Hi any body waiting from December . My agent said that the case officer asked for few documents which were already provided and than case officer is in silent mode. My agent already send two emails about any documents further needed but no reply from case officer it was happened in 26 June 2019 . I don’t know whether case officer has gone into hibernation or he has fallen asleep on his desk .Any Suggestion

@Jerita Seeing as though you're still within the waiting / processing period - best suggestion: be patient and wait it out. Unfortunately, not much more you can do.

    Hi Guys

i have lodged the 186 TRT nomination as cook company turn over 1.8 million but loss and profit statement says $116 loss is its still possibility for approval of nomination company accountant supportive letter been attached with application

can someone let me know please

    thank you

@Nagra77 This is dependent on the CO assigned to your case and other financial factors associated to your companies nomination. It's not all based off profit / loss.

Unfortunately, there are too many factors here for someone to confirm this confidently. Best case, would be to wait and hope for the best.

Just a quick question my boss didn’t pay my super from a while and I talk to him about it but no appropriate answer and he didn’t give me any shit since then if I go to fair work regarding the matter is not gonna affect my visa .. my visa was 457 to 186 I got my permanent residency in July last month .. i was working for him from last four years .. thanx

@ssk84 This is interesting. How long is a "while" as the department would typically go through and confirm you / your companies super contributions before decisions are made.

    As for your question:
You should be fine reporting this, however, I'd confirm with an MA (just to make sure) as if it's been longer than a given period, the company could be in breach of it's sponsorship licensing, which I feel could affect your visa?

I second your opinion. If someone can provide all the right matrix that impacts the outcome of an application and then people stop asking question outside those parameters.

It is waste of time, when someone post some question or outcome and then people start asking how, when, what, congratulations, thank yous.

@BigBan This is "ideal world" thinking 😛

    - It might work for a day, but then we'll be right back to it all - joys of a dynamic forum as this.

Thanks for your response, but how does number of lines matter?

@BigBan I suspect this is in hope that it would keep the posts to a minimal size, hence, increasing the amount of posts per page.

Although I can appreciate that, I personally, would rather have a few lines (as most already are), as it's much easier to read VS all information crammed into 2 lines.
    - Never mind the fact that we already battle getting people to follow this concept (adding a signature), imagine trying to further manage / police the length of said signature 😮

  6. Something I though you guys might find interesting -  page showing what's needed in order to become an Accredited Sponsor (with priority processing)

    Hi everyone,

can anybody help or give me some suggestions? My nomination got refused on 25/07/2019.

    Nomination applied 28/10/2016,

    visa applied 01/11/2016.

In 2017 one of the stuffs in my working place sue my boss to the fair work, because unfair dismissal and under payment. My boss got penalty. In 01/03/2019,my boss received a bar from the immigration. The immigration bar the sponsorship from sponsoring more people until 01/09/2020. My boss told me this bar on 13/03/2019. After that the boss also told me that he stoped the service with the agent. I was worried a lot. I asked many agents about this. But my boss said if I cannot find a lawyer they won’t continue help me because they don’t trust any agents.  That time was already weekends, only one lawyer agent answered my phone located in Sydney named Agape Henry Crux. The lawyer named Jason answered my phone and analyzed my case in 16/03/2019 and said I have a big chance to win my case, they sign a contract with me.  I paid them $7800 including gst. And the lawyer team did submission about the bar to the immigration and take carriage with my case and told the immigration I have changed to this agent. In May,I didn’t get any news from immigration and worried a lot. So I asked my lawyer team if they can write a complaint to the immigration. The lawyer team replied me that because this is an additional instructions and I need to pay $1000 (plus Gst). I think it’s really unfair for me and argue with me. I signed the contract said they will help me with case and this is a part of my case. I didn’t pay them any more money and I wrote the complaint to the immigration by myself. The lawyer team said my case is very urgent and they said they helped me a lot so that’s why charge so much for me. But the immigration refused the nomination because my boss bad record. The fact proved that what  my lawyer did does not work at all. Before this,I asked my lawyer if my case fail,do you refund me? They said if it is their fault yes,if not no. After I received the refusal letter from immigration and asked the lawyer team if they can return part is my fee, they said they don’t pay the result fee. I showed them the screenshots to show that they promised me before if it is their fault they will refund me.

Wow, it sounds like this layer / company took you for a ride. Sorry to hear the bad news, hoping things work out for you.

Hi @Hex. We all including my son did the immigration medical check up on the same day late June which is way more than 5 days. Prior to medicals my son had a regular check up in the local medical center using interim medicare card. No we didn't provide any HAP ID during his check up at local medical center. We didn't even know our HAP ID until before MA provided us after immigration requested it. This was after my son's normal checkup at the local medical center.

