I think maybe the 175 on the list is maybe a mistake? I hope it's not, that would be great!

What I don't understand is, are they ever going to have all the sponsored applications done? As there will be people constantly applying surely so they will never all be done? Also with the recent changes the number of sponsor visa's will probably increase. I feel like it's going to take so long for them to get through them all and then eventually start on the 175 visa's. so it'll probably be months before they even start allocating 175's on CSL. This is so frustrating. I guess we should be thankful we're on CSL at least.

Sorry I missed 2 pages of this thread and just realised my questions were answered there! Thanks Gill and everone else supplying the info!

my concern is the 175 cl who have had there meds and pcc. I know we front loaded at are own risk but we didnt know this was gonna happen.

Your always told to go for 175 if you can. All agents will advise you to get 175.

Rachael

Hi Rachel

Up until 17th December when the Minister suddenly skewed the entire skilled migration program towards employer-sponsored and State Sponsored visas, all the Agents recommended the 175.

Since 17th December they have all been advocating the State Sponsored 176 visa wherever possible.

Best wishes

Hi Gill

As always your advice is invaluable ;-)

A question:

Is there not a limit on the number of Regional Sponsored visas for a 'migration year', so when reached they will have to move onto CSL?

Thanks!

Hi

I just thought that this was a good question. Can anyone clarify?

Thanks

Hi Funzkig

The Minister is trying to curb the overall number of skilled migrants for 2008/9 without actually being seen to cut the quota ceiling (currently 133,500 skilled migrants on PR visas in total.) He need not worry about the original subtotals that he might have had in mind because he has bumped employer-sponsored & State Sponsored applicants to the top of the pecking order and has relegated a lot of other applicants to a limbo zone where no further processing of their applications will take place for at least another 6 months.

The total number of skill-based PR visas granted during 2008/9 will come in at under 133,500 for sure. Seemingly this will keep the Minister happy.

Best wishes

A quick note to say that we are seeing requests for meds and police clearance certificates for State Sponsored 176 applications lodged in 10/2008, so the escalation of processing priorities is clearly starting to manifest itself ...

Best regards.

Hi Alan

I've had people asking me all evening:

1. Will they ever find time to start processing visas where the occupation is on the CSL but it is not a State Sponsored application? and

2. If so, when?

I assume that the ASPC must have done some work on the logistics so I assume they do believe that it will be possible for them to bring the CSL people "on stream" fairly soon? If so, do you have any idea when, roughly?

What I am seeing is several people who have applied for 175s and their occupations are on the CSL. The query is whether it is worth their while to join the stampede for State Sponsorship?

I don't have a crystal ball. The only thing I can think is that the ASPC must have run some sort of model to test whether the Minister's wishes can actually be carried out within a finite period before they let him have his head about his Bold New Vision? The Civil Service can generally keep the boss under control so as to ensure he does not drop himself into a political mess by making promises on which he cannot deliver.

There is no point in the CSL unless they can do something about the people affected by it fairly swiftly, surely?

Cheers

Gill

My hunch is that the ASPC will spend the next couple of months allocating and processing the State and Territory Sponsored 176 and 475 applications.

They will then move onto the applications with CSL applications - my expectation is that these will also be processed with a view to grant in this program year - subject to numbers.

In addition, I would expect the Department to be looking at statistics (number of visas granted to date versus the program total for the year to determine the number of remaining available grants, number of State Sponsored applications, number of CSL occupation applications, etc) and will be managing the skilled program so that it achieves the Minister's stated intentions, so he can announce the achieving of previously announced objectives after the end of the 2008/09 program year.

It is a somewhat thankless logistical problem for those managing the skilled program - I dare say that DIAC employees at the ASPC had the processes ticking along fairly comfortably before the Minister decided to get involved ...

:biglaugh: I'll bet you are 10,000% right about this.... Ministers with Ideas Of Their Own are definitely Dangerous Menaces without a shadow of doubt.

It needs something smooth [and Minister-Scaring] from Sir Humphrey Appleby, I feel.....!

Would I be right in assumning that priority processing will also be given to 475 applicants sponsored by relatives to go to a regional state (ie. SA) My step-daughter had 115 points for a pass mark of 100.

Thanks

No, I believe that family sponsored subclass 176 and 475 applications will no longer be processed as a priority.

Consider looking on the SA wanted skills list to see whether a subclass 475 State Sponsorship can be substituted for family sponsorship.

Best regards.

Hi Kazz

Unfortunately not unless her occupation is on the new CSL in the first instance?

http://www.immi.gov.au/skilled/general-skilled-migration/pdf/critical-skills-list.pdf

What is your step-daughter's occupation, please?

The big flurry at the moment is to try to keep applicants out of the Relegation Zone if at all possible. Applications in the Relegation Zone will not be progressed at all for the remainder of this Program Year and so far there is no indication about what might happen in the 2009/10 Program Year.

Hi Alan, Thanks for your very prompt reply.

That's very disappointing to hear. When she was waiting for her skills assessment in Aug / Sept her occupation was on the list for 475 in SA but it took 7 weeks to get the skills assessment back and her occ was taken off when the list changed in Oct. Also, we were advised by DIAC customer service, at the time, that the family sponsorship was more benficial as it carried more points (25 vs 10).

