  3. Correct I am not objecting to that fact - everyone is entitled to resign - that is not the point I am making. It is the fact that you make a declaration when completing your 186 visa application that you agree to take up the position for at least two years, if it is reported to Immi by your employer which the person stated that their employer advised they were not happy with them leaving to go to another employer within the two years than it can potentially put his/her visa at risk. I am not taking about employment entitlements or leaving an employer as everyone has that human right. It is an obligation to do with this the Employer Nominated Visa.

I did not say resignation is fraudulent. 186 is granted on the basis that you intend to stay with your employer for the 2 years. if as soon as he receives the PR and resigns to change employer than if his Nominating employer reports to Immi then he is at risk that the visa may be cancelled - as clear did not intend to work for the 2 years. Also on Immi website it clearly states that once you have the 186 VISA: We expect that you will work for your nominating employer for at least 2 years. If you don't, we might cancel your visa.
  7. Hi @Saugat Correct, it is because you have applied for your 186 - which means you are eligible for Medicare. However, as your 457 visa probably has the condition to maintain private health insurance it is probably best you keep your private health insurance until you have your PR grant.

Your employer is correct, the 186 PR application is employer nominated - it is granted based on the fact that your employer is offering you 2 year employment. and is granted on the basis that you have advised Immi that you will continue to work with your employer for the 2 years from visa grant. If your employer reports this to immigration your PR is at risk as you have provided fraudulent information as you have not intended to complete the 2 year employment post PR grant.
  9. Hi Jobie, It depends if you have used a Migration Agent (MA) then they will receive the notification of the visa grant, if not then you will receive yourself. It will also update in your immi account under messages - so if you check that you will also be aware.

Where is the proof is in this statement? @ElisePart of the 186 PR application is that you have intention to stay for 2 years, if this is not the case then your employer can potentially report you to immigration, that you have violated this, that you provided false information on your application. Only if circumstances change, like if your employer is deviating away from your employment contract may you have a case. This has been a hot topic in recent pages... if you are thinking to go back to study or take a new opportunity, best to talk to your employer see if there is something that can be worked in. Keeping your employer happy will mean that they will not report to immigration.

  12. You just have to wait it out, you are still within the timeframe. Also no set turnaround time for when CO will look at your file again after request for information. Even applicants from 2017 getting Agents to call IMMI or calling themselves get generic responses. Also there was another person in this forum, who waited another year after department requested more info regarding minor offence of their partner - as they had to do character investigation which can take time. Be patience and best of luck
  13. Hi MerryPumpkin, No further details were requested, my MA was pretty proactive with keeping the file up to date. With recent payslips, also he saw a trend of increased refusals due to 'genuine need for the employee', so as well as a letter from the director we also provided my key achievements, over 3 years of working at the position, contracts won, new clients acquired etc... Also linked with bonus payments, pay increases etc.
  14. Hi Jerita, your application has been in only since December 2018 you need to stay positive, you and many others are in the same boat. Complaining is not doing any good. You are still within processing times. Also be respectful, there are so many applicants in this forum waiting since 2017 who are patient and haven't complained to the extend I have seen from even 2019 applicants do so lately. I know it is frustrating, but honestly a positive outlook is a healthy one, do not sicken yourself with constantly comparing your application to others. I know you probably think this is rich coming from someone who has already got their PR. But I have been here for over 7 years - my initial 186 PR application got refused. This time round I remained positive, yes I was anxious that it may get refused again but kept that at the back of my mind and enjoyed living in the country I want to stay in, enjoyed my friends around me and lived each day by day. Seriously do not let this waiting game be the be all and end all - otherwise you will go crazzzzy!!!
  15. Check your application status If you applied online you can check your visa application status in ImmiAccount. We assign a status to your application to show progress. The status shows next to your application in 'My applications summary'. Incomplete means you have started but not completed an application. Ready to submit means you have completed an application and can submit. Submitted means you have submitted an application. Received means we have received an application from you and can assess it within the current processing times. Initial assessment means we are assessing your application. Further assessment means we are assessing the information we requested from you. Finalised means we have made a decision. We will notify you by email or post. Note: The application status for My Health Declarations and Partner sponsorship forms will always display a status of submitted and will not change to a status of received.
  16. Usually tells you on the Visa Grant letter. You can check the request for info letter pdf in messages on your account. But not 100% sure that it always means your application will be processed by that PESE. Best to check when you get the visa grant.
  17. Hi As long as you apply within 6 month of the visa grant than that is fine. If you apply Nomination and Visa at the same time - that still is fine, nomination grant does not expire then as application already submitted. Just applies if application is not submitted, then it must be submitted by 6 months of Nomination approval.
  18. Remember this forum is a very small sample of visa applications, just because no one has advised of via grants here doesn't mean they are not happening. Try to stay positive and do not get caught up with it. It is a waiting game but do not let it get to you.
  19. Hey, Haven't heard of a similar circumstance, timelines are impossible to gauge. I would suggest contacting your MA to see if there is an update - can they contact the Case Officer directly to advise or if they can let you know. It may be the case that your application is back in the pile for processing - if that's the case then could be picked up today, tomorrow, next week or few months/year. Obtained from Migration Agent Nominator changes their ABN or ACN Nominators can sometimes change ownership or business structures during the processing of a nomination or visa application which results in a new ABN or ACN. Nominators who obtain a new ABN or ACN are considered to be separate new entities, even if there are no practical differences, for example, the management and business practices remain unaffected. Where the ABN or ACN details specified on the nomination form change, a new nomination must be lodged and the business will need to be reassessed against Regulation 5.19(2)(a). Any associated visa application should be withdrawn and the nominee will need to make a new visa application. This is because the associated nomination will no longer be able to satisfy the visa time of decision criteria 856.221, that an approved nomination continues to satisfy all criteria for approval. A new visa application will be required as a new nomination must be lodged.
  21. If the ABN number of the business is changing, this will be a serious problem for your application. If you used an Agent for your application advise them of the sale immediately. If you self lodged the application, obtain some professional advice urgently.
  22. Incorrect. Your application is linked to the nomination - based on the business credentials - accounts etc... They need to inform Immi of the change. I know the nomination is already approved but if the department request any further information then likely your application will be refused. There was a case like this a good few pages back. I would recommend contacting an MA to discuss your options.
