  1. @E2306 Oh no, you've made a grave error. I'm sorry to say that based on what you've said it's highly likely to be refused and you would lose all of your money. My advise would be to contact a registered migration agent at the earliest opportunity. I don't hold out much hope but they may be able to help in some way.
  2. The 461 doesn't take very long to process. A couple of months, so she could apply now and it's done.

  7. No problem. Shouldn't be much longer than 4-6 weeks.
  8. There's a possibility that she could get another substantive visa to allow her to stay, but she'd really have to know exactly what she wants and if she is eligible for it. Without knowing specifics it's very difficult to say whether she would be successful. It might be worth using the visa finder on the border.gov.au website, to see what she'd be able to apply for. She'd also have to ensure that the visitor visa that she travelled on didn't have a 'no further stay' condition on it, otherwise she'd not get a bridging visa to carry her through to the substantive visa that she was applying for.
  9. Living in the sponsoring state on a 190 is not a visa condition. It's more of a gentlemen's agreement or a 'moral obligation'. You are expected to stay in the state, but there's currently nothing in law that says that you must. Many people use this backdoor into Australia, but many states are clamping down on it from the outset. Some are insisting that you have strong family ties in the area, have minimum 80 points, or are already living in the state. I'm not sure if Victoria is one of those states, but it's worth finding out first.
  10. Yes, I agree it is slightly conflicting. If in doubt get the AFP check anyway. That's what I would do in that situation.

  13. Not far off what they do now to be honest with you. They really just want to weed out serial offenders, and people who have committed crimes that would result in long jail time or series of crimes that result in imprisonment. They aren't interested in the 'jack the lad' who got up to mischief and petty stuff when they were younger. They like honest people who accept that they did wrong, and also people that don't dumb their history down or try to distance themselves from it. Also, a word of warning to anyone with a record who is travelling to Australia prior to applying for a visa.....make sure you tick yes to the criminal convictions on the incoming passenger card. The IPC's are crossed checked when processing your visa. And if you haven't declared in the past then the department will know that you completed the card and gave a false answer.
  14. You can apply for this visa while in Australia and receive a bridging visa. Providing that the visa that you originally entered on does not have a 'no further stay' condition.
  15. Don't worry about it. As long as you don't break the conditions of your visa you'll be fine.
  16. Currently there are no invitations being sent out for Accountants with 60 points. If I recall correctly, accountants with 60 points have been waiting over a year already. I can't predict the 190 visa.
  17. If I were you I'd give them a call, tell them that the original certificate says no live trace and that unless something is on the record then they should issue a new one correctly annotated. You might get a new one for free, so it's worth a try. You'd only get a no live trace for any convictions or cautions. Nothing else.
  18. I'd send a complaint into ACRO if I were you. It shouldn't say that if there is nothing on your record at all.

  23. Fill in form 1023 which I presume that you have already found. Get your husband to write a very humble grovelling letter explaining his silly mistake and that the offence was out of character, it was embarrassing and that he'll never be a naughty boy again. Another thing that you'll have to do is to get a written explanation of the offences committed. Easiest way to do this, including dates and how the offence was dispensed with, is to apply for a subject access report (available on the ACRO website). This costs a tenner and takes 40 days to arrive. You can get your husband to call ACRO and they can tell you exactly what the offence(s) were so that you don't miss anything else. In the meantime explain what you are going to do to the department and I'm sure that everything will be ok.
