  1. Hi Rebecca, I have been concerned about this as well but my agent said I shouldn't worry about it. I have been in my occupation for 10 years and recently received an AQF Certificate III through RPL (recognition of prior learning). I have had my skills approved from the TRA but when I spotted the 3 years post qualification exp. I only have 6 months of this under my belt. I have been working in my occupation in Australia for 7 years and now in the process of ENS 186 from offshore. I hope everything goes to plan for both of us.
  2. Hi eswarpisces, I don't think it should be a problem for your employer to provide the profit & loss statement. However, I have been going through the same problem regarding meeting the training benchmark. If you know your employer has been investing in training for his Australian employees and meets the 1% of payroll, this will suffice. My employer has no training in effect with his company and is having to meet the training benchmark 'A' 2% of payroll, which he is donating to Tafe Institute to meet this requirement. It is also possible that the 1%, training benchmark 'B' can be met if your employer has evidence to show an auditable plan to meet the requirements without the training being delivered within the 28 day period that immigration give you. This auditable plan is also available for company's that have been trading for less than 12 months. I have info. on all this that I could attach here if it is possible to do so???

Hi I'm almost ready to lodge the ENS 186 Direct Entry Nomination & Visa Application together for DRC from the U.K. Does anyone know if it is mandatory to have my medical & character documents in this application for a DRC or do I wait for my CO to contact me? I'm sort of confused as I hear people talking about front loading their applications but don't really know if they're already in Australia when applying. I have recently just passed a medical regarding work for offshore so don't know if I should apply and wait and see if this medical is satisfactory with Immigration. Any advice greatly appreciated. Thanks.

  5. Hi louk, I don't see why not, you have not breached any visa conditions. You should have asked immigration if it would be okay to apply onshore as they would have known your circumstances at the time and that you were intending to travel now. This is why they give you 28 days to sort out arrangements and as blossom says, you would have to have sufficient funds to be granted this visa. I think they have changed it to the subclass 600 now for tourists on e-visa just to let you know. As you have booked your flight there is certainly no harm in you applying from NZ asap and you have nothing to lose except AU$115 application fee. My friend regularly does visa runs from Australia to NZ but you can now stay up to 12 months on this visa if granted.

  7. Congratulations, I was bang on 8 weeks. Managed to acquire an AQF III in Australia before leaving as I had no NVQ's. Relying on a private nomination now. If all else fails I'm sitting on 50/55 for an EOI without IELTS. Did you have to sit the IELTS to meet the pass mark if you don't mind me asking? Fellow painter.

Hi Jamie, I managed to attain a AQF Certificate III in my trade through a Recognition of Prior Learning which includes a full academic transcript in a matter of days with no practical training, providing I supplied all the evidence for my trade. This helped me to have a successful skills assessment as I had no trade documents and had to leave Australia and apply offshore. Bearing in mind it took me a week or two to gather the evidence but you could be ready to go. If you are based in Sydney I can pvt msg you the details of the company and fees I was quoted for my trade. This guy saved my bacon! I can also send you a detailed Statutory Declaration for a Carpenter to give you an idea what TRA are looking for in this department. Biggy
  9. Thanks for the link. I will discuss this matter with my agent. Would they not take into consideration that the qualification is Recognition of Prior Learning with 15 years experience. Maybe it's possible for me to try and transfer now through the oil and gas industry instead.

  11. It doesn't quote 'must' so I'll have to rely on my agent's advice. I had my skills assessment approved ok and there was specific criteria missing from that. Thanks for all your input folks, much appreciated.

My employer has highly skilled Australian employees and would only have to meet the 1% benchmark for this requirement, Training Benchmark 'B' In your link 'Training Benchmark FAQ' it states 'What if my training expenditure on my employees is less than 1%? Then Training Benchmark 'A' applies'. Why would they not just say then you have to meet Training Benchmark 'B' for your employees? Whichever benchmark this is, he will meet. I'm just not sure on this donation benchmark and if the recent expenditure will be confirmed as acceptable just days before applying for DRC.
  13. My agent told me to get the AQF but he never mentioned the 3 years post-qualification experience for the visa. He said everything should be ok with the experience I've gained in Australia but I'm not so sure now. Just need a little extra advice on this. Thanks JB.

Maybe for the visa application they could get back to you on needing more experience which could pay off as you work and wait but having to do the skills assessment first you would have to send all your experience you have from the date you apply. My skills assessment took 8 weeks to get approved with no more evidence to be provided.
  16. Hi Blossom, I have employed Global Visa's which has been a bit of a nightmare. They are sending my employer details for the 457 app. when I already told them I'm wanting to apply for ENS 186 Direct Entry Stream. I seem to be correcting them instead of getting results. I'm getting far more information using PomsinOz and investigating for myself. You always seem to help me as I always see your name popping up. I should have employed you!! :notworthy:

  18. That's why I acquired an AQF Certificate III to help me with my pre-qualification employment. Pre-qualification employment may be considered. Of course this get's considered. There's many out there that have years and years of experience but no qualification. That sounds even better for you, just 1 year post qual. in the last 5.

  20. I've passed my skills assessment but could still have problems with my visa. An agent told me to get my qualification attained through Recognition of Prior Learning but he never mentioned the fact I have to have three years post qualification to meet the visa requirement!! Same here mate, no idea on the agreement scheme and it sounds more complicated. There's no doubt you have all the experience for the occupation. Sorry, the 12 months in the past two years was related to my assessing authority, TRA. I have recently been approved my skills assessment and I am going through the 186 direct entry from offshore. I have worked in my trade in Australia for the last 8 years and acquired and AQF Certificate III in Dec. 12 as I thought I would have trouble with the skills assessment. Would I have trouble with the visa now regarding the 3 years post qualification?
  22. If you have PR in New Zealand can you not just go and work in Australia? I thought that used to be the back door for Australia. Just noticed all the other posts mate, if your looking to be sponsored in mcd's or kfc etc. I would probably investigate this more by asking your sponsor if he has done this before for someone or contacting the assessing authority (VETASSESS) for your field.
  23. The 457 leads to permanent residency after 2 years, this is when your boss nominates you through the 186. I am currently trying to get in on a 186 from offshore. I've worked in Australia for 8 years in my trade, have an AQF Certificate III and worked with my sponsoring employer and I'm shittin' myself mate. How much experience have you had with this employer and how much recent experience in the last 2 years?

Hi Rupert, Training benchmark A: recent expenditure to the equivalent of at least two per cent of the payroll of the business, in payments allocated to an industry training fund that operates in the same industry as the business. Is this not why the benchmark is 2% of the payroll as it does not develop training for his own business employees but helps the training of other Australian's? The reason being is I do not want my sponsor to donate almost $10k (2%) a very substantial amount before nominating me and be told it is not satisfactory. He also understands that his business is obliged to meet this requirement for at least 2 years. I have also worked for this company for the recent 2 years before applying. Thanks Biggy

As long as you have 3 years full time paid employment in this field and 12 months in the last 2 years prior to your application which I suggested you go and work for him for a year on a working holiday visa then apply for a 457. You would also need a qualification for your field to prove this to the TRA. Also, if your occupation is not on the list anymore, what do you mean by your sponsor is classified in this type?
