    Does the below apply for 143 or 804 or both?

    The applicant:

                                  (i)  does not hold a Subclass 870 (Sponsored Parent (Temporary)) visa; and

                                 (ii)  if the applicant held such a visa--has left Australia since that visa ceased to be in effect.

    Also, where can I find the latest Migration Regulations 1994 Schedule 1? 

    Any help is appreciated

    Hi @LindaH27,

    Do you know or have any info if someone is one 804 bridging already can the govt change rules to affect them as well? or will it be for anyone who applies after the new rule/legislation gets passed?

    Hi @Ollie1234, I haven't read the entire convo or context but your signature suggests you have applied for 143 and you also saying you have 804 bridging visa.
    Are you questioning for someone else or generally about 804 bridging visa?

    Subclass 600 - if you get the 3 years validity visa will give you a maximum of 12 months stay in 18 months period, which means they will have to go out of Australia within 12 months and stay outside for 6 months before entering again.
    Other option is Subclass 870 which has an option of either 3 years or 5 years. A bit expensive but if you think it in a way, they won't need to travel back for that entire period then it's a good option. It is a 2-step process, and all details can be found here - (Subclass 870) Sponsored Parent (Temporary) visa (homeaffairs.gov.au).

    Also, as you mentioned you have applied for 143 in Sept 2018, its highly unlikely and based on a calculator floating around (I can't find the link but if you read previous posts, you might find it) you won't hear back from Immi for the next 5 years. So, based on your situation, decide accordingly what suits you better.

    To be honest and say this very humbly, there is a very unlikely chance of her getting 143 granted before October 2023. You might (*might*) get request to submit additional documents before October 2023 but then the remaining process of AoS will also take some time. So IMHO chances are bleak, and she would have to leave Australia after her Visitor visa expires.

    If one wants to remain in Australia upon the expiry of an existing 870 visa and is to seek a renewal 870 visa another visa will therefore be required between the two subclass 870 visas.

    This might be – say – an onshore visitor visa (subclass 600), or a student visa (subclass 500).

    Key in this regard is avoiding the inclusion of condition 8503 No Further Stay on the visa.

    My parent's 870 is nearing its term and I was wondering if there is a minimum time period that I cannot apply for a 600 when her 870 expires?

    There is 90 days which needs to be maintained before applying for another 870 but I can't find any other info regarding 600 once 870 expires. Any info will be appreciated

    I applied for my Mum's 143 in July 2017 and according to the numbers from the spreadsheet I reckon we will still be waiting till 2024 for it to be processed to the next stage.

    Just wondering If I can swap the 143 application to a 864 application (provided there is no 8503 on her 600 grant notification) and if so will there be any consequences on her timeline? Will her file get a new queue date?

    Any help is appreciated.

    Hi there, yes you can apply for a tourist visa while the 143 is under processing.

    One of the conditions to apply for 804 is

    • not have already applied for or hold a Sponsored Parent (Temporary) (Subclass 870) visa when applying for this visa

    What I would like to clarify is if someone has recently started the process of 870 and only applied for the sponsorship part will that be considered as "already applied for" as per the above clause OR is it when the applicant has applied for the 870 is when they consider it to be applied.
