  1. The nomination is lodged by the business meaning no business = no nomination; no nomination = no visa. The moment AAT/Immi finds out you’re no longer working there/being nominated, both the nomination and visa will be refused and you will be given not sure how many days to leave (21 or 28). You have the option to lodge a new nomination while you are still here, if you find a new business, but you still might have to leave after the 21/28 days and wait for the decision overseas as you won’t have a substantial visa to remain here. If approved you can then lodge the visa application, if granted you can then move to Australia again.

  5. Difficult to assume but from what I've been seeing online it is usually between 14 months and 24 months. Not sure if them receiving the notification regarding your health situation might speed things up (make them open your file faster). Don't be limited by finding an Agent in Brisbane, you don't need them physically close or present. Everything can be done online. I haven't even met my Agent and I've had him for over 2 years. Once you find people who have dealt with such procedure they might be the best ones to suggest Agents too.
  6. Hi Karan Do you have an Agent? This is a very specific case and unless someone else here on the Forum has gone through the same scenario I wouldn't expect much help. Even the Agent has to be knowledgeable and experienced in such issues so if your current one is not, I suggest you finding the right Agent first before proceeding to the next step. In case you're given the chance to remain here for the treatment check if it's possible to lodge a new nomination from a new business- if you can find one. In case you have to go back to your home country and finish the treatment there, look into options to apply again from overseas (if you got a Sponsor). This is still a high risk I believe with the TB, unless it can be cleared. Sorry, I'm no expert in TB. I also suggest you google other forums where people discuss precisely such TB concerns to get more insight into what's possible but would under no circumstances recommend you going through this process on your own.   7. Great then, focus on proving the points they stated when refused you, you will be fine. Many people win at the AAT as the people there are not as the people at IMMI- they are not bothered with politics and instructions by their party or Prime Minister. They have to be 100% objective.   8. It's your Agent's job to prepare a strong case along with your Business, you as applicant can only do so much. Also, the current waiting time is sitting at around 2 years so relax a bit, won't happen anytime soon. Make sure you find a good Agent and your business is ready to support you throughout the process however needed.

  17. How do you know it will open? Once opened they should request additional documents, if they require any. But normally the documentation you provide should be related the the reason for refusal- so in your case everything to prove that there is a genuine need.

  19. What's for NSW? According to the website general processing time, average, is 1 year and 7 months. Curious after how long from appeal date they normally request further docs? Ta
  20. That's the explanation he's giving to us, not them. He's only told Immi that he's updated everything.
  21. Don't worry, just lodging an appeal application is enough to start with. You can add documentation whenever you want after that. You can also wait for them to open the case and request supporting document before submitting.
  22. I agree, and the reason in his case is *financial loss*. In my opinion payslips wont be enough as you've had payslips since the day you started, and even without them IMMI can easily see how much you're paid. When the business is showing loss the best way to fight it is with a strong business plan (long term goals and plan, recovery strategy etc), and investments done by the business (if applicable) to justify it.
  23. To be honest I don't think that is enough. Your agent should really prepare a strong case for this one, as in show a business plan that proves they're handling it, have long-term plans and goals, how they deal with the loss, do they invest in something that might support the loss, etc. Just the payslips is not enough as they can easily see how much you're paid, this needs more than that.
  24. Thank you. It wasn't due to a mistake the Agent has made, it was simply a misunderstanding, still can't believe how the CO has twisted the facts and made up a different story. We will appeal at AAT with the same Agent, hopefully this week.
