Banksy
We moved to Melbourne last January, before leaving we forgot to stop our child benefit. It was still paid into our Halifax account in the UK. In May we wrote to them and told them we emigrated in January and had still been receiving the benefit. They wrote back to us to say it was now cancelled and that we didn't have to pay back the overpayment. Today we've had a letter from them saying they never received a reply from us and that they want the £468 back in full otherwise they will start legal proceedings! I'm in work now but I'm pretty sure we would have thrown out the original letter from them. As it's the HM Revenue involved what should I do? Surely they would have the original letter on file somewhere?
Cal2
I would think so, but presumably you haven't spent the money so you can pay it back - I don't know of anyone who hasn't been told to pay back on over pay - maybe someone else would know. akiralx
Ask them to resend the letter, to which they say you didn't reply (why would you need to as they weren't asking anything?). The chances of their successfully recovering a sum under 500UKP from an Australian resident would be slim. Offer to repay by installments if you feel the need to. Sammy1
Just pay it back, that will solve the issue of you being paid when you should not have been. Easy enough to transfer it to them from the your bank account in the UK.
Parley
Ask for a payment plan. Tell them you can't afford to pay it back in one go and see if you can pay 10 pound a fortnight.
AJ
If they didnt know it was in their bank account they couldnt have spent it, so just pay it back, no problems
