Please help! Any advice regarding unable to meet english requirement on time of application

My father is on a 457 Visa. He is eligible for a an employer-sponsored nomination scheme for permanent residency under transition scheme.He has lodged his application last September.

 

 

His case officer mailed him and told him hat he needed to show another IELTS test result as the one he submitted does not require the minimum english requirement. He got 6 in all the components except for the listening. He only got 4.5 on this. It is mainly due to the fact that my dad has severe hearing loss as diagnosed. However, we weren't able to inform the test centre of this so no special adjustments was made and he took the test anyway. What's done is done.

 

 

The other way to prove is to show at least 5 years in secondary or tertiary education in English medium but my dad only has 4 years of this.

 

 

Otherwise, he said that we might have to withdraw our application or else, it might be refused on the basis that my dad is unable to meet the English requirement.

 

 

My dad is willing to sit in another exam. We don't know yet if his CO will allow this. And we are willing to pay the second installment also if applicable (for applicants that are assessed as to not having minimum English requirements) (Is this applicable to the main applicant? Our CO didn't give us this option. Is it acceptable to ask him if we could do this?)

 

 

We badly need the visa as we were main victims of the recent supertyphoon. Our little city is still recovering.

Unfortunately you need to prove it at time of application. As you have already suggested the best option is to withdraw and start the application again, when your father has taken an English language test and received the result.

 

Edit: I notice that you are already discussing this with the CO, if they have suggested you withdraw I would do this, as if you are rejected you can be banned from the country for 3 years.

Thank you for your advice. Really sad as we shelled out almost $9000 for the application. Still hoping that his CO will allow my dad to sit in another IELTS exam. I just remembered that he asked my dad if he has any more recent IELTS test (i hope that implies that he accepts IELTS result beyond the date of the time of application)

 

Regarding the second installment(i attached an excerpt from immi.gov.au in a photo) , do you have any idea about this? Is it good to initiate talking about this to our CO without him advising us of that? Much appreciated x

Well you can ask the CO if you can sit the IELTS now, but if they say no you should withdraw the application and start again. The IELTS should have been done before applying, this requirement is clear.

 

Just to comment on the response above, you will not get banned from Australia for three years just because you made a mistake with the application. What a ridiculous thing to say!

 

There is no point even thinking about second application fee at this point.

Thank you Rupert! Yes, i know. Actually a little bit upset to have overlooked that! I just comfort myself with "what's done is done" really. Hoping for a positive response from our CO. That's just what i have to do now, right?:(

 

Actually I just read your link more closely, I am surprised it mentions second application charge for the primary applicant, never come across that before. It might be worth asking about, yes.

Yes, it mentions a second installment for main applicant. Holding on to that (and the other cheaper remedy of course which is to allow my dad for another ielts) Will ring CO tomorrow morning for sure! Thanks!

The second instalment for primary applicants is limited to very few circumstances, i.e. high income earners and ministers of Religion (who are exempt from paying).

Thanks for the input. What is the best thing to do now aside from waiting for CO's response? Have you had any circumstane like this before?

Honestly I don't think you have any options. See if they will take a later dated IELTS (unlikely) or withdraw application.
