbie I'd love to hear thoughts of people around this one.

Thanks everyone and good luck to all those waiting for the decision.

Cheers!

@Tapas Welcome!

You hit the nail on the head with this one: "Also, from the posts in this forum I am getting a feeling that timeframe for final decision is extremely random and there is absolutely no way to tell if the decision is gonna take 2 months or 2 years"

- No one can tell you for sure, you simply need to hold, hope for the best and and enjoy the ride...

Hey guys. Is it normal to be waiting nearly 2 months for a decision after the status was changed to further assessment?

@Tweedathart Unfortunately, i'd say no - it's typically longer! 😮

- There are the exceptions to the case (as there always are), however, in my experience - I've seen more "Further Assessment" cases take longer than 2 month + (easily) than others that are quicker.

I'm sure it wasn't the news you wanted to hear but none the less, it's my experience. Holding thumbs and hoping for the best for you.

@KLE It is very unlikely that you will loose your PR if you leave your company.

How it works is basically like this:
- When you apply for sponsorship, you and your sponsor are basically agreeing that you will each stay with the other for a minimum of 2 years - after the PR is granted.
--> This, however, is not law (they cannot make it law - for obvious reasons).
--> If you leave your sponsor within 2 years after receiving PR, you need to make sure you do it the right way and on amicable terms.
--> The only way things could get messy, whereby immigration would look into your case for leaving early, is if your sponsor (or someone on their behalf),  lodge a complaint, indicating that you left the company and you had no intentions on ever staying the complete 2 years.
--> If this is investigated and proven, then yes - you would loose your PR, however, I've never heard of a successful case.

My opinion is this:
Your sponsor put themselves on the line to sponsor you, the least you can do is to sit down with them, explain your situation and that you'd  like to leave.
- Then leave on good terms. If not - and the sponsor holds a grudge, things could get ugly.

Thanks for the suggestion @davey5593

I think my application is as complete as it can be in current situation. My company has filed my application through PwC's Immigration consulting arm and I have also submitted all documents - police checks, IELTS scores as well as other supporting documents in first shot itself. The medical tests were done last week as well. From the looks of it, now all I can hope is to be on the 'early' pile. Fingers crossed!

Cheers

Hi Tapas, I'm not sure why I can't send you a message. I want to send you a pm.

So @Hex do you see this often then? Similar cases to mine where the persons nomination and visa are being looked at at the same time? Further information was requested for both.

I was hoping because of this, they may approve both at the same time as all further information has been submitted. Then again im aware there are no set rules. As i previously stated i was  just seeing if anyone else in a similar position as myself as its seems to be rare.

Cheers

@Charlie6002 It's more common than you'd think - same thing happened with my case as well.
You'd hope they'd get approved at the same time, however, I found that once things go into "Further Assessment" and a month or 2 pass, you MIGHT be in for a wait.
- Only my opinion though (based off experience), lets hope i'm wrong.

Hi Hex,

Thank you for your reply.
What do you think about Immi web site under your obligation (TRT), when you have this visa > What you must do on this visa (your obligations)? It says "We expect that you will work for your nominating employer for at least 2 years. If you don't, we might cancel your visa"

Cheers

@KLE Sorry, I don't understand your question.

Also, I think I had (likely) already answered that in my previous post.

Hi Hex,

Thank you very much for your previous answering.
I mean I checked the Immigration web site (ENS 186 TR stream), which says that "We expect that you will work for your nominating employer for at least 2 years. If you don't, we might cancel your visa"

Should I worry about this sentence?

Cheers
