Hi Guys,

First of I know this is a very personal decision - still I'd like to see what your opinions are (especially Raul and other Migration specialists).

Occupation : Marketing Specialist, ANZSCO 225113

Transition stream :

  • In about 75 days I will qualify to apply under the 2 years 457 (same employer) category.

Direct Entry :

  • I have a positive VETASSESS skills assessment towards my Master of Marketing + previous work history
  • I nominated the Marketing Specialist for my 457, I will nominate the same for my ENS186.
  • IELTS is not an issue for me, its simply the cost.

Given my employer may take 2-4 weeks to organise the NOMINATION paperwork, does it make sense in pushing and going under the Direct Entry? I have seen people previously suffer from waiting (i.e past June 30th in case new rules come into place).

All other paperwork for my VISA (police clearance etc is actually ready, I just the NOMINATION paperwork from the employer).

Thoughts?

It really depends on the individual circumstances.

The nomination application under TRT is more involved as it is at the nomination stage where you have to show that you have been employed on your 457 for a period of at least two years.

Under Direct Entry, the nomination is a bit more straight forward, however, at the visa stage you have to be careful that you have the required three years of employment experience. You need to be sure that the 3 years experience is skilled, in the nominated occupation, etc. This can become complicated if the 3 years is made of various positions with multiple employers.

Hi Raul,

You tell it like it is and your posts always have a voice of reason in them, I appreciate it!

Only 2 employers. The most recent work experience i will be including as part of (Marketing Specialist, ANZSCO 225113) is :

Aug 2007 - December 2009 : Fulltime marketing role (overseas, fully documented with relevant papers)

Jan 2010 - December 2011 : Master of Marketing in Sydney uni

Mar 2011 - Ongoing : Working in a Global Internet Marketing and advertising company and moved up the ranks to a relatively mid-level management.

This is in addition to positive VETASSESS skill assessment.

Guess I should consider taking my IELTS... and look to go down the Direct stream..

So I have a slight setback.

I got a PCC done in Jan 2013 from the Police Commissioners Office. DIAC issued a circular in Feb 2013 to state that PCC now needs to be made from the Regional Passport Office - http://www.immi.gov.au/allforms/character-requirements/character-penal.pdf

Since I live in Sydney I am at the mercy of the VFS processing centre : http://www.vfs-in-au.net/policeclearancecertificate.html

Pray for me guys?!

Hi wonder if you can help us aswell under the direct entry does it have to be the last 3 years or just 3 years in the trade, as hubby was out of work in the UK (that's why we've come over here) but has been doing his trade since school (on and off with redundancies) and he's now nearly 50 so we have to get it sorted quite quick :(

Thanks Debbie

Hi Debbie,

Generally they would question large gaps. Has he worked atleast 3 years in the last 5 years in his area of trade? Also is it very relevant and can he evidence this through appointment letters, payslips etc? It is very situational.

Additionally :

1. Does your husband have an Australian employer that is willing to sponsor ?

2. For the ENS186-Direct Entry scheme your husband would need to submit a Skill assessment from the relevant certifying authority for his trade.

I would suggest reviewing the latest checklist here : http://www.immi.gov.au/skills/skillselect/index/checklists/186-applicant-checklist.pdf

(particularly page 2/3/4)

Using the checklist, see how far you get with a mock "application" and consult a reputable migration agent/lawyer who can guide you. If need be pay the $$ and lodge via a Migration Lawyer who can go to review/appeal if things get complicated.

Hope this helps!
