got visa subclass 475 - help required

We have been awarded a 475 regional provisional visa sponsored by Western Australia.

Due to lack of job offers etc we have not been able to emigrate and our visa expires in July 2010 if it's not activated.

Can we go over for a holiday just to activate it and return home after a couple of weeks? Will it remain active for the three years it's supposed whilst we're in the UK, for us to return to Oz when possible?

Is it possible to change visa categories without starting the whole process again? Our circumstances have changed and I think we would qualify for an independent migrant (subclass 175) visa.

You can go and activate a PR visa and then it is good for five years but not sure whether that would apply with a provisional/temporary visa and think not.

 

You should have a grant letter which will indicate conditions and if it gives you the latest entry date of July 2010, I'd expect that is when you need to enter by to start the provisional period.

 

If you want to apply for a different visa, that's what you have to do, no changing categories with the 475 as I understand it.

I understand from your earlier threads that your wife is a Teacher. What subjects and age groups does she teach, please?

 

Which schools has she applied to in WA? Have you tried the private schools as well as the State run ones?

 

Your earlier threads suggest that your sc 475 visa was probably granted recently and that you must make a validation trip to Australia before dd/July/2010? The three year validity of your sc 475 visas will start to run from the day that you set foot in Oz using your sc 475 visas. You should make the validation trip or your sc 475 visas will be at risk of cancellation.

 

There are far worse postings in WA than Kalgoorlie, my friend! Kalgoorlie is now a large, modern town with very good facilities (and good schools) apparently. Plus it is only a 4 hour drive from Esperance, which is gorgeous. Tom Price or Newman, up in the Pilbara, would both be far worse imho.

My wife teaches art in a secondary school although these days she's spends more time out of the classroom managing other teachers and the curriculum.

 

She's applied for various positions at state and independent schools in WA but rarely even gets an acknowledgement.

 

Our visa is very limiting in that we can only live and work outside of the Perth Metro area. Also limiting is my wife's belief that the only teaching jobs she would possibly be considered for are secondary school posts in her specialist subject, art and design, rather than the middle management role she currently performs, or even primary school postings.

 

Do you know much about the schooling system in WA? Do schools want round pegs in round holes or is there some flexibility about who can teach where?

Mmmmmm. I am no expert on education anywhere. I imagine that your wife would have to be willing to teach classes to start with, though. As yet, she doesn't know about how to manage a school in WA, after all, is not familiar with the local legislation about it etc.

How rude of the schools. What sort of example is that to the children in their care? I'd send a few pithy e-mails to this effect to any schools rude enough to ignore me.

 

Have you tried Smart Teachers?

A few months ago Nagle College, which is a Catholic secondary school in Geraldton, wanted about 8 teachers covering a range of subjects. The word I heard was that Nagle - which has very good results - had two British Teachers whom they were sponsoring on subclass 457 visas. Delighted with the first two, they allegedly decided that they wanted more British Teachers and I heard that in addition to advertising on the school's own website, Nagle reportedly instructed Smart Teachers to find the additional 8 Teachers or however many it was.

 

With the State sector in WA, I can offer some tips:

 

At present they have a Maths teacher at the good school in Mandurah - the one which shares the campus with the TAFE and the University. She is on a 457 visa and is leaving at the end of 2009 for personal reasons. Apparently WA DET's agreement with DIAC is that although Peel is one of the Regions of WA, it is not "rural or remote" WA.

 

Seemingly the deal between DIAC and DET says that if the school is in a rural or remote location, DET can sponsor the teacher for immediate Permanent Residency on an RSMS visa. If the school is fairly close to Perth, DET are restricted to offering a 457 visa only and then they will sponsor the teacher for PR via the ENS 856 visa after 2 to 3 years. The whole scheme is designed to provide an incentive to get migrant teachers to go to the parts of WA which the Aussie staff would decline to consider. Nagle College and Smart Teachers may have had a similar reaction from DIAC about Geraldton, considering that it is less than a day's drive from Perth (400kms.)

 

The coastal strip from Mandurah down to and including Margaret River is not deemed to be "rural or remote." Wealthy Perthites have holiday homes around Busselton because the Bunbury by-pass is now complete so the driving times are quite quick.

 

Kalgoorlie counts as "rural" and in my opinion it would be a darned sight better than the Pilbara or Kimberley regions of WA. At least you can escape to Esperance easily and it is not really in the cyclone belt, which the Pilbara and Kimberley regions both are.

 

Your wife does not need an employer sponsored visa, which might be foxing the schools. I'd ask WA State Migration Centre for a letter in the same terms as the one that Immigration SA publish in order to help the holders of sc 475 visas:

Our visa is very limiting in that we can only live and work outside of the Perth Metro area.

