Did you try to send a formal complaint to immi? You’ve been waiting for so long.

Yes my immi agent have sent it.

It’s seems to be pretty normal. I got a friend who is waited 1 year and half after winning AAT.

Now my employer does not want me to work. Should i change the employer then new employer can go to the court behalf of old employer?

May i have to apply again 186 visa? Please advice

Unfortunately you are in a very difficult situation and if your company doesn’t support you then AAT will refuse your nomination. New company cannot fight for you as your nomination is for the current company you are working for. I’d suggest you to talk to a migration agent ASAP or you will run out time. You will definitely have to apply for a new visa. Hope this helps and good luck

Hi Guys,

The good news is that I won the AAT nomination case on Friday BUT bad new is it seems  probably after AAT remit my application to Immigration again Immigration going to play by postponing the process . Anyway a Big step done.

Congrats!

You mind sharing details as to location, position, refusal reasons and interview (questions, requested supporting docs), etc?

Thank you

Would you mind to share in which state your nomination was,  and your occupation ?

Thanks

I do not think the state matter with the cases of AAT, as its a federal thing.

still, I am happy to share, I am in Qld and my occupation is computer Network and System Engineer.

I have applied for 187 visas on August 04 and my employer apply for nomination and RCB in the same time but on December 18 my nomination got refused without asking any further documents and I got 21 days for nomination review and 28 days to comment for my visa. My employer is going to apply for AAT for the nomination before the end of 21 days. Moreover, I am going to wait till my visa get refuse and will apply to AAT for my visa as well. I just want to know if we apply to AAT for both of our nomination and visa will this keep my bridging visa active until I get the decision from AAT for the nomination. Please advise me if anyone goes through this process and let me know what will be a waiting period before I get the first hearing.

I am approaching you coz we have some major concerns regarding our pr. We applied for 187 in 2017 dec and got denied in June 2019 first nomination and than visa we applied for tribunal in august 2019 for both nomination and visa and have been waiting for hearing date since than.. when applied for residency my daughter was only 15 months after we applied for tribunal we started noticing signs of autism in her she is not yet officially diagnosed. But my concern is when we get date for hearing will it be a problem for us to get our pr. I haven't got her diagnosed yet but now her school is telling me that it's okay if she not diagnosed in kindy but in grade 1 she will need to get diagnosed.

My agent is corporate agent hired by husbands company so hardly replies to my query. My husbands company is really big company and has got pretty good turn over and has got almost 120 stores across the country.

His post is retail manager and we are located in Tasmania. And my husband is still working with company over 10 years now and is been on this position for 6 years.

What are our chances..

U don't have any problems as first two files are for company only ie RCB n nomination.

After Nomination done by AAT your case will be forwarded to Immigration. Than oy ur file start processing.

Should be right mate.

But I have heard that  parents with autistic kids are denied residency.

Hi Vama sorry to hearing that. Yes you will have a problem at Immigration. So once your file is at on AAT you should be fine but then if you win your case go back to Immi then they going to ask about all family healthy and they going to pick your daughter. I’m telling you that because I have a friend who is in the same situation. She won  AAT then she did medical certificates then was failed. they were saying that her daughter didn’t passed. So now she needs to go to GP + another specialist because they going to make a decision of the daughter autism is hight or lower then forward to Immi. If Immi refuses she needs to appeal again.

so right now your case won’t affect anything once back to Immi.

I’m sorry

That's correct, some links on this topic:

Normally intervention by the Immigration Minister and/or the public (e.g. petitions) can be of huge help.

Good luck!

So if she has a moderate symptoms may she’ll pass. I know you must be so worried but go step by step. It’s too much going on right now. You are already at AAT so just wait your husbands  been called... it’s pretty much nothing you can do now. actually you can enrol her at school that helped her to improved skills, like drawing, jumping and all the autism things... then she may pass on the test by the doctor. Have a good look at exercises for her.

@milamocha i know abt this cases have been reading a lot but they say one in 100 case gets minister intervention.  We have been struggling for almost 14 years for pr n now this ...seems endless..

I understand.
Our timeline is very similar. We also applied in Dec 2017 and the nomination got refused June 2019. We lodged the appeal in July 2019 and have been waiting since.
The current processing time are sitting at 30 months for 187 DE, so if they are going to leave us waiting till the end we're looking at January 2022 (one more year) for the file to be just opened (and who knows how long for it to be finalised).

You can't do much until they request medical tests again so perhaps spend that time working with your child. She hasn't been officially diagnosed so it might not be as bad as you think.
Best of luck in any case.
