A quick note to say that we are seeing requests for meds and police clearance certificates for State Sponsored 176 applications lodged in 10/2008, so the escalation of processing priorities is clearly starting to manifest itself ...

I must apologise if I came to wrong thread. As I discussed with you some days ago, I am end of Aug 07 HR STNI applicant. I have sent all outstanding documents IELTS, medicals, PCC and informed DIAC that I would pay 2nd VAC instead of spouse IELTS. Still, I have not received any info regarding CO. Last time in 01 Jan, they replied that I had not allocated CO yet. How do you think about it in case of HR applicants? Havn't they started to sort out STNI of HR applications yet? I am really stressed out. Would highly appreciate your input based on your keen observation on latest CO and visa trends.

 

 

I am sure Gill is old enough to look after herself, but I am disturbed by the apparent expectation that Gill has the time to deal with the many - and increasing - specific demands.

 

For one, there are many postings on this and other forums on issues which are raised time after time. I sense some take the easy way out, and simply adopt the "ask Gill" approach.

Hi, I applied for a 175 visa late August. I am unsure weather to go for a 176 instead.

There are no obligations placed on 175. If ASPC will start processing us on the CSL after the 13th of Feb, then it should be quicker just to stick with the 175 application? Or do you think there will only be time to process applications with State and Territory nomination? Thanks! Elli

Trying to follow this, not easy as it is all confusing!

 

We have applied for a 175 visa online on 4th Jan 09. My OH is on the CSL and the MODL. He has started to look for jobs now, and I wondered how our application would be affected if he gets an offer.

 

 

  1. Would it speed up processing?
  2. Would we still get a 175 visa (and not be tied to the employer)?

 

Sorry if this has been answered elsewhere but I couldn't find it.

 

Also interested in the theory about the department checking that the Minister's ideas would be workable before the announcement - having worked in Local Government I know that 'announce now, work out details later' is not unusual...

One more question, if I may? I thought I read somewhere that State Govts could sponsor up to 500 extra people who may not be on the required skills list for that State. If this is so, have you any idea how one would go about this?

 

The 500 special places are earmarked for applicants for the immediately-permanent 176 visa. That would involve a whole new visa application and a new DIAC fee. Also I understand that your step daughter has a skills assessment as a Marketing Specialist?

 

Each State is free to set its own criteria about how to allocate the extra 500 places for occupations that are not on the State's 176 List. The 176 List for SA is here:

Please click on the link because when the .pdf file opens it does so in a strange way - it does not give you a link that will open the document automatically as far as I can work out.

 

You would have to ring the SA State Migration office and ask them whether your step-daughter would be wasting her time and theirs if she were to try to apply for one of the special 500 places.

 

If Marketing Specialist is on the 475 List for any other State, and your step-daughter is willing to move to a Regional part of another State for 2-3 years, there would be no reason why she could not apply to some other State for 475 Sponsorship? The link to all the State Websites is here:

Tasmania, Victoria, the NT and WA will all consider an application for State Sponsorship if the applicant's occupation is on the SOL and s/he has a job offer from a regional employer based in the State concerned.

 

However the Minister has made it clear that at the moment he is not prepared to use the Skilled Migration program as a means of re-uniting families. He is concerned with what Australian employers need, what the various States need and with supplying the skills which are required throughout Australia only for the time being. He is determined to insist that new, skilled migrants go to the places where they are actually needed. If they are not prepared to do that then they can wait indefinitely for their visas as far as the Minister is concerned.

 

Your Federal MP would have the right and the ability to bend the Ministerial Ear about this on your behalf if you are not happy about the Minister's stance.

 

LOADS of people are caught in the same conundrum as your step-daughter, I can assure you. The Minister specifically intends that in the short term it will not be possible to solve the problem for everyone. He will undoubtedly get his own way about this. I think that if your step-daughter can find employer sponsorship locally that will be the solution to grab. She is luckier than many. She is in Oz and so can attend face to face interviews etc. It is a LOT worse for a lot of others.

The ASPC e-mail states that "all" State Sponsored applications will be allocated to COs by 13th Feb.

 

In the meantime your application is not "decision ready" because you have not yet obtained and submitted your police checks. You can bet your bottom dollar that the ASPC have junior staff assisting the COs. In order to manage the workload efficiently, I would tell the junior staff, "Check all the documents on the files. If we are still awaiting anything from the applicant, put the file to one side. Give the complete, decision-ready applications to the COs so that we can get those out of the way quickly. I don't want the COs getting bogged down in making requests for further documents etc at this stage. Let us deal with the decision-ready applications first."

 

If they get rid of the files where nothing more needs to be done except to grant the visa, they can reduce the size of the "pending" pile quite quickly.

 

Now is not the time to pester the ASPC when all that they would be able to say to you is, "Krisha, where are your police checks? The system has been asking you to produce them for the last several months so where are they?"

This is what Alan Collett of Go Matilda told us all at post # 34 on Page 4 of this thread:

 

My hunch is that the ASPC will spend the next couple of months allocating and processing the State and Territory Sponsored 176 and 475 applications.

 

They will then move onto the applications with CSL applications - my expectation is that these will also be processed with a view to grant in this program year - subject to numbers.