 

I suspect that this is nervous perception more than reality. My sister and her family (plus Mum) live in the Perth Metro area and have done so for years. However a dear friend of mine lives in Dalyellup Beach, a bit south of Bunbury. They are established and settled round there and wouldn't want to move from that area, because they can get everything they want in Bunbury so Anne almost never goes to Perth.

 

I think one of the main problems with WA is its vast size. If you go for only a fortnight, you really wouldn't have time to do much more than look around Perth with a quick flip to Mandurah, probably.

 

If your hearts are set on Perth Metro, I think you would have an uphill battle to secure employer sponsorship, frankly. You would probably have to rely on a subclass 175 visa but your wife is on the CSL so your visa would be processed within about a year:

I suspect that the security of an sc 175 visa might be what you would really prefer? If so, you would need to apply for a sc 175 visa from scratch, with all the attendant costs, but there is nothing to stop you from doing so if it would make your wife feel more confident about moving to Oz.

I have changed from a 176 s.a state to a rsms visa,at the mo we are filling in a 47es form(pain in the bum they already have all this info).Will i have to pay any of the fee's again & will the med i have had done be ok?

Hi,

I have recently applied for a 475 visa and am intending on the move to Mandurah as this is non metro. As far as I know, the visa is a three year visa and part of the criteria is that you have to live in a regional area (Mandurah etc) for two years and work for one year. On the web site Skilled – Regional Sponsored (Provisional) Visa (Subclass 475) it states "This visa is a three (3) year provisional visa for skilled workers who are unable to meet the criteria for a Skilled - Independent visa. You will have the opportunity to apply for permanent residency after you have lived for two (2) years and worked at least 12 months in a Specified Regional Area of Australia".

 

This to me says that if your visa entry expires July 2010 then you need to go over to activate the visa before this date and then you have a year in which, if you need to return to the uk then you can however, you must live out there for two years and work for one.

How about keeping the same 475 visa but changing the state that's sponsoring us? Is that a a more vialbe, less costly and less time consuming possibilty?

Hi dazzarooni,

 

I read your post with some interest. I originally applied for a 475 visa as I originally was awarded a SS from South Australia. Later on I then received SS for a 176 from WA. I spoke with DIAC and they have catagorically stated that you cannot convert your 475 application into a 175/176 visa.

However what you can do, and this will help, is to apply for a seperate 175 or 176 at your own cost. You will then need to upload your docs once again. DIAC have informed me that a CO will not flick from application to application to transfer docs!!

Then once they have received these docs they will then see that you have already passed meds/police checks etc.. and the 175/176 visa will then supercede the 475.

A word of caution however is to confirm that your medicals are thorough enough to comply with those required for permanent residency.

Alternatively you can always contact other states and indicate that you have been granted a 475 for WA, however you wish to apply for a 475 with another state.

If the role is in demand, then they will snap your hand off. You are then only obliged to inform WA that you do not wish to take them up on their offer of a visa.States such as Victoria & South Australia allow 475 holders to work within the cities of Melbourne and Adelaide.

My next word of caution is to also look into the benfits of applying for a 175/176 as you have access to more benfits/help from the government should you need it, which includes health care etc..Sorry if I have put some spanners in the works, but these are all areas you'll need to consider

It will probably be easier to find work if you are actually there. Bit of a risk I know but that is what most skilled visa applicants are doing ie leaving for Oz without secured employment. Employers respond better to people they can see straight away.

 

I appreciate this is different on a temp visa to start with but if you really want it.......

I think you need to take the plunge and go out there or one of you go out there first and try to get work before the other also gives up work and makes a move. At least that would keep one income coming in. It is extremely difficult to secure a position from thousands of miles away and most people would not manage this, no matter what visa they are on.

 

If you ultimately decide that you don't want to take the plunge then there is nothing you can do about the existing visa. You can't change it to another state or to another visa. All you can do is start another application for a 175, but if you are still not prepared to come out unless you have a job lined up then that might be a waste of time and money as well.

If you have a look @ Regional Sponsored Migration Scheme (Subclass 119/857) you'll see if you're eligible for a 119 and apply for that rather than the 857 it'll be fee free, staying with the offshore visa application approach.

As for your med it'll depend on when you did it as meds have 12 months validity.

Hi, is it really possible to change states on 475 visa ? Does not that mean we have breached our agreement wid the state who sponsored ? Though if we can do it, it would be nice i guess as I think its very difficult to get a full time job in my occupation in regional WA though I am still trying....wud be nice if I can look at other places such as Adelaide....Thanks
