We are in the final stages of our 190 Visa, our CO due to be allocated on Friday, we declared my husbands drink drive in 2005, a common assault charge in 2008 fined £400 and sent on a course and possession of cannabis 2013. We however totally forgot about a second common assault charge in 2009 he was fined again. I know he has been stupid, he is a fantastic father and husband a hard worker and has made some stupid stupid mistakes. Our agent is concerned that we missed one of the convictions and I'm now really panicking we have been honest with everything since day one and genuinely didn't mean to miss the charge off his stat dec please can anyone recommend someone who can help us ? You forgot something, mistakes happen, it is not something that would have been a bar to getting a visa so doesn't sound like it is insurmountable. A professional advisor ought not get involved with a case where an advisor is already instructed - unless the advisor who is presently acting is appraised of the client's wish to discuss an issue with another person. Quinkla Posted October 15, 2013 Share Posted October 15, 2013 Your agent should be telling you about the form to fill in if you remember something that you should have mentioned on the application, and should be helping you to explain that it was a genuine oversight. Your husband needs to say he is sorry for his criminal past but has now turned over a new leaf. This might be tricky since his most recent conviction is less than a year old, but presumably you addressed this on the original application. I am guessing that the sooner you do this, the better. It may be that they are more concerned with the 2013 conviction, as we are currently in that year and there is a pattern/history of problems that are not in the past, but seem current and unresolved? Quinkla Posted October 15, 2013 Share Posted October 15, 2013 It would help you enormously to submit your supplementary information form before you have a CO. The first thing a CO will do is ask you for a police check. If you wait until then, it may look like you had tried to hide the record and realised you would get caught out.