As she is now already here in Adelaide, on a 12 months tourist visa, and unable to work, can you suggest anything she may do to speed up her application. We were banking on 7 months processing time. Her occupation is Marketing Specialist. She is, however, also a fully qualified Remedial Massage Therapist, which is on the list for 475 now, but she didn't have enough relevant work history for this as it was only ever done on a part time / self-employed for lcoal sports clubs.

Many thanks.

....and a lot of the guys coming in are not entitled to state benefits - really hope the UK are looking at this model......!! Have to say, this is pretty smart and totally in keeping with the times, but painful for lots of people.

Giving my employer the good news tomorrow - going to be a sore one after more years that I can care to remember working with them......onwards to Adelaide I hope!!

No, I am afraid I have no "quick fix" as to speeding up her application, beyond suggesting that she considers another State or Territory if her occupation appears on a subclass 475 wanted skills list.

Hi Kazz

Is your step-daughter entitled to a Working Holiday visa?

Visa Options - Working Holiday - Visas & Immigration

If not, a Student Visa would enable her to work part time during the college terms and unlimited hours during college vacations?

Students - Visas & Immigration

The tourist visa does not prevent your step-daughter from applying for jobs. If she can find a willing and eligible employer, a temporary subclass 457 visa would hold the fort? Or even an immediate RSMS visa since she is in SA and already has a positive skills assessment?

Employer Sponsored Workers - Workers - Visas & Immigration

Booklets 11 & 5 are relevant:

Information Booklets - Applications & Forms - Visas & Immigration

The Minister decided to alter the whole way that the skilled migration program works. He announced the changes on 17th December and they became Law on 1st January 2009. The advice DIAC gave you was good advice at the time but everyone has been caught on the back foot by the sudden and direct intervention on the part of the Minister.

The focus now is to find pragmatic ways around the spanner which the Minister has seen fit to chuck into the works.

Best wishes

Gill

Hi Gill,

Greetings. I have lodged state sponsored visa in october 2008.Due to the changes in time processing by ASPC i am slightly under pressure to speed up the things from myside.

Please anawer my following queries which will clear my doubts .

1. Do i need to fill up the form 80 which was not asked when i filed application online. if you say yes then can i fill it up and upload scanned copy through on line.

2. What about Australian value statement. I saw in some cases it was requested by case officer. Shall i proceed to fill it up and upload the same?

3. I have received police clearance certificates from 3 countries for the last 10 years i have lived. Do i need to semd them original by post or can i upload the certified copies without a request from case officer.

4. Medicals: Can i go ahead and book it or i should wait for a case officer . Once case officer is allocated then will i get atleast one month time to do the medicals.

Please clarify my doubts. I know that you never let any one down in this forum. My thanks and Regards.janak

Hi Janak

1. Do i need to fill up the form 80 which was not asked when i filed application online. if you say yes then can i fill it up and upload scanned copy through on line.

Yep. If you are married then one each for yourself and your wife. If they don't need it they can throw it away but the idea is to save time for your CO. If you have children, do a Form 80 for any child who is 16 (or will soon turn 16) or above.

2. What about Australian value statement. I saw in some cases it was requested by case officer. Shall i proceed to fill it up and upload the same?

Exactly as above. If they don't need it, they know what a waste paper bin looks like and where to find one.

3. I have received police clearance certificates from 3 countries for the last 10 years i have lived. Do i need to semd them original by post or can i upload the certified copies without a request from case officer.

Yes. Please do so. The idea is to get your application "decision-ready" by the time a CO examines it.

4. Medicals: Can i go ahead and book it or i should wait for a case officer . Once case officer is allocated then will i get atleast one month time to do the medicals.

They are beginning to ask Alan Collett of Go Matilda to organise meds & pccs for clients of his whose applications were submitted in Oct 2008. It is a fairly safe bet that Alan's clients are mainly from the "low risk" UK, though, I would guess. As against that, the 13th Jan e-mail from DIAC says:

State & Territory Nominated Applications:

Subclass 134, 136, 137, 175, 176, 475, 487, 495, 885 and 886 applications

(processed by the ASPC and where a successful State or Territory Nomination

is held) will all be allocated to case officers for assessment by 13

February 2009.

God knows how they plan to work it but it is reasonable to assume that they mean what they say. "All" is not capable of too many different interpretations, surely?

In your shoes I would phone the ASPC about this and ask them outright whether they want you to frontload your meds.

Best wishes

Hi Gill,

Thanks very much for responding - the help and advice you give people is amazing, second to none.

Unfortunately, she is just too old (!) for a WHV and also not keen on the student option, at this stage.

She had thought of looking for work with sponsorship at some stage, but didn't want to do anything too soon in case it affected the 12 month visitor visa she was already on. She's very conscious of the fact she had to convince them she could support herself for up to 12 months and wasn't coming here with the intention of working. However, she can't really wait until the next processing year as she was made redundant in UK last August and was hoping to be working again here sooner, rather than later. So ........job hunting it is.

One more question, if I may? I thought I read somewhere that State Govts could sponsor up to 500 extra people who may not be on the required skills list for that State. If this is so, have you any idea how one would go about this?

Krisha,

You are at liberty to follow up your application at any time. However, given that State Sponsored 176 applications are only now being allocated I would not be chasing your application yet.

You may want to progress your police clearance certificates in anticipation of them being requested.

Best regards.
