jrstaf
Hi all, We're applying for a 309 and of course need two witnessed declarations. We've asked my brother to write one of these. Having read through the list of people who can witness his statement, teacher appears. His wife is a a teacher. Can she witness the statement, or perhaps because she is a family member should it be someone else? Thank you! John
ali
I've always assumed a witness shouldn't be a family member/relative
wrussell
Leglly yes, but some authorities do not accept this.
Ausvisitor
Ultimately if the witness is lying they have committed an offence (perjury at least) whether they are related to you or not. Some companies and bodies don't allow this though as you'd be more likely to lie/conserve the truth if it benefitted a loved-one so it's more likely to have issues with it than something witnessed ny a true independent person

jrstaf
Thanks everyone! Taking general consensus as better to avoid it if possible. Cheers!
