Are there any exceptional circumstances where a Australian Visa can be granted without going through the normal Visa protocols. I have reached the end of my tether with the current system. It seems it is designed to reject the applicant without reason or logic. It also appears to have an inbuilt discrimination against the aged. In my opinion it is bordering on illegal.

Look up the contributory parent visa, it's a possible option for you if you have children here and can afford it.

 

To be honest, Australia has one of the most accessible visa systems in the world, try getting a visa for America, it is much much harder.

 

Australia is under no compulsion to just offer visas to everybody, it simply does not work like that in any country and with an aging workforce here, Australian citizens have to take priority in that regards.

There is no back door if thats what you mean. DIBP only issues visas to people who qualify for them, not those who just feel like moving. And if you meet the requirements they grant the visa.

The older people get the less they can contribute to society by means of working/taxpaying, and Australia wants people who can contribute, not eole who it has to support.

 

Harsh maybe but true.

I can understand how frustrated you are,but the fact is that countries are allowed to be fussy about whom they accept. As Sammy says, if you think Australia makes it hard, just try getting into America or Canada - they are much harder. Or try getting into Britain as an Australian (you'd be surprised).

 

Unfortunately if you're not eligible, you're not eligible, and I doubt there is anything you can do about it.

Hi Keith, I don't want to be rude, but if you're so desperate to be with your daughter didn't you consider your visa strategy before she left for Australia? If reunion is very important to you all, which I understand, it may be that she has to consider returning to the UK? There is a good part of this forum which can provide advice on that. Here is an excerpt from a work I wrote in 1992/93 that was published in 2001 by Otford Press:

 

'I have never seen a Federal Court application.

I have spoken to a few lawyers from some of the free legal

services to get a clue, but none of them has been to the

Federal Court. I do not even know which Act to apply

under. I had enough trouble with the Philippine application

and we were not in a fight.’

‘You told me that it was the Administrative

Decisions Judicial Review Act.’

‘I did, yes, but you can't apply for damages under

ADJR.’

‘How do you know?’

‘I asked the database. That was the case under the

wrong Act.’

‘How do you apply for damages?’

‘I'm stuffed if I know. I found only one case with

damages and Commonwealth, section 39B of some Act or

other, and some aviation company or other, they won.’

‘Aman Aviation.’

‘That's right. How did you know?’

‘It was in the papers years ago. The commonwealth

cancelled their contract and . . .’

‘Don't tell me what was in the papers. Go and

memorise the case report, and all the other rot.’

‘Can we do it?’

‘We can have a look at it and decide. If I can work

out a way that we do not get costs stuck up us then we

should have a go. We will have to attend court a few times

and see how it looks.’

‘Are the courts here the same as Philippine courts?’

‘More or less the same I suppose. I don't know.’

‘Are the judges corrupt?’

‘Of course not.’

‘You said the department of racialism wasn't

corrupt.’

‘Can you prove it is?’

‘I'll have a go.’

‘Corruption flows top down, as you know very well.

Bogus didn't bother to reply to my letter when I asked him

whether he wanted to know who was selling visas in

Manila, and buggering children.’

‘Would you have told him?’

‘No, but I am trying to tell you something and you

are not getting twenty questions.’

‘Tell me we are doing this for fun.’

‘How can you expect to win when your opponent

can change the law retrospectively to make anything he does

legal?

I was short of a chapter so, to amuse myself, I sued the minister - Russell v The Minister .. G75 of 1993, unreported,. If you follow suit get your files under FoI before you sue or else they might, could, will (select one) vanish. Beware of costs.

A lot of parents successfully migrate. There is nothing illegal in the way the age criteria is established. There aren't any loopholes or shortcuts, you need to meet the criteria, lodge your application and wait for it to be processed.
