Kier2000 Posted May 6, 2014 Share Posted May 6, 2014 Hi all, Hoping I might be able to get some direction / advice :-) Unfortunately in my late teens I managed to get into a fair bit of trouble with the police and ended up being sentenced to 15 months in a youth detention centre. Well, I managed to turn things around, went to Uni and now work with young offenders. So now 17 years later I'm wondering if there is any chance of ever getting a visa to live and work in Oz....? my job is on the consolidated sponsored list. I have read into the character test and I understand that a 'substantial criminal record' is defined by 12 months or more in custody but I've also read about the ministerial discretion which can be applied on appeal. Has anyone succeeded in this process and do you have any advice....? Does anyone know of any lawyers with this expertise..? thanks for your help... Rupert Posted May 6, 2014 Share Posted May 6, 2014 You will fail the character test, so it is all about getting a waiver for you. From what you have said, I would hazard a guess that you could make a good case with the right help, so wouldn't assume this is a show stopper. Guest Guest40285 Posted May 6, 2014 Share Posted May 6, 2014 I'm guessing all the rules have changed, I came to Aus on a work visa 20 years ago, applied for PR in that time and got it, I have a criminal record in the UK and a long list of convictions and time in both juvenile and other corrections, back then you had no chance if you had been convicted of drug, terrorism, or sexual offences, I had to supply authentic copies from my local constabulary of my record, probably no help mate, but good luck with it all, Cheers Matt. r and c Posted May 7, 2014 Share Posted May 7, 2014 Hi make sure you get ACRO police check report which shows your not wanted in UK and fill in a form 80 early on in the process Which shows you hav'nt got a warrent for your arrest in any other country also a statutory deceleration from a soliciter will help ive just done all my application and forgot about a miner conviction over 25 years ago and now more waiting for form 80 to be sorted there very sensible the Aussies they can see you've turned your life around they won't hold it against you the just want proof good luck Link to comment Share on other sites More sharing options...

snapper123 Posted May 10, 2014 Share Posted May 10, 2014 I would say think about going it alone (depending on the crimes ). it has been 17 years since the crimes were committed and you have proven yourself to be a redeemed Character. It is a fairly simple process .From what i have learnt the immigration department would require you to write a letter detailing all your past individual crimes including any mitigating circumstances you would also require references from employers etc. I have heard of people being taken to the cleaners by some agents so be careful and get a Full quote if you go down this route.Well done for sorting your life out and Good luck Link to comment Share on other sites More sharing options...

As snapper said just write a letter giving a personal account of what happened with dates etc. Explain how your life has moved on and get character references. Debbs72 Posted June 18, 2015 Share Posted June 18, 2015 Hi, if I can help with a little bit of advice. When you apply for your police checks also apply for a subject access. My son had a minor fight when he was 15 and it showed up on his police check saying no live trace. Immi then require you to explain it sometimes. The subject access takes about 40 days to come through sometimes sooner but it gives them all your details and shows you are no longer a threat since that last conviction. It saves a lot of time and only costs £10 I'd apply for that straight away same website you get your police check from. As soon as my sons Immi officer had that they were happy as it shows full proof of nothing else pending. Immi call it a step down report. Hope this helps. I've had my skills assessment done and now just waiting for the State's new job lists to come out.. With regards to passing the character test I have applied for the subject access and the police record through Acpo to be armed with these for the next stage... Fingers crossed..!