@bsuman A normal check up means nothing to immigration - all medicals need to be related to a HAP ID.

    1. If your son did a medical which had a HAP ID attached to it (typically at a BUPA center), then you should be fine.
    2. If you're saying that your son had a general check up and hence, doesn't need a check up, then your likely wrong and one would be needed.
    - With a HAP ID which links back to your visa application.

I think I've explained this a few times now, so my next suggestion would be - if you're still not sure, to please contact your MA and ask for their advise / input.

Hi @Hex . Created and Immi Account and IMMI Status Shows "Further Assessment". In the details it shows medical submitted for me and my wife. While my son's show "Medicals in Progress". We all did the medicals on the same day. However Immigration had asked for medicals only for me and my wife as my son's was already in "Medicals in Progress". We had a  interim medicare card and my son had visited the doctor. This visit happened before immigration had asked for our medicals. I informed MA that my son's doctor visit was just a normal one. He provided me with another HAP ID for my son. The same HAP ID that was generated while I had submitted EOI for 189 visa. Don't know why my son's medical still says in progress. Very anxious and confused.

@bsuman If you have not done a medical for your son (which included you walking into a medical center, providing a HAP ID which included him), then it might be that you'd need to still complete one for him.

In saying that, the data on that page can also be out of date / medicals not uploaded as yet (typically take 5 working days to upload).

My suggestion, if you're anxious and not sure - contact your MA and ask for confirmation on this.
    - Worse case, you'd need another HAP ID and medical for your son.
    - Best case, the information has not yet been uploaded and it's out of your control.

I'm embarrassed to say I couldn't figure out how to check the Immi status. All I can see through that page is the status of my bridging visa, which is active.

@younghote No need to be embarrassed, it's what we here for; hopefully these screenshots will help.

Go to the following address: https://online.immi.gov.au/lusc/login --> create an account and login (if you don't already have one).

    image.png.ae09de4d658787fe157006564909c73a.png

Then click Import --> you should then get a new item in your list, your visa application.

    Hope that helps.

Thanks @Hex. I do not have an immi account. Can I create one by myself? And do import application. Doesn't this create any problem as my agent's immi account is probably linked with my TRN.

    @bsuman
1 - Yes you can create your own account, try it and you'll see - most people here do it.
2 - No, it will not affect your MA's account in any way - they are completely separate, you are simply importing your own visa application.

  12. Just now, bsuman said:

Hi @Hex I am also on the same boat. I currently have a 457 visa and my bridging visa will kick in on 05 May 2020. How can I see the status myself without bothering to ask MA.

@bsuman If you have already lodged you PR application, you would have received a bridging visa that contains a TRN number, attached to your case.

With this information (and a few personals), you can login to your immi account --> click import application --> enter the TRN and passport number --> click import and you'll see your application appear in your list.

I strongly suggest, if you have an MA - to do nothing other than view it for status updates - rather let the MA make any changes etc. (that's what you paying them for anyway).

Been a silent reader for a while, though I should contribute a bit as well.

It's been more than a month since I've got the nomination approved. "Waiting for something" has to be one of the most annoying things in the world.

It is nice to know that this forum exist where you can see a lot of other people's experiences, know what to expect.

    @younghote Just noticed that your signature has this labeled;

    - "IMMI Status: MA would know"

Thought i'd let you know that, if you have your bridging visa, with the TRN number you can login to your Immi account and import your visa application and view the status yourself
    - Login to your account, click Import --> enter TRN / passport number and a few other bits of info.

Silent reader here and extremely frustrated one..

    Occupation: Electrician

    Visa applied 08/08/2018

Added newborn to application March 2019

    Nomination approved& S56 request 08/05/2019

    Medicals done 20/05/2019

    Passport for newborn sent 06/06/2019

Haven’t heard anything since.. Status: Further Assessment and last updated 17/06/2019

Extremely frustrating as we won’t get Centrelink help for childcare until PR approved. Also extremely annoyed reading people getting their visas in just a couple of weeks/months. Good for them but not fare in my opinion!

Not sure if pregnancy and having a baby mid application affected but been a long wait since nomination was approved. Would love to know if we can stay or if we need to leave as it’s not easy to stress with a baby here now too.

@Kinnu I'm afraid I don't think having a child during the process adds any delays (as long as all the documents are in order).
    - We were in the same position with a new child - the child care was really needed (so I completely understand).

Unfortunately, just need to hold on - it shouldn't be too much longer (we'd hope). Having the s56 means they've at least opened your case and should hopefully come back soon.

