  1. Hi everyone. Firstly, thanks for all the input and advice, I feel like an expert on the partner visa process now! The great news is that i have secured a new job, just before the 28 day countdown was about to kick in! The paperwork has been submitted for the visa transfer and hopefully this will be approved relatively quickly. I'll hopefully be De Facto very soon which will ensure i need not worry about going through this process again!

  3. Thanks for your reply, quite reassuring. I'm certain i'll find another job - my nervousness is finding it within 28 days of my visa expiring. If i have extra time then i'm confident i will be OK. I'm at the latter stages in interviews for a couple of roles right now so would definitely be able to provide evidence that other opportunities are in the pipeline.
  4. Hi PIO'ers Just a quick update on my situation. 4 weeks left in my job, still haven't been able to secure a new job. Race against the clock! Plan to meet a migration lawyer this week to finalise my 801/820 Partner Visa Application and understand any potential bridging visas i can secure that will allow me to work. For some reason i feel pretty relaxed - i'm confident i'll find a way somehow and will be able to stay and attend my own wedding..! Any tips or advice is kindly welcomed.
  5. Hi all, thought I'd rebump this thread. Hope you don't mind. My current position is that I have been made redundant but I am still working my notice period. I am still looking (without success) for a new role to transfer my 457 visa to. I've also got all the paperwork to apply for the 801/820 De Facto Visa which is unlikely to be approved until next year. I'm keen to understand more on bridging visas which will allow me to work on the rights of a 457 visa whilst awaiting my partner visa approval. Can anyone assist?
  6. Hello Pomsinozzers I'm in the process of looking for a new role after my current position was made redundant. If successful, and I am able to find an employer who is willing to take on my 457, then what is the normal waiting time for this to be approved? Thanks
  7. Hi guys, I've got a question regarding a question on this application form: Question 55 - What is your current relationship with your sponsor? Married, de facto or engaged. Now, I am applying for a de facto partner visa and (having lived together for 18 months) should I state we are de facto from when we lived together? We are also engaged - does this 'trump' de facto? Do I tick both de facto and engaged? Cheers all for any help you can provide.
  8. Hi guys, i'm looking to see if anyone can assist with a query i have. My Australian partner and i have bought a property and have lived in it for the last year. Well, technically she has bought it as she is a citizen and i am on a temporary 457 visa - it makes it a lot less complicated. Our view is that once i am permanent then we will find a way to legally add my name to the property. I am contributing 50/50 to everything in the property and to all intents it is a joint mortgage in terms of contribution. (We're getting married later in the year so we are very much committed for the long haul) My partner is concerned that as the property is technically not in my name, legally she may need to declare my mortgage payments as a taxable income. Can anyone confirm if this is the case? I've been unable to find anything from the ATO that can help - any assistance from anyone in a similar situation would be great.
  9. I can't take the risk of a 'no further stay' - will see how the job hunt develops and will probably pick up with a migration lawyer if it starts to look tricky for me.
  10. Bumping this old thread with an update. I was made redundant last month and thankfully have been given a decent notice period which should allow me to hopefully get a role within the 28 day period upon completing my current employment and thus transfer my 457 visa across. De Facto application forms are being filled in too to ensure I am making progress on this front too. if the worst case happens and I don't get new role soon, am I able to leave the country and re-enter again as a tourist? I remember being told by a customs official that I need to leave the country for a period of time inbetween visas - true or nonsense? Alternatively, any further information on bridging visas would be great. I wouldn't want to miss my wedding!
  11. Agree with the previous posters. The current exchange rate is helping me to blitz my mortgage in the UK having been able to clear credit cards, debt etc in the last year or two. If the Aussie bubble bursts (or the UK economy sorts itself out) then that would be a good time to being the cash over to Oz. although it looks like that could be many years away yet.
  12. Thanks for the update Rupert. Without being knowledgeable about the process, could it not be argued that the 457 'expires' when i leave a role and do not find a new role within 28 days? Checking the IMMI site, the language they use is that the Visa 'ceases' unless i am in employment. It will be interesting to understand the process after this stage.
  13. Thanks George. I reckon a call to a migration agent would be the best bet. I'm naturally a little bit concerned, especially sharing a joint mortgage over here. The prospect of waiting up to a year to work (whilst saving for a wedding) is a not a good one. Hopefully the migration agent can provide some good advice. And hopefully i am able to keep my job!
  14. Thanks for the advice George. I have no knowledge of the processing times - my 3-6 month belief was based on advice from friends who recieved their partner visa in early 2012. I appreciate that things change very quickly so this sort of processing time may be rare nowadays. 10-12 months though, seriously? Is there a thread covering the processing times? Would the fact i am in the country and working on a 457 not potentially assist? Although we are agreed that a prospective marriage visa is not the best approach, am i right in saying that this is granted very quickly in comparison to a partner visa? A timely approval to allow me to work looks like it could be my priority, regardless of additional paperwork required.
  15. Thanks again for the advice Rupert. The reason i've never applied for the spouse visa before now was because my employer has agreed contractually to pay for PR once i am eligible next year. This is obviously on the assumption that i am still in employment, which is not a guarantee. Redundancy does look likely, so even if i get the partner visa application lodged when working legitimately on a 457 Visa, you believe i would not qualify for a BVA should the 457 be revoked whilst waiting for Partner Visa approval? This could make it very difficult. I reckon i will start making progress on the partner visa now.
  16. Thanks guys for your help! With a mortgage and a wedding coming up i'm a bit concerned that i would need to leave the country. It sounds like the partner visa and a bridging visa (if need be) are the way to go. No idea about this one. I meet the highly skilled requirement and the partner requirement which are both important. It looks very cheap too ($360 v $3975 for partner visa). Will look into this further. Thanks for this. Is this subclass 820/801 visa ($3,975) that you are referring to? Processing times for this are in the region of 3-6 months - would i be able to work in the meantime?
  17. I've currently got a 457 highly skilled visa, sponsored by my company. The role i'm in is likely to be made redundant very soon which could provide a bit of a challenge unless i find another role to transfer my visa to very quickly. As i've lived with my Australian partner for 18 months (and we're getting married in 10 months) can anyone recommend the best visa i can apply for which ensures i'm not exposed to the risk that potential redundancy can bring about? I'll be applying from within Australia. The prospective marriage visa is only valid from 9 months prior to the wedding - this could be something to consider next month once i am eligible. The IMMI page also has the 'Spouse with transitional Extended Eligibility Temporary Visa (EETV)' - could this be an easier option seeing as i already have a visa? Any advice would be appreciated, thanks all.
