cfernandes
@Alan Collettย For offshore 143 visa applicant's I understand that they have to be offshore at the time of visa application. Have you in th recent past come across any cases where the parents were onshore and may be stuck onshore due to the covid-19 situation and can't go back or leave AUS. However, the department has still considered this and granted the 143 visa to allow them to continue their stay?

Parento
Hi everybodyย We have been following this forum for quite sometime. I enjoy reading to update myself in particular on parent visa 143. We have applied for ย theย parentย visa 143 in January 2016 and have gone to the various procedures and processes of the application.ย We are in the final stage of waiting for the visa to be granted but in view of the COVID-19 pandemic in Australia we have yet to receive any news from the Authorities . My Mom is here and we have also submitted all DOCs and have been waiting for CoVid situation to improve so they progress my parents application, but on 29 Aug 2020ย she will complete 1year in Australia and needs to leave the country before that date/unless I apply another visa (not sure). Currently she has 600 Tourist Visa which allows her to stay in Australia 1 year on every visit which expires next year in June. Does anyone have some idea how to go about getting her to stay here in Australia as it isnt safe to travel anywhere at the moment? Thanks! However, we are still at the AOS & medicals stage. In their case the visa has an 8558 condition. They don't have an 8503 condition where a waiver needs to be requested. Although their one year expires in October, their visa as per VEVO is valid until March'2021. They will stay here until then. We don't need to do anything at this stage as noย waiver is required for the 8558 condition.ย Once the borders open up, they will perhaps start asking for the second VAC. Then they can perhaps leave AUSย and come back. Hopefully it will be safer then. ย

This is a condition in visa and the visa holder needs to comply unless they have applied for another visa which lets them stay longer otherwise the visa holder has overstayed.ย Now since your in-laws dont have an 8503, it means they can apply for a new visa without waiver of the 8503.ย I am going to apply for a BVA before my Mom's 12 month period is up, because she holdsย substantive visa 600 and has applied for aย substantive visa 143 The only contitions my mom has on her visa are 8101 (no work), 8201 (max 3 months study) I hope this helps! At the moment we are hoping that the borders will open until then and they don't have to do another round of temp visas. As a rule a 143 visa can only be granted onshore to a 173 visa holder - unless your mother has what is called a substituted subclass 600 visa. Best regards. @Alan Collettย This is what a mate of mine got when he sent in a request for the 8558 waiver.ย ย If you hold a visa with condition 8558 you should depart Australia before the date on which you will have stayed in Australia for more than 12 months in any 18ย month period. If you are unable to depart Australia before this time for reasons beyond your control however, we do not expect you to apply for a further visa unless you are unable to depart before your visa expiry date. Your โNo Further Stayโ waiver request will therefore be prioritised according to the visa expiry date, and not the date on which you will have stayed in Australia for more than 12 months in any 18 month period. Condition 8558 is not able to be waived, however a breach of this condition under these circumstances will not result in visa cancellation or have any negative consequences for a future visa application. ย
