Question about temporary 820 partner visa becoming permanent

Hello all,

 

Haven't been here in some time, been enjoying my life here in Adelaide for the past 2 and a half years with hubby and our two cats :) I've found conflicting information online and know this is the best place to come so I would like to ask about when to expect my visa to become permanent? I came over on a prospective marriage visa in 2012, we got married in August 2013 and sent off the papers that month which were approved with a temporary 820 by mid-September 2013. I know that after two years of marriage this is supposed to become permanent but is there something I should be doing right now or just wait for them, do we have to fill more forms in and is there a wait time? or should I just automatically receive the notification of a permanent residency after our two year anniversary?

The two years for eligibility for a permanent Partner visa starts when the temporary/provisional Partner visa is applied for which in your case would be some time in August 2013. You would usually be contacted by DIBP about 2 months before the two years is up so you should be contacted soon - probably some time next month. See the following:

The grant of a permanent visa is not automatic and you will need to provide evidence that you are still in a genuine relationship.

Just to add to that -OP, although it always seems to have been two months prior to the anniversary, a coupe of us wating for PR have received our requests this month and thats only ONE month prior to the anniversary, so don't panic if you don't get it at two months prior. If you check the Immigration website it has a list of the stuff you'll need to provide for PR - police checks etc.

They didn't send us any forms, just copies of the two documents on that page

We;re using more of the same sort of evidence we used the first time - joint accounts, joint bills, letters/cards/excerpts from viber/etc when apart (which is a lot as he does FIFO). Statements from both of us - there's a proforma for that, and 2 *** Stat Decs from Aus citizens or PR.

Thanks guys :) I will get straight onto it as soon as it hits 2 months. Hopefully it won't take months to approve.

 

Couple of notes from my exerience with the Immi account.

Firstly you need the application ID from the letter/email inviting you to provide info for PR. Although it says you can use the Temp Spouse ID that won't work.

Secondly it asks you whether it has been 24 months since your application was lodged. If you tick no (cos for us its only 23 at present) then you can't proceed and can't lodge the application online. You have to wait until the 2 year mark before you can submit. I guess if you do it on paper you can submit before the 2 years is completely up, but we are geared up for online so I'll sit it out another couple of weeks1

Well I've been allowed to apply for the permanent stage as of mid this month (2 months shy of 2 years ago) and had no problem getting the police certificate, ordered and paid for onlne and it was sent out in the post the very next day! Now I've got all my papers ready and JP witnessed ready to be posted off - and this is a very little silly question but will it cause any problems if I sent it all off through registered post? It's going to a PO box so I don't know whether that means there will be nobody there to sign for it so that will just delay it... probably a silly question but after the hard work put into all these forms I want to make sure they arrive there safely!

 

I will keep you all updated with any news of a (hopefully) grant once I hear anything. Not too much longer now....

Perhaps i am missing something but why are you posting stuff? I put our application in a few days early by ticking the 'has it been 24 months' box then just uploaded everything online. it took a while but i was happier doing that than applying on paper and trusting the mail.

I was having trouble logging in - but I've now been able to access the online application and am currently scanning (slowly) all the documents in :)

The system has been down a lot over the last couple of weeks. Good luck with the scanning, tedious isn't it!

No, it won't cause a problem. But it will be a needless expense. Registered post is not handled in any terribly special way and it is no more or less likely to go missing. However, it will give you compensation if it goes missing - to the value of what you sent. In this case, the documents you send may have been difficult and time consuming to collate, but they do not have any monetary value so you would not get much compensation.

I'll say! Well I stayed up late last night scanning and submitting everything, thinking that was the last of it...

 

Only to find an automatically generated email this morning telling me that "We require additional information or documents that cover your circumstances since you were granted the temporary partner visa." not citing anything specific and only providing general information I already know and the checklist I have already found and submitted everything in accordance to...

 

Has anyone else had this happen? I guess all I can do now is call them up and wait in a long queue to know what's going on. Grizzle.

Didn't you say you were applying 2 months before the 2 years are up? That email is the one you get (as we did) automatically 2 months before when the two years are up, askng you for the documents etc. Its a standard one generated by the system when it hits that date.

As you have uploaded everything you have just got ahead of the system, thats all. The stuff you have uploaded won't have been looked at yet because they haven't even asked you for it - if you see what I mean.

 

All you have to do now is sit and wait!

I was getting so grizzly, what made me wonder that is that it wasn't sent just after I submitted my application, but about 12 hours later. I think they need to change the wording of the email then for those people like myself trying to get ahead of the game :) Thanks again my evening is now happier.

Glad it cheered you up! I just suddenly realised it was the same wording as our email. I think it gets generated automatically regardless of whether you have already started the application. I think I was about halfway through doing ours when I arrived.

 

Here's hoping none of us have too long a wait for more news!

Any news yet, or from anyone here applying at a similar time? Success stories are in high demand!

 

I'd really like to start studying (PR= still upfront payment and no hex loan but not the hiked up international student fees.) I am hanging on my emails every day - the official site now says 12-15 months is standard which is depressing since this is the third visa I've had the pleasure of applying for ;) (PMV, then temporary and now PR.) We all deserve medals in patience and such big parties. Any one else encountered the "you're just English so it must be easy" type of conversation? #noteasyforapom

No news at all except for someone with agency connections who says that we can expect at least a 12-15 months timeline due to the increase in the offshore fees. Seems that due to the increase more people are coming on tourist visas and then applying for Spouse onshore - as a result the PR requests like ours are being pushed to the back of the queue.

That's not fair. We've been together for 7 years this June so I'd say I'm incredibly 'low risk' for some sort of immigration conspiracy. I also have to put my career on hold as I can't study until I get it. I hope since we submitted before much of this happened, that they're overestimating the expected time just to be safe.

I'm so cross about it. Just cos the fees went up and so everyoneis coming here to apply, we are missing out. My husband travels a lot without me, some for work, some to pursue a couple of hobbies, and we have to keep remembering to keep all the paperwork justifying why we are apart.
