What happens if you lose your job on a 457?

So what is the employer liable for if they let you go on a 457?

 

Do they just buy you a ticket to England and that is it?

Or do they have to ship our things back as well?

What about the dog?

 

We are just wondering what will happen if the worst happens?

 

Is there a government website to look at, that would put our minds at rest?

The in's and out's can vary company to company and its normally discussed when you are offered a job / shown your contract. The norm seems to be they pay for flights and shipping but always check and get it in writing before singing anything.

The answer is half of bugger all. They are liable to pay for your ticket home, and that of your dependents. Your dog walks home. That's the legal minimum. Anything else is the goodwill of your employer...

DIAC says under Sponsor Obligations http://www.immi.gov.au/Visas/Pages/457.aspx:

 

[h=4]Pay travel costs to enable sponsored people to leave Australia[/h]You must pay reasonable and necessary travel costs to enable the sponsored person and their sponsored family members to leave Australia. They must ask you in writing for you to pay the costs. We can also make a written request on their behalf.

 

The costs will be considered reasonable and necessary if they include all of the following:

 

 

  • travel from the sponsored persons usual place of residence in Australia to their place of departure from Australia
  • travel from Australia to the country (for which the sponsored visa holder holds a passport) and intends to travel to
  • economy class air travel or, where that is not available, a reasonable equivalent

 

Unfortunately there's nothing in the above about them having to pay for shipping your possessions or your pets...

The flight home rule is there for the benefit of immigration, when the visa ends the employee has no excuse for not leaving and the cost falls on the employer rather than a cost to tax payer.

 

Immigration are not interested in furniture or dogs, they are only intrested in removing people who have no longer a right to be in the country.
