Thats awful. Was it a small company or something? I don't understand how they can refuse that he wasn't necessary if he had been there for 7 years! Sounds like they need him to me but I guess Im not the expert and I don't know the ins-and-outs. Seems very harsh but hard to comment from afar.

Regardless, Im really sorry you have to go through this.

In first request : current training benchmark,  2017 lose profit,  current bas statement 

For visa : form 80 , expired police clearance, 

In second request : She called to my MA and said my nomination approved,  but she need at least 10 year information in in form 80 by mistaken I put 9 year.  That's why we resubmitted form 80.

Sorry to hear elote, but if you don't mind can you explain what went wrong on training criteria?

The reality is, though, that if someone comes to Australia on a temporary visa, they know it's a temporary visa when they sign up.  If they rashly made decisions on the basis they're here for life, that was their choice.  If the employer gave them the impression they were secure and guaranteed to be able to stay, the employer should be shot because that's very far from the case. More than half of all 457 holders end up going home.  Length of service or being a "genuine employee" are not part of the criteria.

When you're on a 457, you're on a temp contract with a possibility of maybe being able to migrate in the future.    I wish everyone the best of luck in making the transition, but it's a lottery and the government has been making it ever more difficult.  I wish people would think it through more, before they even apply for a 457, but I guess the unfortunate thing is that it's human nature to think "I'll be the lucky one who'll get to stay".

You can check your visa status through below link to confirm the visa. When my status was changed to finalised, it was night and my MA wasn't available at that time. I confirmed it through the below link to confirmed it was approved.

Being in a job for 7 years doesn't make you indispensible. I had a job for 7 years and the company was able to replace me, it happens all the time. 

Of course,  the company would rather keep the employee they've got, than go to the trouble of training a replacement, but that's not the government's problem.  They designed visas like the 457 as a way to temporarily fill a gap until there are Australians who can do the job.  They may be wrong in their assessment, but that's the intent of their decision.

I would counter that and say if you have been in a role 7 years there is a clear need for the role as long as its tied to genuine, profitable, business objectives, and its on the occupation list.

I agree that it should be looked at through a temporary lens but i would say that there is an inconsistent application of policy if thats the case. Are you saying that there are not enough Australian cooks? Or customer service managers? Pick an occupation and you will see some inconsistency.

Take them off the list and then its transparent and fair. I dont blame the hard working people in the offices processing, im merely commenting on a lacklustre immigration policy without clearly defined objectives tied to Australia's needs.

I completely get your point. But to give the flip side, when you spend that amount of time in a country, you do create a life here. A visa application is someone's future being decided and so has huge standing. I think everyone knows when applying that there is always a chance they won't be granted a visa. Otherwise, there would be no need for forums like this as everyone would be confident in their position. Fact is, if you believe you hit certain criteria and then you are refused on the basis of your position not being genuine, after being there for 7 years I'm assuming that's not something you thought would come up. So I stand by the fact that I feel awful for people in this situation and hope others don't have to go through the same. Thinking "I'll be the lucky one who'll get to stay" is called hope, and we all need a bit of hope.
