Mortonc01
Hi my Dad moved to Australia in the late 60's as a 4yr old and was brought back to the UK in the early 70's. Said in total he was there for about 4 and half years. We're wondering if he could apply for dual citizenship and myself through ancestry laws could apply for dual citizenship? Any help or advice would be appreciated. Cheers
Marisawright
I'd say it's unlikely as he would have been given Permanent Residence, not Citizenship. Rules have changed over the years though.
ali
I would agree with Marisa in that he probably may not have citizenship. I had a colleague who came as a child - she had to apply for citizenship having lived here about 50 years in order to get a passport. Skani
For your dad: until 30 November 1973 British citizens could apply for Australian citizenship after living in Australia for 1 year. They did not have to attend a citizenship ceremony. If his parents did that - and included him on the application - then he would still be an Australian citizen. If they didn't then he has to become eligible the same as anyone else - he would need to be granted Permanent Resident status and have lived in Australia for at least 4 years preceding the application for citizenship. For yourself, a child born after 25 January 1949 can become an Australian citizen by descent only if he/she had a parent who was an Australian citizen at the time of the child's birth. A child in this situation born overseas does not obtain automatic citizenship: he/she has to make formal application.
Quoll
Your grandparents probably didn't apply for citizenship as it wasn't really as an important thing back then so I should think it highly unlikely he would have any sort of claim on Australia. He was only there for a short time anyway and its not as if he was born there.
