Start new business on a student visa

While I am exploring all the possible pathways for migrating to Australia I was told that it is possible to come to the country on a student visa and then start a new company( i am thinking of a private tutoring company).After a year, I can apply for the 457 visa. Can anyone tell me if this is feasible?

The 20 hour work limit per week still applies if you are running your own business and you need more than that to set up a successful one.....then your business has to qualify to sponsor individuals for a 457 which includes why no Australians can be found to run it....then and most importantly, the job needs to be on the migration list of professions and you must have the skills and qualifications to match it. Tutoring is not on those lists so this plan is not going to work.

It is possible, but difficult. Take professional advice before you try it.

Why do you think it is difficult? Can you please explain?

 

As wrussell has advised, your plan is possible but complex.

 

It will involve self-sponsorship on a subclass 457 visa and is not something that can be simply explained in a few lines on an internet forum.

 

There are many factors which need to be taken into account such as the structure of the business, the business plan, cash flow projections, source of funds, training plans, your position in the business, etc.

Apart from the factors that you mentioned, do I have to earn at least 52000 dollars, as it is required for self sponsoring in general?

 

The salary issue is separate to the self-sponsorship issue. Both are important but not related.

 

The Temporary Skilled Migration Income Threshold (TSMIT) is currently $53,900 plus superannuation, however, it is not as simple as having to earn this much. You must also meet Australian Market Rate requirements which will depend on the occupation nominated. This means that the minimum could be well above $53,900.

My sincere advice, don't betray yourself ... This plan isn't going to work... Chances of success r almost nil... Why don't u explore some other options??? Many people choose student visa as an option to permanently settle therein Oz land but I can assure u that while considering the current employment scenario switching isn't an easy job anymore. In fact, it is quite a painful route unless your skills are in a sector which is genuinely experiencing shortage of labour...

My problem is that I dont have enough proof for my years of working experience, so I cannot obtain an assessment from vetassess. I was also thinking of going to Australia on a student visa, then open the tutoring company for a year just to gain the necessary experience, and then apply for the 190 ( i meet all the other requirements). But, as a student I will be able to work only 20 hours a week. do you know if vetasses require full time work only? Will I be able to claim one year of experience if working part time?

Yes, I am a Physicist and was teaching for 9 years but dont have the necessary documents to prove it. My question is if Vetassess accept one year of PART TIME employment.

 

Have you considered consulting a registered migration agent to develop a strategy?

You really need to have a chat with an agent. It will make no difference if they accept part time work if you can't prove you are any more qualified than a random person on the street. You could find you waste a year for nothing if you are not careful.

Of course I can prove that I am a physicist. I have a bachelors degree. Lack of proof refers to my working experience. But if I vetassess accept part time work, and I can work as a tutor while being on a student visa, I think that solves my problem.

You have been given sound advice here. Consult an agent as although you may not want to pay out for agent fees, it may well be cheaper in the long run because you could lose money trying for assessments that you might fail.

@wrussell is a very respected agent on here and you would do well to heed his advice and send him a PM to discuss how best to consult with him.

Have you googled the code for a tutor to make sure you have the minimum teaching qualifications? It isn't as simple as 'I have a degree' or everyone would be doing it. That's why it's best to invest in a bit of advice from a good agent.

 

Yes, I meet the minimum requirements and that is why I am not discussing this right now. My questions are on a completely different aspect of the topic.
