Really don't know what to do!!!

We have finally rec'd an email back from TRA and I feel sick and think we should just knock it on the head now - perhaps we are just not meant to go!

 

"The requirement for an applicant to demonstrate five years under supervision applies to applicants whose first comparable qualification is the AQF qualification, and serves as an informal training period for many applicants who may not have undertaken any formal training in their trade.

 

When a person undertakes a formal apprenticeship there is a combination of on and off-the-job training undertaken, and whilst the formal training component may be completed within a shorter period, apprenticeship are often of 3-4 years in duration. When an applicant provides evidence of completing an apprenticeship there is a recognition that the participant has undertaken ‘formal training’ to develop and achieve the competencies required for the qualification, combined with application of those skills and knowledge in the workplace. Without formal recognition of skills via a qualification/apprenticeship, TRA requires applicants to demonstrate that they have undertaken the required training on the job to meet the same standards. Currently this requirement is to demonstrate five years under supervision as a proxy for a formal training period."

 

 

As my husband did his training course in the UK and then set up his business straightaway he has never had a 5 year supervision period, he has always been self employed.

 

If we were to get a 457 sponsor and then apply for PR, would we still hit the same brick wall as and when we came to be assessed for PR? Has anyone had this problem with TRA, gone out on a 457 and then gone on to gain PR?

 

 

When I speak to DIAC they say you have everything that we are looking for but say we need a positive assessment from TRA and we have spoken to two agents who are not willing to take us on as they say it will be a waste of time and money as they could not get through us TRA either.

Sorry to hear this news,hopefully this may be of some help.Our Friend a baker had worked for the same guy for 10 years some of those years were cash in hand and he did not serve a formal apprenticship.They could not get his skills assessed ,however his Wife emailed every bakery in Perth for two years until they got a reply! he flew over at his own expense and worked for free for a week to show them his skills,they offered him sponsorship and after 3 months they were on their way.This same friend had got in with the wrong crowd when he was a teenager and after the death of his father went off the rails a bit and served some time in prison abiet 20 years ago,Moral of the story dont give up! they are in Perth 18 months and love it, sponsorship seems your best option at present it has always been our plan c really hope things work out for you.They tell us he will not need to do the dreaded ielts or a skill assesment that after four years he will have enough points for PR!

Hi Candygirl.

Sorry to hear that news. You must feel gutted but don't give up, where theres a will theres a way.

If DIAC say you have everything they need apart from the positive assessment from TRA then you will find a way around this, its not the end of the road.

I can't comment on the PR situation but surely if you get a sponsor and work for a number of years then you will eventually get PR?

This is the route I'd be taking I think.

Bombard your OH's CV to every company possible. All you need is for 1 of them to be interested.

I have just spoken to my Wrinklies who are brilliant. My Mum has said in her usual way - "Pick yourself up - we will gladly look after the hooligans, don't sell the house for peanuts, shut it up, get a 3 month visa and get out there, get jobs and don't look back - you've gotta love em!!! Anyone would think they cannot wait to see the back of us.

 

WRussell - thanks for your advice, we have spoken to 3 agents who have said they would be happy to take our case on once we have a positive assessment from TRA. TBH, this is the biggest problem we have and need an agent who knows their "Onions". I honestly don't know now whether an agent could help as TRA are insisting on the 5 year supervised employment and my husband does not and will not have that ever as he he always been self employed. He has continued his training on new products/services over the years, but this does not amount to 5 years.

 

Thanks for your kind words everyone. They have made me cry all over again. I know that I am stronger than this I won't let the Bar Stewards get me down, I prob just need today to feel sorry for myself and then pull my socks up tomorrow.

 

Looks like my KitchenAid Foodmixer is gonna have to stay in the shop a lot longer:biggrin:

Hi Hon, looks like I will need to use your info after all?

 

I think this is the only way now, but I am worrying about having an assessment once we apply for PR. I would hate to think that we found a sponsor for OH and then applied for PR and still hit the same brick wall.

Is your hubby in quite specialised work Candy? Or is it just the TRA requirements that are holding you back? If you could cope with the slight uncertaincy on a 457 I would start to send out to every job advert in his field, on sites such as seek.com.au and hopefully you may get a response. Or the trip over may be a good idea, at least to make some contacts.

He is a Residential, Commercial & Automotive Locksmith, specialised in that you need to know what you are doing and you have to work by a certain code for obvious reasons. I think it is just TRA. He does not meet the 5 year supervised rule and that's that.

 

I have a list of available jobs and he is going to stay up tonight and call them all and gauge what they have to say.

 

He was the first Locksmith to get an AQF III by RPL with the TAFE - not really sure what this is good for now though:biggrin:

yep thats what I was getting at.... :) dont give up too soon...

I have approached this move from all angles !!! everytime I thought there was a brick wall , I carried on researching and found a way through.... it pays off !!! I know thats what you have been doing for months now ! I should have phoned an agent long ago, but even then, its good to know the bloody immigration system backwards !!! :D Good luck !!

I was going to say, you could get 457 and keep rolling it over until OH has the 5yrs he needs, but i didnt cos i knew LV would come up with something better :laugh:

Thanks. The problem is that OH has 7 years experience as a Locksmith, but none of it has been supervised. He completed his training in the UK and then set up his own business and has been working on his own ever since. He has kept up-to-date and had further training over the years to keep abreast of new products and methods, but has always been self employed, employing and sub-contracting other locksmiths as and when his workload has demanded it.

 

TRA are saying that they require a minimum of 8 years experience now, 5 of which have to be supervised.

So sorry to read this news. I know you were so anxiously waiting for them to give you a positive answer. :hug::hug::hug:

 

I can't add to the great advice already given but wanted to say please don't lose heart and give up your dream. The wrinklies are old and wise. Much as they will miss you they want your dreams to come true. Take the leap. I know you have the skills to get what you need to live in Oz.:yes::hug:

Seems like the general, and informed, advice is for your OH to get himself an employer and get yourselves over to Oz on a 457 and convert to PR later.

 

Hope to see some positive postings on this Candygirl - go for it, follow your dream and don't let the barstewards grind you down :yes:
