We went through the significant investor stream and withdrew our investments when we applied for PR.

We went through an agency for our 188 visa but applied ourselves for 888.

Did you go through the business innovation stream?

That is correct. It's a timing issue which has caught a few out including some fund managers who obviously aren't across the requirements.

I've been reading this forum as in the process of applying for our 188C and want to be sure of the next step before we commit further and would like some insight from those of you who have either applied for 888 or about to.

Were you asked for police certificates and health checks early in the application and if they expired due to a long time in visa processing did you need to do it again?

I read that somebody withdrew their investments as soon as they applied. Is it ok to do this or do we need to maintain them until PR is granted?

Does it make any difference to processing times whether the application for 888 is done onshore or offshore?

Does anyone know why it takes such a long time to process given it just requires proof that the investments were compliant and still in place?

Hi Scaredycat

You say you are in the process of applying for your 188c, but you questions suggest you you might actually have the 188c an are applying for the 888. Can you clarify?

The 188c is one of the few visa streams which has been identified for priority processing so processing times are typically shorter than for the 888. 

Speed of processing depends on several factors but from my experience with the 188c's I have assisted with, country or origin and due dilligence re "source of funds"  and character tend to be the major factors influencing processing times. 

Under the current framework, the 188c is a a five year visa where you can apply for the 888 after you have held the 188 for a minimum of three years. I personally advise all 188 clients not to redeeem their investment on the three year anniversary. It is also important you are aware that some of your investments may not be available to liquidate at short notice due to a lack of liquidity.

Whether you are onshore of offshore for the 888 should not be a material factor. 

Processing times for the 888 are slow, however, I guess the department takes the view that you are free to live and work in Australia and are on a pathway to PR, so it's not a high priority for them.

Hi Steve,

I’ve applied for the 188c a few months ago and still waiting to be able to invest but I have a son who will be going to university soon and hopes to do his masters in Australia but it would be unaffordable if we’re not likely to have PR in about 4 years time, so I’d probably live most of the time here in Ireland until he graduates and hope we’ve got PR before then. The other question I have is that he’d like to travel around Australia during his gap year and pick up odd jobs but WA is the state that nominated us and they specify that anyone who’s lives in Australia can’t live, work or study in another state as they won’t then be nominated for 888. How do they check this and would travelling in their gap year be a breach as they wouldn’t be permanently living in another state. Does the nomination form for 888 ask whether they’ve ever worked in another state? It’s all giving us doubts to be honest.

You've got a complex situation there.   If you do not already have a migration agent, then I strongly recommend you hire one.  This is too important to get wrong.

Yes it’s something we need to think about. At this stage though all I want is a bit of insight from someone who’s applied for their 888 through WA and can let me know what questions are asked requiring dependants and then we can decide how to proceed from there

This is a small forum and most of the people who post are looking at, or already hold, skilled visas.   Has it occurred to you that agents have experience of many clients, and they will know how their clients got on, so you're actually more likely to get insights from a specialist like Steve (who posted above) than from forums?   

With migration agents, it's not a case of the earlier you consult them, the more it's going to cost, so there's no benefit in delay.

HI Scaredycat.

We are starting to get into the area of very specific advice which I can only provide to clients so I will have to keep my comments very general. It is my job to keep up to speed with both the Federal regulations which covers eligibility, conditions etc, but also each state and territory's requirements when it comes to nomination. 

It is not clear from your post whether you have actually lodged your visa application or are at an earlier stage eg EOI, nomination however, lets assumed you have already lodged and you receive the typical 70 days to make your investment, you are, given current processing times, unlikely to obtain PR within the 4 year timeframe you have mentioned. 

Secondly, in terms of nomination policy for your 888, your Registered Migration agent should be able to answer this one. It's not an uncommon scenario. 

The 188c is a visa stream, where it is highly advisable to obtain advice from a registered migration agent who is an expert in this space. A successful application is one thing, but ensuring ongoing compliance is arguably even more critical to your ultimate success. I am aware of several instances where the applicant had assumed everything was fine until they applied for PR only to discover a non compliance event had occurred three years prior, meaning they were ineligible to apply for the 888. 

If you have submitted your application without professional advice, that's fine but you must diligently monitor your investments and ensure compliance for the duration (up to 5 years) of the 188c. No one will flag matters requiring your attention. It will be up to you to monitor and ensure your investments remain compliant.

That's good to hear.

You should do this ASAP as the minister has flagged an intention to either discontinue or significantly overhaul the 188c. An imminent review has been flagged.

Hello Everyone

 

just wanted to get sone insight on 888A visa. Does home affairs dept. give any kind of priority to applicants from regional area?? and also in regards to immi account, the status says received since last 19 months, does that mean file hasn’t even opened yet or how does that work? 
 

i looked up some data and looks like immigration tends to process quite a few 888 visas in November ever year, do you believe this to be a possibility?

There is no priority given to applicants from regional areas. I would not put any weight on past patterns of grants as we are are in a post Covid recovery phase with a new government in place. The priority is very much other visa categories. It would not be unreasonable to assume the government takes the view that given you are already in the country, there are many other skilled applicants awaiting grants which are a higher priority in terms of addressing Australia's broader needs, which rank as a higher priority. That might not be what holders of provisional business visa holders want to hear, but that's my take on it.

Latest update for 888 (Significant Investor):

  • 25% of applications: 26 Months
  • 50% of applications: 27 Months
  • 75% of applications: 30 Months
  • 90% of applications: 34 Months

34 months is almost 3 years on a bridging visa. When we applied it was supposed to be 1 year.
