  1. I'm currently holding a 457 as a Cafe Manager and can tell you it wasn't easy to get approved. Cutting long story short CO told my agent he was going to refuse it because he didn't like such occupation, he didn't think Cafe Managers are really needed. Luckily my agent was great and put together a letter explaining that the position was genuine and so on... a month after that incident CO just approved my VISA without saying a word. I'm grateful I used an agent otherwise I'm sure the outcome wouldn't have been any good. I've changed jobs ever since and my new employer does sponsor people (company is huge). Last week one of his cases (Cafe/Restaurant Manager as well) was denied and they are now appealing. Lawyer said Immi is getting harder and harder on 457 visas and anything they can do is to show they are not being dodgy.
  2. Hi Cippalippa, If you don't mind me asking what exactly you're applying for that you need to prove 1 year experience? I'm a Cafe Manager myself on 457 atm thinking about next step to get PR. Thanks
  3. I do agree you never feel safe on 457 but this is the only option we have. I stated before we don't qualify for any other visas (trust me, I wish we did! badly!). Fingers crossed we will make it through and apply for TRT
  4. Right now I'm sure both companies would agree to add a dependent if needed, but who knows what future holds. Anyway I believe it's easier to deal with adding a dependent than finding another sponsor in case one of us have trouble at work. To be honest I don't think we'll have any issues at work, it's just a matter of feeling safer.
  5. Oh no, I wasn't thinking of moving to his visa as his dependent. My idea was to keep my visa and he would get his own visa, no one being dependent on one another. If one of us have trouble at work and, let's say, lose the visa, we could apply to become dependent... sorry if I wasn't clear in the start
  6. One of the 457 visa conditions is you can only work in your nominated occupation, and for the employer that has sponsored you.
  7. But if one of us lose the job that means we no longer have a visa so we would classify to become dependent, right? My main concern it that Immi won't approve my hubby going from my dependent to his own visa and then moving back as my dependent if something goes wrong and he loses his visa (and vice versa). They might think we are fooling around or so.

  9. Hi. I'm currently on 457 visa and my husband is my dependent, but last week he was offered his own 457 visa. Could he accept it and move to his own visa? And what if one of us lose the job, could I apply to join his visa and vice versa? I know it sounds very messy, but I would love to have 2 visas and feel safer. Last year I had trouble at work and felt trapped as I couldn't leave without finding another sponsor. Just by knowing we have each other's visas to rely on life gets a little lighter.

  11. Nobody? New employer called me last night to let me know he is meeting with his lawyer on Tuesday and then will tell me the outcome. Quite anxious here, would give my resignation letter tomorrow if I could.
  12. Hello all! I've seen many posts about changing employers while on 457 visa but none of them has the answer I'm looking for. Quickly, I'm on 457 since August 2014 and lately my working conditions have been terrible. Ever since the visa was granted my boss started bullying me and always saying things like 'now I own you' or 'I know you have nowhere to go, you'll never leave'. Don't want go deep in there as it' a lost cause and things won't change so decided to find another job. Two days ago I found a company willing to sponsor me under the same ocuppation (Cafe Manager). They are already SBS approved and as far I understood they also have a nomination approved. My question is: my current pay is $56,000 per year and new employer said his pay is $53,900. I don't mind at all, just need some peace of mind and $2K less a year is very much worth it. But how will Immi look at it? Both companies are in Melbourne not far from each other (different suburbs, 15km apart). Also, I'm aware this might take 2 to 6 weeks but could it be any faster if nomination is already approved? Thanks!

