Jobo Posted January 6, 2011 Share Posted January 6, 2011 I am currently Cat 4, having applied for my 176 family sponsored visa in May 2009. Once it became clear Cat 4s were going no-where we opted for the SS approach and have applied to NT for SS. once we get the SS (my occupation is on the SMP) then we can inform DIAC and change to SS 176. So my question is - what happens to us then? I thought that we would move to Cat 2 and then be processed in date order along with the other Cat 2s. however the DIAC just refers to all the other Cat 2s (apart from WA/SA) being allocated a CO. Surely i can't be the only oldie with a Cat 4 application who has applied for SS hoping to move to Cat 2? so they are going to have to update the message along those lines (i hope) at some point. i doubt anyone knows the answer as SMPs are still in their infancy but i just thought it was worth asking...and posing VickyMel with another challenge:smile: cheers Jo Link to comment Share on other sites More sharing options...

I think this is one of the reasons the government stopped people who lodged after July 2010 from doing so as it had caused a problem with numbers for them in the past. What happened previously was when people switched if the original application date was already being handled by COs they quickly moved along to getting a CO after they switched their visa. I would assume that once you get your NT SS, assuming that you can switch your visa, then you would soon be allocated a CO (but don't quote me!! :wink: ). What you might check out is the SMP FAQs - I am not sure what happens re switching family state visas to state sponsored? http://www.immi.gov.au/skilled/general-skilled-migration/pdf/statmig-faq.pdf http://www.immi.gov.au/skilled/general-skilled-migration/pdf/statmig-fs.pdf Q10 Can I obtain priority processing under a State Migration Plan if I have already applied for an Independent Skilled visa or I have been sponsored by a family member?Applications for permanent visas lodged before 1 July 2010 Applicants who applied for either a Skilled (Residence) or Skilled (Migrant) visa (subclasses 175, 176, 885 and 886) before 1 July 2010 are able to seek a nomination under a Plan and have their application assessed on the basis of having a state or territory nomination. Applications for permanent visas lodged on or after 1 July 2010 ... The Migration Regulations have never permitted applicants who applied for a Skilled Sponsored (Regional) visa (subclasses 475 or 487) on the basis of family sponsorship to change their application to a state or territory nominated application and this has not changed. I really can't say whether the family visa, prior to July 2010, can be switched - hopefully someone else can come and confirm or maybe you already know? Even worst case senario you need to apply for a new 176 - given each state has yearly quotas, NT is not that popular and I wonder if it fills its quota? I would hope that you might still see a CO very soon. Don't remember where but it was mentioned somewhere by DIAC that every year in January a new SOL will be released. Please correct me if I am wrong. However, Skills Australia had a review of existing SOL in November/December 2010 (Skills Australia). The fact sheet released with the SOL 2010 (http://www.skillsaustralia.gov.au/PDFs_RTFs/SOL/SASOLfactsheet.pdf) says Skills Australia will provide DIAC the new list by February 2011.
