Desperate for PR, Need some definitive advice please

Hi All

 

I've only been over in Australia for 8 months but would like to get permanent residency so that I know that I can stay after my visa expires; I don't want to be forced to retrun to the UK if I don't want.

I'm on a 457 visa which expires in November 2015, sponsored by my company (a retailer) and employed on a 3 year contract (which I think they would be happy to extend if needed). I believe my company have brought me over on the basis of being unable to find skilled Australians able or illing to do the same job.

I have spoke to a migration specialist but their answers are quite vague; however, they seem to suggest that I need to do 2 years work in my role and then get my company to sponsor me for PR. Is this correct, or is there another way to achieve PR quicker? I expect to have to pay some costs and know it won't be cheap....

 

Any help gratefully recieved...

You don't have to stay with your employer for 2 years to get an employer sponsored visa or even your own independent visa. You do that if you don't think you'll pass the skills assessment (as you don't have to do one if you've been there two years).

 

If you've got enough points to submit an EOI or you're on the state sponsored skills list then you can go it alone.

 

If you don't you'd be relying on your employer for sponsorship.

 

I really recommend you give the immi site a good read and see which visa categories you fit into and go from there.

The two years only means you don't have to do a skills assessment if sponsored by your current company. You can apply before the two years are up if you qualify, but will need the skills assessment. In Gladstone, you should be able to get the RSMS employer sponsored visa (which is the one with the lowest requirements).

edit to add: as nicolac34 mentioned, there are also independant visas you could apply for if you have issues with your employer, but this will generally take longer to process than the RSMS.

Certainly - if you can get your employer to go RSMS then it's quicker than an EOI I'd have thought. I got a RSMS in Perth and my visa was granted in 2 weeks!

We know someone who got PR through their employer after a year. You could ask your co if they will nominate you early! He said that he was leaving his job as wife couldn't find anywork rather them paying for his return, they put him through to get his residency.

But you would still need to do TRA as you haven't work for 2 years in Australia which is a cost you would have to bear. When we went through the ENS system with our employer, the visa only took 2 weeks to come through.

Regional Sponsored Migration Scheme. Has lower requirements than the standard employer sponsored visas.

 

But isn't applicable everywhere, only applies to "regional, remote or low population growth areas of Australia".

Sydney and Melbourne are out, but Perth and Canberra are in etc...you must give them 2 years, then you're free to move and work anywhere. It's a quick way in for some people.

Those days are gone (for the moment at least). We applied in mid June........ Waiting..... Along with MANY more. Loads of people applied before the rule change so they have huge backlogs.
