Hi guys,

I've been a silent reader for a while.
Here's my situation:
Restaurant manager
186 DE
State VIC
Nomination and visa application submitted September 2017
LR Country
IMMI Status: Received

I have been waiting for 15 months and I guess you can understand how confuse I am when I see so many granted visas from January, February or even March 2018.
It looks like Restaurant managers applications are indeed left aside.

Anyway, since the last update, I am now out of the time frame. I have called the immigration but got given a very generic answer: "10% of the applications are actually processed outside of the time frame. We cannot track the application status for you, so all you can do is wait".
I have read in previous posts that other applicants have been luckier than me when reaching out to Immi (nomination has been granted shortly after they called). So what kind of information can you ask for or give in order to get the process sped up when you are outside of the time frame?

Welcome to the forum.

Unfortunately the occupation "Restaurant Manager" is seen as high risk. Due to this it seems to have a higher processing time than other occupations. This is manly due to this occupation being taken advantage of with many fraudulent nominations. You only have to look a few pages back to see what I'm talking about. I wouldn't worry to much about that as its out of your control.

Calling IMMI will not help I'm afraid. You will just get generic response - please wait.

In terms of previous posters having more luck contacting IMMI - i believe that is just coincidence. I don't believe them calling actually had any effect in their application being processed quicker - its just luck that their application was allocated after they called. Those that answer the calls are not case officers, just customer service advisers.

Unfortunately there is not much you can do but sit tight and wait - many of this forum will be in your situation so we are all in it together.

I still have a 1.5 hour window left for the QLD processing office... either way i'm cracking open a beer in 1.5 hours... i'm still hoping for champagne... we will see!

Immigration asked my agent on 10th Dec for extra police clearance, my agent asked these documents to me yesterday (20th Dec).

Considering that immigration give 28 days as deadline to send the documents, considering the scenario that I can't give these documents in time for the 28 days, what can happen?

They don't accept any documents after the deadline? There are any possibility/reason to make them accept it?

My agent stop to work today and will return only 7th Jan.

Any help/idea?

Wtf you MA work like this? If I were you, I would submit it directly to my immi. Not reliable MA

As far as I know, they give the 28 days to you to provide the documents, so after the 28days they might open your file again and take decisions based on what is there (you uploading or not).

But even after the 28days period you're still able to upload any documents.

 

They also understand that, in some circumstances, if you're not able to arrange the documents in the 28days time frame, they might extend the deadline. You need to send them an letter/email explaining the situation and ask for more time.

I haven't seen any other pharmacy technicians in the forum either, and I like to think I'll be alright

Apply now online on the afp website. I applied two days ago, and they sent the certificate already via post (it will arrive 3-7 business days). What a bummer that your agent didnt advice you on time. Is there a way you can contact him/her to just submit that directly? I believe we can't submit any docs on our immi account if we import the application,or can we?? Good luck!!!!

Yes, he requested to immigration to extend the deadline due to Christmas and New Eve period. Hopefully they will understand and accept it.

So I think you're good.

But apply for afp now, first week of the year it'll be delivered to you, and will be in between the 28days.

I spoke with my MA yesterday, he tild he hsad  a lots of Restaurant Mangers grants recently.

He said TRT applications won't effect however DE Restuarant Mangers are on high risk unfortunately.

I truly do feel for Cooks who are doing everything legit and you have people like the above playing the system.

@Austin It is illegal - no question about luck. What 'you' or 'your friends' are doing is wrong and has an impact on others.

Thought I'll quickly let you guys know..  Received an email Friday night around 6pm (QLD time).. Looks like our application is with PESE WA. 

 

They've requested a letter from the company just saying that our little girl (born after nomination was lodged) is included in the Company Nomination. We're not using a MA, so didn't event think to update the Nomination. She's included in VISA application.  

 

Company is closed now for the holiday's so we'll only be able to get the letter from them early January, upload and wait! 😁

After having consultations from 2 migration agents and 2 migration lawyers,then I decided to reapply as those migration specialists said there is the best option for me so far. The positive point for reapply option is that  the laws have chance. So.if you lodge a nomination application after 12 August 2018 the case officer are now not required to assess the training benchmark requirements as all businesses that nominate permanent or temporary staff must simply pay the training contribution charge( $3,000 for business with a turnover  less than 10 million.

Anyway my case still has risks as the refusal decision of the previous nomination is on record and it could be adverse information and this can affect to the new nomination so the best way to do is providing  a strong submission about the previous training issue. Or if I'm lucky , the case officer might not give  weight to the training benchmark issue on the record as it has been discarded by the new laws. Finger cross and always have a good hope! 

What I want to tell you is that don't just stick on one migration agent but seek a lot of second opinions from several agents or even lawyers to ensure you get the best solution. Good luck!

Thanks for sharing your story! It's just ridiculous how they refuse our nominations for such reasons, but it had already happened. For exactly same reasons as you, I'm reapplying the visa too, and my MA also said training benchmark is gone, but as we have a record, we gotta prepare documents for the reasons for refusal as well as new SAF rules ($3000 donation).

Irregardless of TRT / DE, sadly, Restaurant Managers will be looked at with the same level of scrutiny.
