For or the transitional stream, the nomination must be lodged after you have been with the employer for 2 years. in your case, you lodged the visa after you have been with employer for 2 years, BUT you were only 22 months with the employer when the nomination was lodged, so you have not met the 2 year requirement on the nomination part.
  2. did your employer lodge direct entry or transitional stream? If they lodge through transition stream then the reason is obvious as you have not met the 2-year requirement. If they lodge through direct entry stream, then the reason for refusal should be in the refusal letter. Ask your employer what was the reason. This is is the risk of lodging the visa part without getting the nomination part approved first. You lose the money you paid for the visa part. I suggest you have your employer lodge a new nomination using a good MA. Wait for the nomination to be approved, then lodge a new visa application once you have approval of the nomination. it will take longer to get PR but your money is safer.
  3. You need to talk to your employer again and explain that you need the nomination lodged ASAP as you are running out of time. Don't wait until May or you will be in a tight spot. If your 187 visa is not lodged by the end of April then you better pack your bags and be on the plane out of Australia by 4 May. Employers need to be chased. Mine took 7 months from the time they agreed to nominate me for PR to actual lodgement of the nomination.

  5. This is the checklist from DIBP website and shows you have to prove your dependents over 18 years of age have functional English. If you can't prove functional English for dependents then you have to pay a significant amount of money. http://www.immi.gov.au/Visas/Pages/checklists/187-applicant.aspx You must provide proof that your partner has functional english. An International English Language Testing System (IELTS) test result of an average band score of at least 4.5 based on the four test components of speaking, reading, listening and writing. Your test must have been completed within 12 months of visa application lodgement or can be completed during visa application processing. If your partner cannot achieve this score, there are other ways to prove functional English. So be careful, if you are not exempted from the English language requirement and you do not provide an IELTS of 6 each module at the time you lodge your application, then your visa might be refused because you did not satisfy the English requirement AT TIME OF APPLICATION Depending on where you are from, you might be exempted from IELTS so check the exemptions if one applies to you. You can only upload IELTS after visa lodgement for dependents. But for primary applicants it must be satisfied ​at time of application/lodgement.

I'm confused...I read in DIBP website that medicals should be done before lodging visa thru 'my health declaration" or if you have already lodge the visa, the website says you have to wait fr CO to request it. Can we do medicals after lodgement but before being allocated to CO? if yes, then where can we get a referral letter with HAP ID?
  9. Hi Leah, Philippine schools issue a document called CERTIFICATE OF ENGLISH AS MEDIUM OF INSTRUCTION. Schools usually already have a format of this. I also graduated in the Philippines and have requested this from my school.

  12. I did it 11 Feb 2015 online and on 12 Feb 2015 got email that the checks were completed on will be on the mail. Very easy to do it online
  13. I have a question, if the PCC from previous country of residence is valid at the time you lodge your application but expires while waiting for a CO, do we need to get a new one? ( eventhough you have not been back in that country since? I understand we need current PCC from current country of residence but not sure for previous countries.

The RSMS 187 was simplified (there is no more separate onshore or offshore file) that is why I was wondering if I am in Australia when I lodged my RSMS 187, then I go overseas using my 457 visa which is still valid until 2016. If while I am overseas DIBP decides to grant my 187 before my scheduled reutrn to Australia, will there be problems with Immigration at the airport when I arrive? as I was onshore when it was lodged but offshore when it is granted?
  17. I am hoping to lodge my RSMS transition stream visa by July or August (once the nomination is approved, nomination lodged 2 February). I plan to go overseas on December for about a month. If I lodge my visa application ONSHORE on August and go overseas on December, what will happen if the visa application is granted while I am overseas? Will there be problems? By the way, my 457 visa is still valid until May 2016
  18. I will be lodging 187 visa soon. I have question regarding front loading medicals. after I organise my health exam through "my health declaration" and print my referral letter. can I lodge the visa application or wait until I have actually done the medicals. if I lodge before the actual medicals, do I answer yes on the form where it asks if medicals have been done and provide the hap IDA or do I answer no. how long does it usually take to get an appointment slot for medicals

Hi tonic83 As you are the agent's client since you are the one paying (and I assume you are the one who signed the client agreement with the agent), your agent is bound to follow your instructions. So you can tell the agent to lodge only the nomination part and hold off the visa part until the nomination is approved. This may take longer to get the visa granted but financially you are safer.
