What a bloody joke..... did Evans really know what he was talking when he made the following...

 

"If people want to come to this country to study, they're more than welcome. We encourage that industry. If they want to come for a permanent residency outcome, they've got to meet the migration rules and the priorities of the Australian Government that are in the Australian national interest. "

 

So where do we stand in this.......have we not met the migration rules that he's banging about????

Apparently all accounting students are an exception. It's only us former IT students who are not welcome at all.

same here....went through a solicitor so I can't inquire.... I will call him up to see if he knows anything!

My agent just got back to me. She said I should apply for new assessment with ACS to get the ANZSCO code.

 

However, what I get from her email is that the plant to change occupation using 1023 have not been approved by Canberra. But they are fully aware that there is unfairness for pre July 2010 IT Graduates -- I wonder after how many phone calls + emails that is. DIAC said after they received the 1023 forms, the applications then put into "batch" until further instruction.

 

I feel like they are being overly cautious giving us this information :/ For now I remain positive that changing occupation using 1023 will happen, after all they admit that they're being unfair to us is a huge different from telling us we don't have "skills Australia need" lols. Let's see what happen in the coming weeks. DIAC, please don't betray my trust... AGAIN :(

 

Let's see what sort of reply the others gets.

I just called DIAC. They now acknowledge that Computing prof.s nec have been unfairly treated. They have advised that we need to get a new assessment from ACS and let them know.

 

They also told me that they are waiting to see how many applications they get . So, if we all get new assessments from ACS and let DIAC know, they would be willing to do something for us.

 

I think if they don't receive that many applications for review, they may not go through with it. So, let's all get new assessments from ACS.

 

I think this is still a step forward.

Hopefully they won't only based it on the number of applications tho. How to get many applicants if they don't make any announcement? Not all applicants are proactive in following up their application. Hopefully they are being sensible about this.

 

Edit: but it's good that inquiries are answered with pretty much the same information :)

I emailed them to get the advice in writing.

 

Here is what i got.

 

Dear *******,

 

Thank you for your email in relation to your visa application under Australia's General Skilled Migration program.

 

The advice is not to get a skills assessmnet in a SOL - Schedule 3. The advice is - Applicants with specialisations should contact ACS regarding their circumstances.

 

The Department of Immigration and Citizenship acknowledges that some pre-1 July 2010 ?nec? Skills Assessments with specialisations assessed under ASCO Code 2231-79 do not map directly to ANZSCO coded occupations. Applicants with specialisations should contact ACS regarding their circumstances. If provided with an ANZSCO Skills Assessment from ACS, please send it to the department with a completed Form 1023 Notification of Incorrect Answer(s) requesting your occupation code be changed to ANZSCO. The department will then determine which priority group your occupation is included in and process accordingly.

 

Please send these documents by email to: adelaide.gsm.documents@immi.gov.au

It is a scam. Golden rule of dealing with DIAC is never ever take their phone operator's word for it. I learnt it the hard way and almost got refused flight to Sydney many years back.

 

Until they have it in writing in their website, I woudn't even consider it.

 

There are three things that can happen.

 

1) Bump all ASCO to ANZSCO

2) Get reassessed to ANZSCO and ask DIAC to change it

3) Keep things the way they are now - pre-July in cat4 and post-July in cat3.

 

If they implement (1) then you are wasting money on reassessment. It's better to wait and see. I am hoping they will announce something whether good or bad in next few months. Nothing can get worse than this really.

It happened to me too. They told me i needed a visa to return in OZ with NZ passport :eek:. They know nothing !!!!!!!

I'll take my chance :( hopefully when I got my assessment they've figured out what to do. Just because if they do go ahead with this I got an early start, if they cancel it well.. wasted another money for skill assessment. I won't update any other documents tho until they have the announcement (medical and police clearance), to minimize my loss of money if they once again give us unfavorable decision.

I have just been doing that. If you look at their website now under contact us; they have cleverly removed the whole lots of contact persons for the skills assessment and placed a online enquiry form, which I am pretty sure ACS being ACS will reply 'very promptly'.

What's the point in contacting ACS? They just say to get a new skills assessment and pay another $375! These guys are playing handball with our lives and taking us for a longgg ride. If I wanted a rooler coaster ride, I would have gone to an amusement park, not apply for a PR..

Is it worth to get another skills assessment and fill that form 1023 or whatever to let diac decide your priority . My course is Bachelors in Information Technology(System admin ) and was given 2231-79 so will that occupation come under specialization ? or they require something else?

You can email DIAC to get clarification. Although, I suspect you will also receive the same email.

Just call their phone numbers listed on your assessment letter. Every now and then, make them busy. ACS is the biggest liar, ever. All they want is money. In fact in the IT industry of Australia, ACS is nothing. Their reputation in local community is bad too.

Seriously, I wouldn't hesitate if we all go to ACS office in person and start a petition. They have to be responsible for what they do, not just undermining the image of Australia. They should be ashame of what they have done to us.

I called my lawyer today and informed him about this reply DIAC has been giving us - I think he will contact the department as well.

 

Let's see what DIAC tells the lawyers/solicitors !!!

Contacted ACS and the advice I obtained is to apply for a new assessment in SOL 3 with all supporting documents. They were not interested in the fact that I had been assessed as having a specialisation in the old MODL/CSL.

 

What I infer from my communication with ACS is that all ICT (nec) can apply to ACS for reassessment and benefit from the new provision by DIAC.

Well that's some good news. The only thing is what about those who have assessed their documents months ago (not within the last 6 months)? I'm also concerned about the way they want to assess university degrees and determine whether +65% of units are related to either one of the new ASNZCO codes. But we have to see how it goes ;)

It's not the reassessment that worries me but whether DIAC is willing to accept them for a cat3 bump up.

 

So far there is no official wordings only "the may consider".

 

Either way it's stupid because I don't recall accountants doing reassessments and we have to because the couldn't be bothered to map us in schedule 3.
