Defacto Relationship

Hi Everyone,

How to show evidence for Defacto relationship  for PR visa? If  we cant do anything , is marriage a good idea ? any Pros & cons .

My partner  has bipolar , I am worried  about  finances as it  will vanish on a manic spell . He  is now well controlled  with  medication . 2 years back when he had mania , he  completely went  into bankruptcy . After 20 years of  marriage , we divorced  as  he started  the process  without insight  , 1 year  he had  to have treatment and stabilised , we  got back  together  but  living  seperate only at nights.  . If I marry then even my finances will vanish . If i can manage showing  evidence of defacto  for visa purposes and get advice from  solicitor to keep finances seperate will be better .  When they are manic they become totally insightless and  spend money lavishly even when they know they  are bankrupt and homeless. 

He has rented place of  his own but stays with us for most  of the day . He has some bills which come to our address. we dont  have joint bank account  but I can create one now  and anyway  going to apply  for PR after 1 year. We  have 2 girls  who are his kids too. I know its difficult  question to answer. Just writing on this forum  helps me . Thanks Much appreciated.

You need an agent. A good one.

 

You and your 'partner' are divorced, you live apart, you have separate finances. In your previous thread you talked of emigrating without him, then sponsoring him later. None of that indicates a current de facto relationship.  Even a married couple would struggle to prove they were genuine. I'm not saying its impossible, but its certainly not going to be straightforward and please don't try and present the application without professional help.

Thanks for your reply. I have contacted 3 agents and waiting to get  consultation  with them. I am confused now. I am applying  for PR now  for Me & 2 girls and will move . Once we get PR , I want to sponsor him . If I cant  get evidence of defacto relationship, then I am thinking of remarrying  and applying  for PR . I am confused  big time thats why I keep posting to get reassurance I think. I will have a full consultation  with Visa agent about the situation  and also solicitor about  legally declaring our relationship at the same time  seperating  finances due to medical reasons if possible. Really appreciate your help ! .Thanks for your advice in this regard.

To sponsor him you will have to prove a strong relationship - even if you now remarry, they will still want to see prove of that.  At present you live in the same country but live apart, have separate finances, etc. If you get PR and move then you aren't just in different homes but in different countries,And you have to show how you are maintaining a close relationship with him while in different countries. You have to show that you are a couple, that your finances are linked, that you make all major decisions together.

When you did your PR application did you declare yourself as single, or as in a relationship with him?

I can't really give you reassurance because I don't now if you will manage to sponsor him on a spouse visa. All I can say is it will take a very good agent and a lot of hard work to even attempt the application. And thats before you deal with the fact that he will have to pass a medical.

Thanks a lot for your response. I am about to apply  for 457 work sponsorship visa just for me & my 12 year old. As soon as its granted , I am going to apply  for PR for Me & my 2 daughters ( 12 & 21 years old kids from our marriage ) and going to put my partners details on the PR application form.

Once I move to Australia , will hire a good agent to sponsor him. Proof of our relationship - I am thinking of  the grocery bills he paid weekly for all of us, joint  holidays that we have gone together, photoes taken together , FB photos . He is psychiatrist working  full time now on treatment  well controlled. I am guessing  he might  have to find a job & come to Aus  by  work visa and then we  prove of our relationship as we will be closer . Or  as  kids have PR , sponsoring  a parent ?? Too long  winded . I guess i will have to take one step and worst comes worst then back to UK . 

I have now contacted 3-4 Visa agents  who might  help me with  some advice .

There is a bag load of issues.

First, taking your older daughter may not be possible. If she isn't in full time education, she is unlikely to be classed as dependent.

Then, if you were to add your ex husband, even if they accept him from the relationship aspect, he may struggle with the medical as the medical isn't just based on current health, but includes possible future and the cost of medications. This is important for you all as with health requirements, the principle is "One fails all fail". So, if he were to fail, none of you would get visas. So, you need to speak to a specialist migration agent on that one.

My daughter will be in full time education for  3 more years so that is ok. As my  partner is stable with  medication and Psychiatrist appointments , I will have to get an opinion on this. Not  used to handling  uncertainities like this . Steep  learning curve for me !! Thanks

I agree that you should speak with a migration agent regarding how to either include your de facto in your 457 application or future sponsorship.  You don't need to have joint accounts for financial evidence.  Showing how you both contribute financially to the relationship can be sufficient, e.g. which bills do you pay and which ones does he pay, etc.  Your situation is complicated, but that doesn't mean it's not possible.

Hi I'm bipolar I passed the medical all I had to have extra was a detailed report from my psychiatrist that I wasn't suicidal & not a risk to myself & others around me. Also our 21 yr old was classed as a dependant we are all on my husbands visa. Even our 16 month old granddaughter. All we had to provide was proof that we kept them both which we did with shopping bills & proof of paying all the bills for them both. They only thing is we all live together. That you need to show proof of which we could. It's a bit different for us as my husbands the main applicant. He also was offered a job in the ADF our visa's were approved after 3 months. I don't know if this helps at all.
