ENS 186 Visa - Temporary Residence Transition stream

OK It's a bit of a long winded story but I'll try to shorten it as much as possible:

 

 

  • I'm on a 457 Visa with my current employer
  • Last August 2012 we put in the 186 Visa and they paid for it all (Over $3500) but I was told to submit the documents myself.
  • Paid and had all medicals done and UK and Aus police checks
  • Didn't really know what I was doing but did my best and thought I'd uploaded everything correctly
  • Received a call a couple of weeks ago to say I'd submitted the Employer part using direct entry stream and my part using theTemporary Residence Transition stream which is the one I should have chosen for both.
  • Basically told it was either withdraw and lose the money or she'd have to refuse it.
  • Obviously I withdrew and my employer is happy (ish) to do it again but I am obviously having to pay for my part this time
  • We submitted everything again on Friday

 

 

My questions are;

 

  1. As I can't afford a migration agent (And am pretty confident I'll not be that stupid again) am I able to submit a decision ready application on my own?
  2. Do you know what the current wait time is for these applications as I already feel we've been waiting for so long and I don't feel safe if you know what I mean? I feel like there's a huge weight on my shoulders until this is final. We want to buy a house and actually settle in the Country we've called home for 5 years and it's all our son has ever known.
  3. The last person at the company gave me the last 3 month bank statements but I'm now been told that I can't have these due to privacy - will this be a deal-breaker.
  4. If there is something missing will this put us back down the list?
  5. Has anyone else been this stupid and had to start again?

My answers to your questions in same order:

 

1. No, only RMA can submit "decision ready applications".

2. I believe your recent experience is probably indicative, that appears to be August to May. I think 6-9 months is about normal at the moment, very slow..

3. Do you mean your company accounts? Pass. I was not aware that people typically sent company accounts, however if they are asked for and the company refuses to provide it surely isn't going to go down very well.

4. If something is missing it will just mean everything will take longer. Much better to try and think of everything, it seems like if the file is put down, they might not pick it up again for a few weeks, so you want to try and avoid that by providing complete application.

5. I am sure people have had to start again, yes.

1. You can't submit decision ready, however you can submit all the docs yourself that are on that list. We did and it went straight to a decision, no further info required.

2. Our direct entry visa took 4 months to be granted in total.

Hi all,

 

I am currently filling out the online form for my part of the 186 and the question - Usual country of residence has confused me. I am living in Australia on a 457 visa, have been for 3.5 years, so is that this address or my old one back in the UK which i am a citizen? its confusing as he next question is your residential address, and postal address, which i asume is the Australian one?

 

can anyone help?

I am a bit confused. Did you compete the employers paperwork for them as well as your own visa application? That would be a bit unusual as the employers would normally do the nomination.

 

Tell me about it, he left it so late and was so busy I had to to get it done! I'm so angry with him actually he been promising to do it for such a long time now.