I'm on my phone so couldn't find the link where I got this information from, but few days ago I read somewhere that the 457 visa holder can complete the notice period with their original employer without being in breach of condition 8107 (after nomination with new employer is approved). Have a look online, I'm pretty sure you'll find it
  14. Hi Raul. I will definitely seek professional advice, but I do like gathering as much information as I can. May I ask where did you find the information about part-time employment? Booklet 11 (http://www.immi.gov.au/allforms/pdf/1406.pdf) defines "employed" as "having worked in paid employment for at least 20 hours a week". Of course it's possible I'm not even looking on the right Booklet, but it doesn't hurt asking. Thanks.
  15. He said his lawyer advised him to wait 2 years to apply on the Transition Stream instead of trying the Direct Entry because if things didn't go well he would 'lose' 1 year spent on 457. I'm having a look on the Immi website but couldn't find a hint yet
  16. Hello! A friend ofmine told me if I apply for the Direct Entry Stream (after getting a positive assessment from Vetasses) and for some reason it's refused I'll have my time on 457 back to zero. Has anyone ever heard such thing? Next year I'll complete 3 years working as a Cafe Manager and would like to apply for the 186,instead of waiting 2 years to apply under the Temporary Transition, but if it's refused apparently I'll have to work for 2 more years instead of just 1 to go under the Temporary thing. Does it make any sense? Any help is appreciated. Thanks.
  17. And the nightmare has finally ended! Visa granted on August 21st! Timeline SBS Application lodged: 20/12/2013 SBS Approved: 28/02/2014 Nomination Application lodged: 13/02/2014 Nomination Approved: 10/07/2014 457 VISA Application lodged: 14/07/2014 457 Visa Approved: 21/08/2014 Couldn't be any happier! Yeah, we had a huge headache when applying for nomination as the CO didn't want to approve it as - in his own words - a cafe is a small establishment and doesn't need a manager (the one I work for has a good size though). Luckily it is in the past now. Thanks for the heads up, wasn't aware of those 3 years of experience for 186!
  20. This sounds great! I can prove I've been doing 40 hours per fortnight and my duties do match with whatever ANZCO requires. Unless they find something else to put me off looks like I do have the education and qualification needed to be assessed. Much appreciated your help!

Actually I'm still not sure... reckon I can prove the education thing but was hoping to have someone who applied to tell me if part-time experience counts... they are not clear about it and I couldn't find this piece of information anywhere.   22. Right. But to get a 457 the ask for Management or Business degree/diploma... Thought by having a 457 for Cafe Manager would mean I do have the level of education needed. I do understand they can say I don't have enough experience though...
  23. I've read the link and thought I would be fine, not sure of what they consider 'relevant'... I work 20 hours per week, same employer and same role for the past 2 years. As he is opening up a new place and therefore needs a full time manager he ofered to sponsor me in December 2013. Still waiting for the visa outcome but quite sure it will be positive. Anyway, could you clarify what is a relevant qualification? It has to be full time? I had to edit the post as before I was talking about education instead of qualification. Thanks!
  24. Thank you for the link, very helpful. It seems not so hard to achieve, if anyone has gone through this process please give me a light. Pretty sure it's harder than it looks. Have been searching around and came across few cases of people who got negative results even having many years of experience but no formal qualification or formal qualification but only 3, 4 years of experience in the field. I hold a Degree in Business back in my country (4 years - finished in 2006), a Certificate IV in Business and also a Diploma in Business done here (finished in 2012). Have 2 years of experience as a Cafe Manager (part time) and soon will be working full time (waiting for my 457). Will it be enough? Thanks =)
  25. Hi everyone! I was wondering if any Cafe Manager out there has done skill assessments with Vetasses. I'm soon-to-be on a 457 visa but thinking ahead already. My occupation is not an easy one to get the PR so I'm gathering as much info as I can to see what I can do. I can wait 2 years to apply under the Temporary Residence Transition Stream (186) but things change quick here. As I don't want to take chances I would like to apply for the Direct Entry Stream (186) - and to do that I need my skills assessment done. I could also try the Skilled Nominated Visa (190) but it's only accepted in the Northern Territory or maybe in ACT (limited). Either way I need the bloody Vetasses assessing my skills. My question is what do I need to present to get a positive result... how many years of experience, documents and so forth. Any help is appreciated. Thanks =)
