Hi George,

 

What will happen to thos CAT3 applicants where CO already assigned to the applicants becoz i have read on DIAC website they are currently processing CAT2 applicants. will CAT3 cases would be halt untill all the CAT2 applicants will be finalized?

 

 

Having seen how the Victorian SMP is constructed, and considering what gossip is available about the ACT's SMP, the following considerations come to mind:

 

a) Victoria has picked up very few Schedule 4 only occupations in its SMP. There are some 200 occupations in Schedule 4 which are not in Schedule 3, and at first blush I think they're only sponsoring about 20 of those Schedule 4 occupations. Although it's impossible to know how this will be handled until the Memorandum of Understanding between Victoria and the Commonwealth is released, it does seem that there will be a lot of Schedule 4 applicants already sponsored by Victoria whose priority will not be changed by this announcement.

 

b) Victoria has signalled that it will consider cooks, pastrycooks, welders and airconditioning and refrigeration mechanics in the future, but that quotas for those occupations are full at the moment.

 

c) Almost all offshore applicant IT people holding a pre-July 2010 skills assessment in IT will be eligible to apply for Victorian sponsorship, particularly if assessed in the specified former MODL skills. One new IT specialisation is GIS. Existing sponsorships in most IT occupations except Data Warehousing will also be included in the SMP.

 

d) The ACT list is most likely going to be longer than Victoria's but with higher English and work experience requirements; given that they will only have 1700 places I would imagine it will fill up very quickly.

 

e) Hard to believe any other state will have more places to fill than Victoria - it's going to be a tight squeeze to get SA, WA and Queensland in on that kind of quota.

 

f) Doesn't seem to be much hope in this list for subclass 475 applicants with more diverse occupations, a lot of them will remain in Priority 4.

 

g) Most existing decision ready checklist applications have until Wednesday to be allocated since as soon as the SMPs come into effect those cases take priority in Brisbane - but as the ACT doesn't sponsor many onshore graduates, relatively speaking, and given the narrow list of occupations which Victoria is now sponsoring, there's still hope that some decision ready checklist applications will continue to be allocated in the Brisbane Skilled Processing Centre. A lot will depend on whether other states come in with their SMPs at the same time.

I am now even more confused-how are some people going to be awarded the 475 visas if they cant get state sponsorship and which also carries 10 points? This inherently means that unless there is a new way of allocating points then those at the older end of the spectrum are going to be even more disadvantaged than before despite the wealth of skills and knowledge they can bring. The old way of having a 2 tier state sponsorship list of occupations that attract allocation of permanent visas and those that attract provisional visas with 10 points allocated to each seems to be potentially changing or am I very wrong?

 

Also in the Victoria lists details it states :All applicants for sponsorship under the Skilled – Regional

Sponsored (475 and 487) visa must have an offer of employment in

regional Victoria in their nominated occupation.

 

Is this new? I Thought the 475 was an independent temporary visa linked to state sponsorship and not linked to an employment offer!!!!!

 

I have been thinking and thinking about this and do appreciate your reply George-one thing that confuses me is that if you have a job offer wouldn't you then go for an employer nominated visa and therefore not need state sponsorship given it is not dependant upon points-does this therefore mean that they realise that employer nomination is not really working for the smaller businesses or, if truth be told, the larger organisations (especially since they attached loads of financial obligations for the 457 visa)?:err:

On 16th March 2009, Evans allegedly went a mite spare. According to him, his New Plan of 17th Dec 2008 was supposed to result in visa applications being dumped at the last minute on 1st Jan 2009. DIAC had said the opposite. Evans said that DIAC had interpreted his wishes wrongly - and far too leniently for his taste.

 

Therefore - to what extent do DIAC retain the freedom and flexibility to decide anything by themselves? Is the new Minister less unreasonable than Evans?

 

I'd be questioniing DIAC about this before I would necessarily believe the MIA.

Yes we're seeing Victorian sponsored applications receive case officer enquiries so I'm sure that this is what's happening.

 

FWIW I doubt if the new Minister has had the chance to lose faith in his fearless Departmental advice just yet - however the processing culture of finalising applications with a case officer is far preferable to what happened under Evans, and remember, Evans was responding to a perceived national crisis in the GFC which may or may not have been influenced by maternal whisperings, see http://www.pomsinoz.com/forum/migration-issues/70325-what-would-you-say-minister-immigration-really-69.html#post609759 .

 

@Clickettuk - The ACT government has just advised that the SMP will be live on their website from tomorrow. They've also advised the following changes to their guidelines:

 

VERIFICATION OF ‘LIMITED’ OCCUPATIONS

The SMP Occupation List will be updated on a regular basis to show the current status of the demand against each occupation. A ‘limited’ occupation indicates that the current ACT target for this occupation is almost met. Applicants seeking nomination of a ‘limited’ occupation must have the occupation verified by the SBM Unit before an application for nomination is lodged. ‘Limited’ occupations that have not being verified will be refused without further processing.

Occupations not on the SMP Occupation List

Canberra residents who do not have an occupation on the SMP Occupation List may still apply for nomination if:

· their occupation is on the DIAC Skilled Occupation List (Schedule 4);

· they have been employed full time in Canberra for at least twelve months before applying; and

· the position is available for at least two years and located in Canberra.

I think I found the ACT SMP guys, There are lot of ICT occupations :GEEK: & you need IELTS 7 for each component

Just joined PIO to do some background research for our son who is currently in Oz just over half way through a working holiday visa and thinking of applying the longer term and the above query got me thinking! He worked for 6-months for one IT company in Vic and is now doing the holiday bit. He was considering Vic's 176 state sponsorship but there is a chance he may get a job offer so would he be better off waiting for such an offer and going via 457. Or can he apply for a 176 and cancel / change to 457?

Just joined PIO to do some background research for our son who is currently in Oz just over half way through a working holiday visa and thinking of applying the longer term and the above query got me thinking! He worked for 6-months for one IT company in Vic and is now doing the holiday bit. He was considering Vic's 176 state sponsorship but there is a chance he may get a job offer so would he be better off waiting for such an offer and going via 457. Or can he apply for a 176 and cancel / change to 457?

If he is prepared to pay two fees he can apply for the 176 which would eventually give him permanent residence. But can in the meantime apply for the employer sponsorship for the temp visa...

Several people are doing that at the moment.