Didn't know that we shouldn't spend a few words to participate in the happiness of forum members rather than a click emoticon which expresses nothing. I knew the emoticons existed. Anyways thanks for the policing. I'll refrain from any comment from now on. Better a silent visitor.

@nanda There's no need to take it personal, we went through a phase (a while back), before the emoticon was introduced, whereby many people where adding posts that read purely "Congrats" etc. This started filling up the forum and causing frustration on many peoples parts. Hence, the introduction of the new emoticon.

It's all in effort to help make the forum a better place, with valuable context - rather than people having to trawl through pages on simple "congrats" messages.
    Thanks for the understanding.

@nanda Not to be a party "pooper", but possibly something you're unaware of (I've seen a few posts of yours like this) - there's a "congratulations" emoticon available for all posts.
    - Using these emoticons, help keep the threads valuable, by containing more relevant / helpful information.

Waiting is killing me and my wife day by day

@Mick1983 Why would your wife not be able to join you until you have PR?

    - Do you currently have a 457 sponsor or similar?

Hi guys, got the following reply from my MA,

"We only need to submit a new nomination if your pay is going to be decreased, not if it is increased. There is no need to update Immigration of this change".

      @pravincv @Muppett @Hex

@Roni S I tend to agree with your MA.

On a personal note, I went through a same situation whilst awaiting my visa, I told my MA and we updated the information within my application (didn't lodge a new one) and it was never used / looked at. Personally, I was always about, too much information couldn't hurt but i'm sure I could have left it out the application all together if I so chose.

@Hex Good morning and thanks you for your helpful response and time. You really give extra effort to this form and we really appreciate it. Nevertheless, I am not MA so don't take my advice as a rule. Furthermore, when my friend try to show English evidence for his partner he submitted overall 4.5 result and he got his visa. He was confused also so MA send him legislation which is this  only for Secondary applicants functional English https://www.legislation.gov.au/Details/F2014L01668. Now, about your case there is a different legislation which shows exactly what is component English, professional English or superior English. In those legislations it's clearly mentioned that you should have in each. However in functional legislation it say overall. Hopefully, this sounds good. Once again I am not MA. I just try to show up what is there in sets of rules which I come across. - Thank you.

@Amit Gupta Ahh, so it seems the difference then is between the functional (overall) and professional / superior (on each band).

Learnt something new here - thanks!

    @Amit Gupta

Thank you and taking the time out to help, actually I was confused with the immigration website and worried by different wordings.

So it is cleared now that 4.5 band score overall is needed.

I will upload on Monday, on my immi account.

    Thanks

@Amit Gupta Sorry to jump in here and possibly confuse things a little more here - the score required, would be 4.5 (at least) on EACH band.

That English from the snippet posted doesn't help things, however, it basically implies that you need a 4.5 at least, on EACH band (not overall).
    - That and the same thing happened with me and my wife, she got overall more than her required 80 (she's a teacher) but got a 7.5 in one section and still failed.

    Thanks @Hex for your reply.

It sounds so very unfair. Do they consider processing time at the time of application or current. Because now the processing times have increased people will have to wait even more compared to the time they have applied.

@BigBan That's the kicker! I've had confirmation from 2 MA's that they take processing times as of at the time of the complaint.

    - Meaning, if the processing time was 1 month when you lodged and you complained at month 2 (processing time at this stage was 2 months) - they'd tell you, you're still within the processing times (it would need to be 4 months to be double). Very unfair but hey, what can we do!

Does anyone know what is the significance of processing time available on department's website. I mean is it only for reference to the applicants or does it provide any right to the applicant to take some action if the department is not processing the application within that time frame. I can see a lot of applicants on this forum who is waiting for almost 2 years now.

@BigBan I've heard on more than a few occasions that the department would only take your complain serious if you've been waiting a minimum of double the processing times.

    - Unfair, but that's what I've heard and seen in the past.

    Thanks for your reply @Muppett & @Hex 🙂

Ok so to explain this a bit further... The MA advised lodging the nomination and the application with the old ABN acting as a trustee for the new ABN. I am not allowed to view the nomination documents as my company has a very strict policy; I just know that we had to supply financials for both companies and they requested further documentation last month. The immigration agent ensured me that, as long as the businesses are associated entities and are sharing the same management, the nomination ***should*** be ok. I'm just getting frustrated because a lot happened in my company in the last few years (change of ownership, management, ABN, trading name etc), and there is no transparency on that, so I worry that it will affect my application. I see that most nomination get approved within days, and without asking for extra documents...

@furbibi If this is the case, then i suspect you should be fine. The fact that they are requesting additional documentation also seems to be a positive.

Unfortunately, you will be at the will of the CO and the findings of same - holding thumbs that all goes well!
