Guest luckylucky Posted December 2, 2010 Share Posted December 2, 2010 I want to ask some immigration issue regarding cap"n"cease that what is going on , how much applicants got ther money back how much remain to get , and also how much are to wait to file case or want to contact with new Immigration minister chris bowen for the consideration the case etc . By the way I want to case register as an appeal through good lawyer if I have right to appeal , do you think that we have rights to appeal against the dicission or have no rights , Remember I had applied for " General Electrician " BN-136 Independent class . So bit confusion , that's why I need some advise from here at this forum but still nothing found . Please if you have any knowledge about the law that can I any body launch the file against cap"n"cease or not , there is no right for me/us . Waiting for reply. Always regards, Lucky. Hi Westly Russell , Thanks for the reply but I am sorry for delay responce because of I was out of city due to some office work , Actually you are right that CL is well regarded in australia but thing is that I am not sure about what I have rights given in this visa category , May I Appeal or not if yes then what are the clauses by which I can fight , That's why I am bit confused , If you know some cluases then please advise me how to go . CL indicated some time ago his opinion that cap and cease could be successfully challenged. I referred one case of mine to him and I referred others who were not my clients. I do not know the current status of the issue. I have received a communication from the DIAC rejecting my claim that s65 should prevail and reiterating the purported legality of the cap and cease decision. Look at me, they say Minister can not can and cease 496... But what they can not cap and cease? We are already suffering like you guys. I am waiting since last 40 months and the end result is still waiting. Now I am on Priority 4 which is dead and buried.