 

In addition, I would expect the Department to be looking at statistics (number of visas granted to date versus the program total for the year to determine the number of remaining available grants, number of State Sponsored applications, number of CSL occupation applications, etc) and will be managing the skilled program so that it achieves the Minister's stated intentions, so he can announce the achieving of previously announced objectives after the end of the 2008/09 program year.

 

It is a somewhat thankless logistical problem for those managing the skilled program - I dare say that DIAC employees at the ASPC had the processes ticking along fairly comfortably before the Minister decided to get involved ... :wink:

Having followed many of the threads on this forum (and others) with interest, I can still not decide whether your application will be decided on the criteria that was in place when you lodged the application or when the decision/CO is allocated. Any ideas? My occupation is on the MODL and CSL so at least that is good news..!!

One of our other members is a 175 applicant with a job offer which they have had for some months. Their Agent rang the ASPC last week to find out whether having the job offer would hurry things up? This lady agent's clients have only just had their meds done. The Agent was told to wait until the meds and police checks have been finalised and then phone the ASPC again.

 

The clear "message" from the ASPC seems to be, "Get the application 100% decision-ready and make sure that it is decision-ready. If it is, so that we can grant the visa on the spot, give us a ring at that stage and we will try to help both employer and visa applicant."

 

Is there anything that you still need to do in order to get your application decision-ready, please?

 

Now is the time to work with the ASPC and we can help them by ensuring that applications are absolutely complete and ready to go in every respect. In that situation it takes a CO no time to check the file and then to hit the "Grant the visa" command to the computer.

 

What holds everything up is a situation where the CO checks the file, the wretched thing is not complete and so the CO has to get bogged down with requesting more information/documents, waiting for them to arrive and so on.

 

Without State or family sponsorship the only visa that a CO would be able to give you would be a 175.

Your occupation (Painter & Decorator) is not on the new Critical Skills List.

It is on the current MODL but DIAC are promising/threatening a new MODL "early in 2009." They have not been specific about when and nobody knows which occupations will stay on or be added to the new MODL.

 

My guess is that the ASPC will do nothing about MODL-only occupations until the new MODL has been published and that they may well relegate applications which have become non-MODL at that stage.

 

If you want to be sure of a visa any time soon, I would suggest as follows:

 

1. Study the List for the 176 visa - NOT the one for the 475 visa - for every State & Territory:

 

State & Territory Migration Sites - australia.gov.au

 

2. Work out which States are willing to sponsor Painters & Decorators for immediate Permanent Residency under the subclass 176 State Sponsored visa:

 

Skilled – Sponsored (Migrant) visa (subclass 176)

 

(NB: Do not bother with the NSW website - they do not sponsor Trade Skills applicants for the 176 visa. Do not bother with the ACT website either because apart from not your having a burning wish to live in Canberra, they want $275 to consider an application which they might refuse. Choose one of the other States instead, I suggest.)

 

3. Out of the States which would consider sponsoring you for a 176 visa, choose the State which you like the look of the most. Decide that you are willing to live there for your first two years in Oz.

 

4. Get cracking on researching the target State so thoroughly that they will be delighted to sponsor you for a 176 visa. Then apply for State Sponsorship, which is free for every State except the ACT.

My Wife's occupation is on the Modl & critical skills list also, however we're on the 175, not so great then as they are not as I understand allocating any Co's for the 175 stream !! Or did I miss something ???

Hi Gill,

 

Our emigration guy has told us that my husbands job is on the critical list so our visa app will now be dealt with priority, but we will wait to see ill keep all posted as we have only just finished our skilled assesment and now are on the goverment sponsor section, we where told our visa would be now June/July 09 as before it was January 10.

I was recently given some very good advice about the new CSL... No one has the answers as to "Who is next" "Will we get priority" etc etc

 

That advice was to sit tight, WAIT til Feb and "see what happens "and to reflect on "what has happened"! Then we may have a better picture and know which way to go!

I am referring to the points more than anything. Reading Allan comments it seems that even he is not 100%sure that the points are awarded based on the criteria at the time the application was lodged, or when the decision is made. Hopefully the fact that my occupation is currently on the MODL and CSL list, will put me in good stead if the MODLlist is changed. As one would hope that if it has appeared on the CSL list it will stay on the MODL (but you never know !) As to the priority of processing due to the new guidelines, it seems to me from the information coming through, that as I am not state sponsored in any way that not much is going to happen till the state sponsored are all allocated a CO. How quick this happens will I guess depend on how many more state sponsored applications get recieved...will be interesting to see. Personally we are not in any real rush so not too worried about the time scale, but concerned that the longer it takes, the more goal posts they move, then when our apllication actually gets looked at the points/job critiria has changed from when we lodged our application.

Can anyone please offer me some advice please?

 

We submitted our 175 visa in June 2008, and sent our police cerificates and completed meds early December. My Husbands job is on the MODL, and CSL. However after reading som posts it suggests that we mwy now be better (to speed things up) to apply for state sponsorship. Can anyone please advise what we need to do for this??, and how we go about doing it. I have looked on the DIAC website but i need things explaining in simple laymans terms.

 

Any advice greatly appreciated
