Tinaandco Posted May 26, 2015 Author Share Posted May 26, 2015 Hi sorry for the lack off info, she is 17 at the moment and she has been out of oz 3 times in total, the first time was for 5 months the 3 weeks for Xmas then from this January till now and we wanted to go back in August but that means she will have been out of oz for a total of 14 months. we have had PR the whole time tho since we first went to oz in June 2012. thanks xx Link to comment Share on other sites More sharing options...
VERYSTORMY Posted May 26, 2015 Share Posted May 26, 2015 No. The rule is as follows. You our must not have been out of Australia for more than a total of 12 months in the previous four years. You must not have been out of Australia for more than 90 days in the preceding 12 months from the date of application. However, as a minor, she might be able to apply for ministerial discretion. AJ Posted May 27, 2015 Share Posted May 27, 2015 They will add extra time on, if your 5 years will run out she will need to get an RRV first. Easiest thing to do is call the citizenship line at DIPB with passport number and they will tell you when she will be eligible. There is a citizenship wizard but its easier just to call. The good news is, you will be able to count some time already provided your daughter does not spend more time away. But the five months away will have to be more than four years prior to the application, and 5 of the current 8 months away will have to be at least one year before applying. Citizenship is really for people who have been living in Australia for four or more years and have made a commitment to the place, not for people who have been living partly in Australia and partly overseas. But it is clear that she will not be eligible now, you can go to the citizenship website and put her dates in and out of Austrlaia in the calculator to see when she would be eligible to apply, assuming she moves back of course. But it is clear that she will not be eligible now, you can go to the citizenship website and put her dates in and out of Austrlaia in the calculator to see when she would be eligible to apply, assuming she moves back of course. Also assuming that the residence requirements are not increased before she becomes eligible to apply. The Australian government is currently considering increasing the required period of residence (among many other proposed changes to the Australian Citizenship Act). Quinkla Posted May 27, 2015 Share Posted May 27, 2015 The earliest date would be 9 months after you return to Australia - and that would be assuming that the five month absence had lapsed. If it hasn't, then it would be approximately three years and 10 months from the date she returned from that absence (because the other two months, plus the 3 weeks, plus the 8 months would add up to the max permitted one year away in the past four years). I presume this is related to eligibility for HECS - in which case, you should also be aware that it can take 6 months or more to get a citizenship ceremony from the date you apply.
