Which Partner Visa is better - 309 or 820 and also why is it better ?

Hi guys,

 

Looking to apply for a Partner Visa for wife and considering which option is best in terms of processing timws. Which Partner Visa would be better - 309 or 820 and also why is it better ? 

 

If applied for Partner visa 309, would she be able to apply and then come to stay with me till it is processed - would we know when the process is close to completed so she can be away when the visa is completed for this ? If it is 309, how do people typically do it - do they come to stay on tourist visa for a bit while it is being processed.

There is no better as it depends on your specific situation.

If she can get a visitor visa, she can came and visit for the period the visitor visa is granted for. This is not guaranteed however.

A 309 cannot be granted while the person is in Australia. If they are ready to finalise and see that the applicant is in Australia, they will contact them and ask them to leave.

Thank you for the reply Raul. Is the above a formal procedure / Standard practice - that if the person is in Oz when they are ready to complete, then they will inform the applicant of the same ?

Yes, they will contact you and let you know to leave Australia for a few days so that the visa can be granted.  People often take a short trip to NZ or Bali for this purpose, and then once they are notified that the visa has been granted, they return.  The visa is activated when they return.

A bit confused as when I called the department yesterday, they said they may or may not do the call. 

If we apply through a MARA agent, is it sure that they would call ? 

Also, is there any data on how long the 309 visa would take if we apply through a MARA agent and are here on a tourist visa ?

They will email you. If you have an agent the email will go through the agent. If not, it will go direct to you.  They have to inform you when they are ready to grant as you have to leave the country, there is no "might call" about it.

From people who have done this in the past.  They will contact you, usually by e mail and ask you to arrange to leave the country in order for the grant.  You let them know the dates when you have booked and they will arrange for grant, the visa will then be validated on your return to Australia. Not complicated or difficult just an extra expense if you were not planning a holiday.
